A. 
The Village shall provide refuse collection, by its own personnel or by contract, on a regular weekly basis but at no cost to:
(1) 
Residential buildings with three or fewer units;
(2) 
Not-for-profit properties (excluding schools, post offices and hospitals), subject to compliance with § 291-9; and
(3) 
Facilities leased to Village programs or for Village purposes.
B. 
All others not covered by Subsection A above shall each provide refuse collection at their own expense by contract with a private refuse collector.
Refuse containers shall be placed on or near the curb before 7:00 a.m. on the days specified for collection by the Village in residential areas. Containers may not be placed at the curb earlier than 6:00 p.m. of the night preceding the scheduled Village collection day in the residential area.
A. 
In the Business District, refuse shall be placed on or near the curb between 6:00 a.m. and 11:30 a.m. on the days specified for Village collection.
B. 
On all other days in the Business District, refuse may be placed at the curb for collection by a private collector no earlier than 1/2 hour prior to the scheduled closing time of the individual or entity generating such refuse. Such refuse must be collected by 11:00 a.m. of the following day.

C. 
In the Business District, all multi-use rubbish and garbage receptacles shall be taken in from the curb within one hour after collection of the contents, whether by the Village or by a private collector.
No person shall throw, lay, dump, sweep or in any manner cause to be placed or permit to remain in any part of a street, sidewalk or public place in said Village any rubbish or garbage, nor shall dirty or polluted water, sewage or liquid refuse be permitted to be emptied on any part of a street.
A. 
All rubbish and garbage must be secured, tied or placed in containers no larger than 20 inches in diameter and 27 inches high with covers. Combined weight of containers and contents of bundles, cartons and boxes shall not exceed 100 pounds.
B. 
When said rubbish and/or garbage is placed out for collection, it shall be placed as near to the curb as is possible and in such manner as to ensure that none of it will be blown about by the elements. All matter such as meat, fowl, fish, vegetables or other organic matter shall be wrapped and placed into serviceable watertight metal or plastic receptacles equipped with tight-fitting lids to secure such matter against invasion by flies, vermin, rodents and other animals.
C. 
Empty paper and cardboard boxes shall be flattened and securely tied as shall all other paper and cardboard material.

A. 
All Village residents shall recycle whatever refuse or trash is designated for such treatment by the Board of Trustees, from time to time, by regulations established by resolution.
B. 
The Village will provide the properties falling within § 291-4 with regular pickup of recyclable materials, at no cost, subject to the regulations established by the Board of Trustees.
C. 
All the properties and tenants falling within § 291-4B shall each contract with a private refuse collector, at their sole expense, to pick up the materials required by the Village to be recycled. Such recycling pickup shall occur no less frequently than twice a month and subject to the limitations set forth in §§ 291-5, 291-6 and 291-12 of this chapter. Said private refuse collector shall provide its customers with whatever bins are needed by its customers to carry out the Village's recycling program.
A. 
No person shall set fire to or burn any form of refuse or other flammable substance of any nature in and upon any public street or sidewalk in said Village.
B. 
Leaves shall not be burned in the street at any time and shall only be raked or placed in the street loosely during the months of September, October and November.

A. 
The owners and/or occupants of real property shall be responsible for the regular collection and/or disposal of all refuse which may accumulate on the property owned and/or occupied by them.
B. 
No person shall accumulate or permit the accumulation of refuse on any premises owned by or occupied by him within the Village of Nyack except for the purpose of collection, which shall normally occur at intervals not less frequent than every seven days.
C. 
Nothing herein contained shall be construed to prohibit the maintenance of compost or mulch piles, provided that no garbage is deposited in such piles and such piles do not develop obnoxious odors, attract rodents or otherwise create a hazard to the health or enjoyment of neighboring property owners.
Any ordinance or portion thereof heretofore adopted by the Board of Trustees of the Village of Nyack, including specifically Chapter 25 of the Code of the Village of Nyack entitled "Garbage and Rubbish," that is in conflict with the provisions of this chapter shall, upon the adoption of this chapter, be repealed.
