The Township of Colts Neck hereby establishes a public recreational
bathing facility code adopted pursuant to N.J.S.A. 26:1A-7 and N.J.A.C.
8:26-1 et seq.
A code regulating and controlling the operation of recreational bathing facilities open to the public and the issuance of licenses to operate recreational bathing facilities open to the public is hereby adopted pursuant to Chapter
188, Laws of 1950 (N.J.S.A. 26:3-69.1 to 26:3-69.6). A copy of said code is annexed hereto and made a part hereof without inclusion of the text thereof herein.
Three copies of the Public Recreational Bathing Code have been
placed on file in the office of the Secretary to the Board of Health
upon introduction of this chapter and will remain on file in said
office for use and examination by the public.
As used in this chapter, the following terms shall have the
meanings indicated:
PRIVATE RECREATIONAL BATHING FACILITY OR PRIVATE POOL
A body of water, natural or modified by man, used for swimming,
diving and recreation bathing by an individual, family, or living-unit
member(s) and their guests which shall not serve any type of cooperating
house or joint tenancy of three or more living units.
No person shall locate and construct, alter or operate a public
recreational bathing facility until a permit has issued by the Board
of Health.
The following fees and charges are herewith established:
A. For the issuance or renewal of a permit to operate a public recreational
bathing facility: $150.
B. For the review of new site plans or review of major alterations to
an existing public bathing facility: $100.
Permits issued for the operation of a swimming pool shall expire
annually on April 30 of each year, and application for renewal thereof
shall be submitted together with the required fee prior to May 1 of
each year.
Violations of the provisions of this chapter shall be punishable as provided in §
1-9 of this Code.
