A certain document, three copies of which are on file in the office of the Township Manager of the Township of Newtown, being marked and designated as the "BOCA National Plumbing Code, Ninth Edition, 1993," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Plumbing Code of the Township of Newtown for the control of buildings and structures as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Plumbing Code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions and changes, if any, prescribed in § 121-2 of this chapter.
The BOCA National Plumbing Code, Ninth Edition, 1993, is amended
and changed as follows:
A.
P-101.1 Title. These regulations shall be known as the
"Plumbing Code of the Township of Newtown," hereinafter referred as
"this code."
B.
P-113.2, entitled "Fee schedule," shall read as follows:
P-113.2 Fees schedule: The fees to be charged by
the Township of Newtown shall be specified by the Board of Supervisors
from time to time by resolution in applying the provisions of this
code.

C.
P-116.4, entitled "Violation penalties," shall read as follows:
P-116.4 Violation penalties: Any person, firm or
corporation violating any of the provisions of this code shall be
liable, upon conviction thereof, to a fine or penalty of not more
than $1,000 for each and every offense. Each day that a violation
continues after a service of notice as provided for in this code shall
be deemed a separate offense thereof for each day.

P-117.2, entitled "Unlawful continuance," shall read as follows:
P-117.2 Unlawful continuance: Any person who shall
continue any work in or about the structure after having been served
with a stop-work order, except such work as that person is directed
to perform to remove a violation or unsafe condition, shall be liable
to a fine of not more than $1,000.

P-304.3, entitled "Public systems available," shall read as follows:
P-304.3 Public systems available: A public sewer
system shall be considered available to a structure where the structure
is located within 150 feet of a public sewer main or lateral.

P-309.4, entitled "Freezing," shall read as follows:
P-309.4 Freezing: Water service piping shall be
installed below recorded frost penetration but not less than 42 inches
below grade. Plumbing piping in exterior building walls or areas subjected
to freezing temperatures shall be protected against freezing by insulation
or heat or both.

P-309.5, entitled "Sewer depth," shall read as follows:
P-309.5 Sewer depth: Building sewers that connect
to private sewage disposal systems shall be a minimum of 36 inches
below finished grade at the point of septic tank connection. Building
sewers shall be a minimum of 36 below grade.

of the structure shall have a minimum working pressure of 160 pounds
per square inch (psi) (1,000 kPa) at 73.4° F. (23° C.). Where
the water pressure exceeds 160 psi (1,100 kPa), piping material shall
have a minimum rated working pressure equal to the highest available
pressure.

In the event that the underlying rock structure is limestone or fragmented
shale, the Township shall be consulted on well site location. The
distances in Table P-1606.2 constitute a minimum separation and shall
be increased in areas of crevassed rock or limestone or where the
direction of movement of the groundwater is from sources of contamination
toward the well.

Nothing in this chapter or in the Plumbing Code hereby adopted
shall be construed to affect any suit or proceeding impending in any
court or any rights acquired or liability incurred or any cause or
causes of action acquired or existing under any act or ordinance hereby
repealed, nor shall any just or legal remedy of any character be lost,
impaired or affected by this chapter.
