It is the intent of this article to minimize damage to property
and to ensure safety of individuals and to generally promote the health,
welfare and safety of the residents of the Village by prohibiting
the running at large of dogs, and to provide for the seizure and disposition
of such dogs.
Definition of terms as used in this article are as follows:
AT LARGE
Off the premises of the owner and not under the immediate
and full control of the owner or person in charge thereof, either
by leash, cord or chain.
DOG
Both the male and female animal.
OWNER
Any person or persons, firm, association or corporation owning,
keeping or harboring a dog.
It shall be and hereby is declared unlawful for a person owning,
possessing or harboring any dog to allow such dog to run at large
upon any private property or public or private highway, street or
sidewalk or other public place in the Incorporated Village of Huntington
Bay.
A Dog Warden or any peace officer shall seize any dog running
at large. All proceedings by the Dog Warden or peace officer or other
authority subsequent to seizure shall be conducted pursuant to the
provisions of the Agriculture and Markets Law of the State of New
York. Every dog seized shall be properly fed and cared for at the
expense of the municipality until disposed of. The owner of a dog
seized may redeem the dog within five days of the seizure upon payment
to the Village Clerk of a fee in the amount of $5 and procure a license
for said dog. Any dog not so redeemed within such period of five days
shall be sold or disposed of by the Warden or peace officer. In case
of sale, the purchaser must pay a purchase price of $5 to the Village
Clerk and also obtain a license for the dog.
For the purposes of this article, it shall be presumed that
any dog harbored in a one-family dwelling is owned by all adults in
said one-family dwelling.

Any person or persons violating any provisions of this article
shall be liable for and pay a fine of not less than $50 and not more
than $250 for a conviction on a first offense and shall be liable
for and pay a fine of not less than $100 and not more than $250 for
a conviction on each subsequent offense.
