1. That certain document, three copies of which are on file in the office
of the Secretary of the Borough of Mifflinburg, Pennsylvania, being
marked and designated as, "The BOCA National Building Code, 10th Edition,
1987" as published by the Building Officials and Code Administrators
International, Inc. be and is hereby adopted as the building code
of the Borough of Mifflinburg in the State of Pennsylvania; for the
control of buildings and structures as herein provided; and all regulations,
provisions, penalties, conditions and terms of the BOCA National Building
Code, are hereby referred to, adopted and made part hereof as if fully
set out in this Part.
2. Savings Clause. Nothing in this Part or in the building code hereby
adopted shall be construed to effect any suit or proceeding impending
in any court, or any rights acquired, or liability incurred, or any
cause of causes of action acquired or existing, under any act or ordinance
hereby repealed; nor shall any just or legal right or remedy of any
character be lost, impaired or effected by this Part.
3. Date of Effect. The Secretary shall certify to the adoption of this
Part and cause the same to be published as required by law; and this
Part shall take full force and effect immediately after the date of
final passage and approval.

1. The office of Building Official is hereby created and the executive
official in charge shall be known as the Building Official.
2. The Building Official shall be appointed by the Borough Council.
His appointment shall continue during good behavior and satisfactory
service. He shall not be removed from office except for cause after
full opportunity has been given him to be heard on specific charges.
3. During temporary absence or disability of the Building Official the
appointing authority shall designate an acting Building Official.

It shall be the duty of the Building Official to enforce all
laws and ordinances relating to the construction, alteration, removal
and demolition of buildings and structures.

The following sections of the BOCA National Building Code, Tenth
Edition, 1987, its supplements and amendments, is hereby revised as
follows:
A. Section 117.4 is revised to read as follows:

"Section 117.4 Violations and Penalties. Any person who shall
violate any provision of this Code or ordinance or who shall fail
to comply with any of the requirements, regulations, conditions or
terms thereof or who shall erect, construct, alter or repair a building
or structure in violation of any approved plan or directive of the
Building Official or of a permit or certificate issued under the provisions
of this Code, and ordinance, and also any owner of a building or structure,
or a portion thereof, or of the premises where anything in violation
of this Code and ordinance shall be placed or shall exist, by any
architect, engineer, builder, contractor, agency, person or corporation
employed in connection therewith and assisting in the commission of
such violation or violations, shall be guilty of a summary offense,
and upon conviction thereof in a summary proceeding before a District
Justice, be sentenced to pay a fine of not less than $100 nor more
than $300 and/or be imprisoned for a period of not more than 90 days.
Each day a violation of this Code continues shall constitute a separate
offense."

The Building Official, in the discharge of his official duties,
and upon proper identification, shall have authority to enter any
building structure or premises at any reasonable hour.

The building permit fee shall be as follows: a minimum of $2
up to and including a cost of construction of $4,000, with an additional
$0.50 per $1,000 over and above $4,000.

The fire limits of the Borough are hereby established as the
entire Borough of Mifflinburg.

No building permits shall be required by the Borough of Mifflinburg
for any building maintenance on any buildings or outbuildings within
the Borough of Mifflinburg, Union County, Pennsylvania.

The BOCA Code is hereby amended to read as follows:

Section 124.2: Appeals Board. In order to protect existing structures
in the jurisdiction by vigorous enforcement of the provisions of this
Code, there shall be and is hereby created a Code Appeals Board, hereinafter
referred to as the Board, consisting of seven members who shall be
appointed by the Borough of Mifflinburg, as follows: two members for
five years; one member for four years; one member for three years;
two members for two years; and one member for one year. Each intitial
member shall serve for the period, the earlier of which is until the
first day of January next following the expiration of the term of
their appointment or until a successor has been appointed. Thereafter,
each new member shall serve for five years or until a successor has
been appointed.
