This article is enacted pursuant to the authority conferred
by the Vehicle Code, Act of 1976, June 17, P.L. 1962, No. 81, § 1,
as amended, and is intended to include and be subject to all provisions
of §§ 4902 and 6102 of the Vehicle Code, 75 Pa.C.S.A
§§ 4902 and 6102, and all Pennsylvania Department of
Transportation regulations promulgated or to be promulgated under
the Vehicle Code.
Based upon engineering studies conducted by PADOT and/or its
consultants, the Township Engineer and/or Township consultants and/or
other contracted parties, and in accordance with the relevant provisions
of the Second Class Township Code, the Tobyhanna Township Board of
Supervisors has determined that vehicles with a gross weight in excess
of 24 tons or combination trucks in excess of 29 tons will cause excessive
damage and create an unnecessary risk of failure to the bridge over
the Upper Tunkhannock Creek in Tobyhanna Township on Old Route 940
(TR-644), and therefore such vehicles in excess of 24 tons and combination
trucks in excess of 29 tons shall be prohibited from traveling, traversing
and/or otherwise using the bridge over the Upper Tunkhannock Creek
in Tobyhanna Township on Old Route 940 (TR-644).
Pursuant to the findings of the Board of Supervisors as set
forth in this article, and by authority of §§ 4902
and 6102 of the Vehicle Code and the regulations promulgated therein,
no motor vehicle with a gross weight in excess of 24 tons or combination
trucks in excess of 29 tons shall travel, traverse and/or otherwise
be operated on the bridge over the Upper Tunkhannock Creek in Tobyhanna
Township on Old Route 940 (TR-644).
The Township shall erect or cause to be erected and maintained
restriction signs designating the restrictions as provided in this
article and as required by the Vehicle Code.
Any person operating a vehicle or combination truck upon a road
or bridge in violation of a prohibition or restriction imposed under
this article is guilty of a summary offense and shall, upon conviction,
be sentenced to pay a fine of $150 plus $150 for each 500 pounds,
or part thereof, in excess of 3,000 pounds over the maximum allowable
weight in accordance with the Pennsylvania Vehicle Code at 75 Pa.C.S.A.
§ 4902, as amended.
