There shall be established, at such place as the Common Council may direct, a public market and cart stand for the sale of hay, straw, wood, meats, poultry, fruit, vegetables and other articles usually disposed of from farmers' wagons and for standing of carts and drays.
No wagon or conveyance from which is being sold or offered for sale any of the articles mentioned in § 481-1 of this chapter shall stand in any public square, street, alley or place in the City of Fulton, except the place designated by said Common Council as provided for by § 481-1 of this chapter, and no meat, poultry, fruits, vegetables or other articles usually disposed of from wagons or other conveyances from house to house in the residential portion of the City shall be offered for sale at any street, alley, public square or place in the City of Fulton, New York, except said public market, until after the hour of 9:00.
There shall be established and maintained at said public market a scale for the weighing of hay, coal and other articles bought and sold by weight, which articles to be sold or disposed of within the City of Fulton shall be weighed upon said scales, and no person, firm, association or corporation shall deliver any coal, coke, charcoal, hay or straw without first causing the same to be weighed upon said scales and receiving from the person in charge of said market a weight ticket upon which ticket shall be in ink or other indelible substance, distinctly expressed in pounds, the quantity or quantities of coal, coke, charcoal, hay or straw contained in the cart, wagon or other vehicle used in such delivery, with the name of the purchaser thereof and the name of the dealer from whom purchased.
A. 
The Mayor shall appoint a person, who shall be a resident and voter in the City of Fulton, who shall have the exclusive control and management, under the direction of the Mayor, of said public market. He shall perform the duties required of him by this chapter and such other duties as the Mayor and Common Council may direct and shall devote his entire time to the discharge of the duties of his office.
B. 
The Common Council shall provide an office and such books and stationery as he may require for the proper conduct of his office. He shall keep and maintain in his office a book in which he shall enter the name of each and every person standing upon said market and each and every person selling produce or other articles thereon, with the place of residence of each of said persons and the date when such persons occupied said market and the product sold by them. He shall also keep and maintain a book in his office in which he shall enter the name of each person, firm, association or corporation weighing coal, coke, charcoal, hay or straw, and he shall designate the quantity and material so weighed and the date thereof with the name of the purchaser or to whom it shall be delivered at the time of such weighing. He shall deliver to such person, firm, association or corporation a ticket on which shall be in ink or other indelible substance, distinctly expressed in pounds, the quantity or quantities of coal, coke, charcoal, hay or straw contained in or on the cart, wagon or other vehicle used to deliver the same, with the name of the person, firm, association or corporation weighing the same.
There shall be charged to each person, firm, association or corporation using said public market or said scales such prices as the Common Council may hereafter from time to time fix and determine.

Any person, firm, association or corporation violating any of the provisions of this chapter shall be guilty of a violation and, upon conviction therefor, shall be punished by a fine of not more than $250 and/or imprisonment of not more than 15 days.
