Pursuant to the provisions of § 90 of the Village Law[1] of the State of New York, the Village Board of the Village of Nyack does hereby enact this chapter for the Village of Nyack, which shall constitute the Electrical Code of the Village of Nyack and may be cited as such and will be referred to herein as "this code."

A. 
The Village Board hereby delegates to the Building Inspector of the Village of Nyack the authority and responsibility to deputize properly certified individual electrical inspectors and/or regularly employed and qualified inspection employees of corporations organized and existing to provide electrical inspection services, as agents of the Building Department of the Village of Nyack to make inspections and reinspections of all electrical installation heretofore and hereafter described, and to approve or disapprove the same. In no event, however, will the cost or expense of such inspections or reinspections be a charge against the Village of Nyack.
B. 
All such individuals or the regularly employed inspectors working for a corporation as described in Subsection A hereof shall be referred to as an "inspector."
A. 
It shall be the duty of the inspector to report in writing to the Building Inspector of the Village of Nyack, whose duty shall be to enforce all provisions of this code, all violations or deviations from or omissions of the electrical provisions of the State Building Code[1] applicable to the Village of Nyack and of the Housing Code[2] and all local laws, ordinances and the Building Code as referred to in this chapter insofar as any of the same apply to electrical wiring. The inspector shall make inspections and reinspections of electrical installations in and on properties in the Village of Nyack upon the written request of an authorized official of the Village of Nyack or as herein provided. The inspector is authorized to make inspections and reinspections of electrical wiring, installations, devices, appliances and equipment, in or on properties within the unincorporated areas of the Village of Nyack where he deems it necessary for the protection of life and property. In the event of an emergency it is the duty of the inspector to make electrical inspections upon the oral request of an official or officer of the Village of Nyack.

It shall be the duty of the inspector to furnish written reports to the proper officials of the Village of Nyack and owners and/or lessees of property where defective electrical installations and equipment are found upon inspection. The inspector shall authorize the issuing of a certificate of compliance when electrical installations and equipment are in conformity with this chapter. The inspector shall direct that a copy of the certificate of compliance be sent to the Village of Nyack to the attention of the Building Inspector. No certificate of occupancy shall be issued by the Building Inspector until a certificate of compliance has been filed with the Building Inspector.

It shall be a violation of this chapter for any person, firm or corporation to install or cause to be installed or to alter electrical wiring for light, heat or power in or on properties in the Village of Nyack until an application for inspection has been filed with a duly authorized electrical inspector. It shall be a violation of this chapter for a person, firm or corporation to connect or cause to be connected electrical wiring in or on properties for light, heat or power to any source of electrical energy supply prior to the issuance of a temporary certificate, or a certificate of compliance by a duly authorized electrical inspector.
A. 
Any person, firm, entity or corporation and/or principal of a corporation found to be in violation of any provision of this chapter shall be guilty of a misdemeanor and, upon conviction thereof, be fined in an amount not exceeding $200 for each violation and/or up to 30 days' imprisonment for the active officer. Each week in which such violation shall continue shall be deemed a separate offense.
B. 
In the event that any person, firm, entity or corporation and/or principal of a corporation shall continue a violation and the Village Board shall make a finding that such violation is detrimental to the health, safety or general welfare of the inhabitants of the Village, then the Village Board may direct the Village Attorney to apply to the Supreme Court in the Ninth Judicial District for legislative relief, directing that the violation be corrected or removed and that all costs and expenses incurred by the Village of Nyack in connection with such proceeding, including the actual cost of correction or removal of the condition causing the violation, shall be assessed against the offender and shall be added to the next year's tax roll and become a lien against said property. The Village Board may direct, by resolution, that the Village may correct violations creating emergency conditions of danger by forthwith entering the property and correcting the violation and assessing the cost of same to the violator as set forth above.
