No building permit may be issued for property on which underground storage tanks have been situated unless the following requirements are met:
A. 
The application for a building permit must contain:
(1) 
A statement of the intention of the property owner and his successors and assigns to comply with all governmental requirements for remediation or removal and/or closure of underground storage tanks.
(2) 
A copy of the site characterization and remedial plan submitted to the Pennsylvania Department of Environmental Protection (PA DEP).
(3) 
A drawing and other information clearly indicating whether the proposed building is located so as to interfere with any required remediation or tank removal/closure activities.
(4) 
Where applicable governmental regulations require that the underground storage tanks be removed or closed or other remediation activity be undertaken, a copy of the contract with the qualified storage tank closure/removal/remediation in accordance with all applicable regulations has been entered into.
B. 
Assuming that all other permit conditions and requirements are met, if the underground storage tanks are not removed/closed and other remediation completed at the time of permit issuance, the building permit shall contain a condition to read as follows:
"This permit is issued on the condition that no building activity that will interfere with any necessary tank removal, closure or remediation efforts may commence, nor may an occupancy permit be issued, until all applicable governmental regulations for remediation or for the removal/closure of underground storage tanks have been met and a copy of the remedial action completion report submitted to the PA DEP has been provided to the Township Secretary. This building permit may be removed upon any instance of noncompliance with these conditions. The conditions stated herein are binding upon the successors and assigns of the permittee."
C. 
In the event that a permit is issued but full compliance with all remediation/closure/removal requirements is not forthcoming, the permit may be revoked by the Township Building Inspector or his designee and no occupancy permit shall be issued.
D. 
This Part shall apply to any "underground storage tanks" within the scope of the Storage Tank and Spill Prevention Act, 35 P.S., § 6021.101 et seq. and regulations at Chapter 245 of Title 25 of the Pa. Code.
