This chapter is to establish the residency requirements for
the appointed offices of Deputy Town Clerk, Budget Officer, Deputy
Highway Superintendent, Town Engineer, Court Clerk, and Building Inspector/Code
Enforcement Officer for the Town of Rush.
This chapter is adopted pursuant to Municipal Home Rule Law
Section 10(1)(ii)(a)(1) which grants to local governments the authority
to enact local laws regarding the qualifications of local officers.
This chapter shall supersede Section 23(1) of the New York Town
Law in its application to the offices of Deputy Town Clerk, Budget
Officer, Deputy Highway Superintendent, Town Engineer, Court Clerk,
and Building Inspector/Code Enforcement Officer for the Town of Rush.
The persons holding the offices of Deputy Town Clerk, Budget
Officer, Deputy Highway Superintendent, Town Engineer, Town Court
Clerk, and Building Inspector/Code Enforcement Officer for the Town
of Rush need not be residents nor electors of the Town of Rush; provided,
however, that such persons shall reside in the Monroe County or an
adjoining county within the State of New York.
