The Town Board has become increasingly concerned with the utilization
of clothing drop-off bins throughout the Town. While many of the bins
are for bona fide charitable organizations which is commendable, others
have been determined to have been illicit and not for charity. Additionally,
many of the bins are overflowing and become unsightly creating negative
visual impacts throughout the Town. It is for these purposes that
this chapter is hereby established.
The Zoning Ordinance of the Town clearly provides that clothing drop-off bins are prohibited
unless they are part of an approved site plan. Nothing herein shall
modify the absolute condition that permanent installation of clothing
drop-off bins on commercial premises throughout the Town require site
plan amendments.
Upon registration with the Director of the Department of Technical
Services, a bona fide charity may install clothing drop-off bins on
commercial premises within the Town. The application to the Director
shall include verification of the charitable status, contact information
for immediate resolution of any issues with respect to overflowing
and pickup, the written consent of the property owner, and an acknowledgment
that the installation of said bins is terminable at will by the owner
and/or by the Town if conditions become unacceptable.
Upon review of an application of a bona fide charitable organization
for the installation of clothing drop-off bins within the Town, the
Director shall issue permission for the installation of said bins
for a period not to exceed six months, which may be renewed at six-month
intervals following a review by the Director of the maintenance of
said facilities and the area surrounding it. The bins shall be so
located as to be least visible from public highways and so as to not
interfere with any integral parts of the site plan as approved by
the Planning Board. All bins that are permitted shall contain a number
on the bin which will identify it as having had approval granted by
the Director. The Director may at any time refer the request to the
Planning Board for an advisory opinion as to the placement of said
bins or for a permanent amendment to a site plan should the same be
requested.
