It shall hereafter be the duty of the owners of the lots of
ground respectively fronting on all the streets of said Borough to
grade and pave the sidewalks abutting thereon, to construct curbs
at the edges of the sidewalk areas, to repair and keep said sidewalks
and curbs safe and usable, and to repave the same when unsafe or worn
out.
Written notice of all proposed construction and repair of sidewalks
and curbs shall be given by said owners to the Borough Secretary and
a permit obtained for the same from the Secretary, for which permit
there shall be paid to the Secretary a fee as set from time to time
by resolution of Borough Council.
The location of the sidewalks and the width of the paved parts
thereof, of the grass plots alongside thereof, and of the location
of the curbs at the edge thereof, shall be as determined by Council
or by the Highway Committee.
The grades of sidewalks and curbs shall be fixed by the Borough
Engineer. Every sidewalk and curb hereafter laid shall be in accordance
with the lines, grades, slopes, plans and specifications fixed and
given by the Borough Engineer, as further set forth in the engineering
specifications that follow.
All paved parts of the sidewalks and curbs shall be constructed
of concrete in accordance with the engineering specifications that
follow. All private driveways and the entrances to private alleys,
wherever the same shall cross the sidewalk, shall be paved with concrete
or constructed in such other manner as may be approved by Council
or its Highway Committee.
The dimensions of curbs shall conform to the engineering specifications
that follow. Materials and construction methods of said curb shall
conform to these engineering specifications.
It shall be the duty of all property owners along every street,
after notice given in accordance with law by the Secretary to have
their sidewalks graded, laid, repaired or curbed in accordance with
the requirements of this article within 60 days after such notice,
and if said owners shall have neglected to do said work for said length
of time, the Highway Committee shall, after notice as aforesaid, cause
it to be done at the cost of said owners, and the Borough shall collect
the cost thereof and 10% additional, together with all charges and
expenses, from such owners and may file a municipal claim therefor
or collect the same by civil action, as provided by law.
When the Highway Committee determines a sidewalk or curb is
in a dangerous condition and can be repaired by an expenditure of
not more than $100, and the Chairman of the Highway Committee shall
certify that an emergency repair is required, it shall be the duty
of the abutting property owners, after notice is given by the Borough
Secretary, to have said emergency repairs made for said length of
time, the Highway Committee shall, after due notice as aforesaid,
cause it to be done at the cost of the owners, and the Borough shall
collect the cost thereof and 10% additional, together with all charges
and expenses, from such owners and may file a municipal claim therefor
or collect the same by action in assumpsit, as provided by law.

Any person who lays a sidewalk or curb in any other manner than
is directed herein, or who refuses to grade, pave, construct or take
up his sidewalk or curb and to reset or relay the same in the manner
herein prescribed, or injures or tears up any sidewalk or curb for
any purpose and fails to place that sidewalk or curb in as good condition
as it was in before, or who otherwise violates any part of this article,
shall, upon conviction, be sentenced to pay a fine of not more than
$1,000 and undergo imprisonment for not more than 30 days.
