As used in this Article VII, the following terms shall have the meanings set forth.
PARK AVENUE MUNICIPAL PARKING LOT
The parking lot constructed by the Borough on certain land between the westerly side of Park Avenue through to the easterly side of Boiling Springs Avenue.
A. 
Each parking space in the Park Avenue Municipal Parking Lot shall be marked by lines or markings placed at the outside edges of each space, but not the entrance to such space. Each parking space shall be designated by a number or other unique identifier.
B. 
It shall be unlawful to park any vehicle across any such lines or markings.
A. 
Except on Sunday, no vehicle may park in the Park Avenue Municipal Parking Lot for a period exceeding four hours.
B. 
No vehicle may park in the Park Avenue Municipal Parking Lot between the hours of 12:00 midnight and 6:00 a.m. prevailing time.
C. 
No person shall cause, allow, permit or suffer any vehicle registered in his name or operated by such person to be parked in the Park Avenue Municipal Parking Lot in violation of the provisions of this Article VII.
A. 
Notwithstanding § 285-38A, a vehicle may be parked in the Park Avenue Municipal Parking Lot between the hours of 6:00 a.m. and 12:00 midnight on any day without regard to the time limit in § 285-38B pursuant to a parking lot permit issued under this § 285-39.
B. 
A parking lot permit of a design specified by the Borough of East Rutherford will be issued to the owner of a specific vehicle upon submission of the appropriate application and supporting documents. The parking lot permit shall display the permit number, the make, model and color of the vehicle, and the date the permit expires. No parking lot permit shall be issued to a vehicle having more than four wheels. The vehicle must be owned by a person residing, or by an employee of a business operating, in East Rutherford.
C. 
The following must be presented and approved by the East Rutherford Police Department before a parking lot permit is issued:
(1) 
A copy of a valid New Jersey driver's license for the applicant which, except for leased or company-owned vehicles, reflects an address within the Borough.
(2) 
Except for leased vehicles (See Subsection C(5) below.) and company vehicles (see Subsection C(6) below.), a copy of a valid New Jersey motor vehicle registration for the vehicle for which the permit is sought reflecting an address within the Borough.
(3) 
Proof of the vehicle being insured in the State of New Jersey.
(4) 
If the parking lot permit is for an employee of a business located in the Borough, the name of the business, its address, the name of the employee and the hours of work of that employee. Such permit shall only be utilized by that employee.
(5) 
If the vehicle for which a parking lot permit is sought is leased, then a copy of the lease agreement must be exhibited.
(6) 
A request for a parking lot permit for a company-owned or leased vehicle must provide a letter from a responsible company official, under oath, confirming that the vehicle is assigned to that person.
D. 
The parking lot permit is to be displayed on the rearview mirror when the vehicle is parked. The permit shall be removed when the vehicle is in motion.
E. 
A one-time temporary parking lot permit may be issued to a permit holder whose vehicle is stolen or incapacitated and the holder is driving a temporary vehicle. To obtain such a temporary permit, the permit holder must have been issued a parking lot permit under this § 285-39, and, if applicable, must show proof that the vehicle was stolen or incapacitated, together with a valid registration and insurance for the temporary vehicle. The temporary parking lot permit must be placed on the driver's side of the dashboard so that a police officer can clearly see and read it. The temporary parking lot permit must be returned to the Police Department in order for a new permit to be issued.
F. 
A new permit must be obtained if a permit holder changes his, her or its address but remains otherwise qualified to be issued a parking lot permit.
G. 
A parking lot permit will automatically be revoked if the assigned vehicle ceases to qualify for a permit under this § 285-39. If revoked, the permit shall be promptly returned to the East Rutherford Police Department.
H. 
The following fees shall be paid to the Borough, through the Borough Clerk's office, prior to the issuance of any parking permit:
(1) 
A fee of $500 (for a twelve-month permit) or $300 (for a six-month permit) for the issuance of a parking lot permit.
(2) 
A fee of $5 will be charged for the replacement of the first lost permit.
(3) 
A fee of $10 will be charged for the replacement of the second and every subsequent lost permit.
I. 
Not more than 12 parking lot permits shall be issued by the Borough of East Rutherford.
J. 
A parking lot permit will automatically be revoked if the assigned vehicle ceases to qualify, if affixed to a vehicle other than the one so designated at the time of application or if the vehicle registration number on the permit is different from the one on the vehicle.
K. 
Permits issued under this § 285-39 will be valid for the following periods of time from the date of issue:
(1) 
Parking lot permit: 12 months or six months, as issued.
(2) 
Temporary permits: 45 days.
L. 
Any vehicle bearing a revoked expired parking lot permit and parked in the Park Avenue Municipal Parking Lot in violation of § 285-38 will be subject to the same penalty as a vehicle parked in that location without a valid permit.
A. 
Any vehicle parked in violation of Article VII of this Chapter 285 will be subject to a fine of $50.
B. 
Any person in possession of a parking lot permit who uses such permit in a way not authorized by § 285-39 is subject to revocation of the permit for one year and a fine of $100.
C. 
Any person(s) in possession of an invalid, expired or counterfeit parking lot permit shall be subject to a fine of $100.
