As used in this Part, the following terms shall have the meanings
indicated unless a different meaning clearly appears from the context:
GROUTING
Filling the annular space between the well casing and bore
hole with concrete, neat cement, or other approved impervious material
to form a permanent watertight joint or connections.
WELL
Water wells, test holes for water wells, uncompleted wells
and monitoring wells.

All wells hereafter dug or constructed through any ground surface
point within the boundaries of Ralpho Township shall be grouted. Every
well shall be grouted to prevent the entrance of any surface or other
potentially contaminated water into the aquifer. All well(s) shall
be grouted to a minimum depth of 35 feet from the surface in conformance
with the current standards, specifications and requirements published
by the American Water Work Association (AWWA) Standard for Water Wells,
a copy of which is incorporated herein, and such revised editions
and pertinent sections thereto pertaining to grouting and sealing
subsequently approved by the AWWA Board of Directors.

All abandoned test hole(s), including test well(s), uncompleted
well(s) and completed wells hereafter abandoned which extend through
any ground surface point within the boundaries of Ralpho Township
shall hereafter be sealed. The standards, specifications, requirements
and procedures for sealing shall be in conformance with the current
Standards for Water Wells published by AWWA, a copy of which is incorporated
herein, and such revised editions and pertinent sections thereto pertaining
to abandonment of test holes, partially completed wells and completed
wells and sealing subsequently approved by the AWWA Board of Directors.

1. Permit required. No well shall be drilled, dug, grouted, repaired,
replaced or abandoned unless a well permit is issued by the Ralpho
Township Code Enforcement Officer.
2. Fees. A permit fee shall be established by a resolution of the Board
of Supervisors, said fee schedule which may be changed from time to
time by resolution of the Board of Supervisors.

No person, partnership, or corporation shall dig, construct,
drill, replace, repair or abandon any well accept in accordance with
the provisions of this Part. Further, no person, partnership, or corporation
shall occupy any structure on any lot, tract or parcel of land serviced
by a well for which a well permit has not be issued in accord with
the provisions of this Part.

The Ralpho Township Code Enforcement Officer is hereby designated
and authorized to act on behalf of the Township for the implementation
and enforcement of this Part on behalf of the Township, including,
but not limited to, the collection of permit fees and initiating enforcement
actions before the Magisterial District Judge on behalf of the Township
for any violations of this Part.

1. Any person, partnership, or corporation, who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a Magisterial District Judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not more than $1,000 plus costs
and, in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part continues
or each section which shall be found to have been violated shall constitute
a separate offense.
2. The remedy provided above shall not be deemed mutually exclusive.
Rather, Ralpho Township may take such other legal or equitable action
necessary to prevent or remedy any violation.
