As used in this chapter, the following terms shall have the meanings indicated:
PORTABLE HOME STORAGE UNIT
Portable sheds (commonly referred to as PODS®) that are loaded with materials and placed on a residential property for the purpose of temporarily storing materials. The use of the reference to PODS® shall not be construed to be limited to a particular brand or company providing the portable home storage unit, but is referenced for easy identification of the type of unit regulated.
Portable home storage units are permitted in residential properties in residential zones for a period of 60 days. At the expiration of the sixty-day period, applicants may seek one thirty-day extension only for good cause. A portable home storage unit will be permitted only once in any twelve-month period. Under no circumstance shall a portable home storage unit be used as a shed or for long-term storage on a residential property in a residential zone. On all nonresidential properties and in all nonresidential zones, portable home storage units shall be permitted.
Portable home storage units are prohibited from being placed in streets or the front yard of a property, except as provided in § 134-5. If placed in the driveway, portable home storage units must be kept in the driveway of the property at the furthest accessible point from the street. No pod can be placed on a property if it is deemed to be a sight obstruction for motorists.
Only one portable home storage unit may be placed at any residential property at one time. On all other properties, there may be no more than one unit per acre.
A. 
The Zoning Officer or the Township Administrator may temporarily waive the restrictions of these requirements for up to 60 days at a time if the placement of the portable home storage unit is in association with the issuance of a construction permit or in the case of an emergency, such as, but not limited to, residential fire, hurricane, or natural or manmade disaster causing substantial damage to a residential property.
B. 
Any container to be placed on a street or right-of-way pursuant to this exception shall be placed on the street in a legal parking space, not designated for use as a handicap parking space as designated by the Township and shall not cause a view obstruction for motorists. A container parked on or along any street, right-of-way or other public property shall be equipped with and display markers consisting of all yellow reflective diamond-shaped panels having a minimum size of 18 inches by 18 inches. These panels shall be mounted at the edge of the container at both ends nearest the path of passing vehicles and facing the direction of oncoming traffic. These markers shall have a minimum mounting height of three feet from the bottom of the panels to the surface of the roadway.

No temporary storage unit shall be used to store solid waste, construction debris, demolition debris, recyclable materials, business inventory, commercial goods, or goods for property other than at the residential property where the storage unit is located.
B. 
Storage of hazardous material within the temporary storage unit is prohibited.
C. 
Temporary storage units shall be locked and secured by the property owner, tenant or property manager at all times when loading or unloading is not taking place.
D. 
The property owner, tenant or property manager or user of the temporary storage unit must secure it in a manner that does not endanger the safety of persons or property in the vicinity of the temporary structure. In the event of severe weather conditions in which the unit may become a physical danger to persons or property, the Township may require the removal of the storage unit.
E. 
Occupancy of container prohibited. No human or animal shall occupy the temporary storage container except for the express purpose of loading or unloading the container. No heat or temperature control source of any kind shall be placed in the container. No utilities shall be connected to the container.
Any person who shall place a portable home storage unit in violation of this chapter shall, upon conviction, be subject to the penalties set forth in § 1-15 of the Shamong Township Code. Each and every day that a temporary storage unit remains on the property beyond the applicable permitted time shall be considered as a new and separate violation. Each and every temporary storage unit more than the quantity permitted on the property shall be considered a new and separate violation.
