This Part, together with the Uniform Construction Code adopted herein, shall be known and may be cited as the Uniform Construction Code of the Township of Londonderry (hereinafter "Londonderry").

The purpose of this Part is to promote the general health, safety and welfare of the citizens of Londonderry and to conform with the requirements of the Pennsylvania Construction Code Act and the regulations promulgated thereunder by the Pennsylvania Department of Labor and Industry (collectively referred to hereinafter as the "Code").

The provisions set forth in this Part and in the Uniform Construction Code adopted herein shall take effect August 1, 2004, and shall apply throughout Londonderry.

Londonderry hereby elects to administer and enforce the provisions of the Pennsylvania Construction Code Act, Act 45 of 1999, 35 P.S. §§ 7210.1101-7210.1103, as amended from time to time and its regulations. The Uniform Construction Code contained in 34 Pa. Code, Chapters 401-405, as amended from time to time, is adopted and incorporated herein by reference as the Municipal Building Code of Londonderry.

Administration and enforcement of Uniform Construction Code within the Township shall be through the Code Enforcement Officer. The Uniform Construction Code shall be administered and enforced any of the following ways as determined by the Board of Supervisors of Londonderry.
1.
A designation of an employee of the Township to serve as the Building Code Official to act on behalf of Londonderry.
2.
Retention of one of more Construction Code officials or third party agencies to act on behalf of Londonderry.
3.
Agreement with one or more municipalities for the joint administration and enforcement of the Uniform Construction Code through an intermunicipal agreement.
4.
Entering into a contract with another municipality for the administration and enforcement of this Part and the Act on behalf of Londonderry.
5.
Entering into an agreement with the Pennsylvania Department of Labor and Industry for plan review, inspections, and enforcement of structures other than one-family or two-family dwelling units and utility and miscellaneous use structures.

All relevant ordinances, regulations and policies of Londonderry not governed by the Uniform Construction Code, shall remain in full force and effect. In addition, all construction code ordinances or portions of ordinances which are adopted by Londonderry on or before July 1, 1999 and which equal or exceed the requirements of the Uniform Construction Code shall continue in full force and effect until such time as such provisions fail to equal or exceed the minimum requirements of the Uniform Construction Code as amended from time to time. All construction code ordinances or portions of ordinances which are in effect as of the effective date of this Part and whose requirements are less than the minimum requirements of the Uniform Construction Code are hereby amended to conform with the comparable provisions of the Uniform Construction Code.

Permit fees assessable by Londonderry for the administration and enforcement under-taken pursuant to this Part and the Uniform Construction Code shall be established by the Board of Supervisors of Londonderry Township by resolution as adopted and amended from time to time.

A Board of Appeals shall be established by resolution of Londonderry in conforming with the requirements of the relevant provisions of the Code, as amended from time to time, and for the purposes set forth herein. If at any time enforcement and administration is undertaken jointly with one or more other municipalities, said Board of Appeals shall be established by joint action of the participating municipalities.

The Uniform Construction Code, herein adopted, governs if there is a conflict between the Uniform Construction Code and Londonderry Code Enforcement Offices relating to administration and enforcement provisions of the Uniform Construction Code.
