Editor's Note: The preamble of this resolution provided
as follows:
"Whereas, Article 18 of the Public Officers Law of the State
of New York provides for defense and indemnification of officers and
employees of the City for municipalities which have deigned to adopt
said provisions pursuant to Article 18, § 2 of said law;
and
Whereas, the Common Council of the City of Fulton deems it
to be in the overall public interest to indemnify and hold harmless
policemen, firemen, emergency medical technicians, public officers
and other employees should litigation be commenced against them while
in the course of their employment or the performance of their duties;
and
Whereas, pursuant to Article 18 of the Public Officers Law
of the State of New York, this Council does hereby agree to indemnify
and hold harmless said policemen, firemen, emergency medical technicians,
public officers and other employees for any causes of action commenced
against them while in the performance of their duties and for performance
of their responsibilities for negligence, misfeasance and/or nonfeasance."
The City of Fulton does hereby, pursuant to this chapter, indemnify
and hold harmless policemen, firemen, emergency medical technicians,
public officers and other employees while in the course of their employment
and pursuance of their public duties incur claims against them and
require defense and indemnification and also for payment of any claims
derived therefrom, whether by way of settlement and/or verdict, and
will provide defense for those above employees or officers when actions
are maintained against said officers and/or employees as a result
of their actions undertaken in their public capacities.
