A.
Title. This chapter may be cited as the "Administrative Code of the Borough of Beach Haven," and is herein referred to as the "Code."
B.
Council-Manager plan established. Pursuant to the vote of the electorate of the Borough of Beach Haven on November 3, 2009, in accordance with N.J.S.A. 40:69A-15 providing for adoption of an optional municipal charter as recommended by the duly established Charter Study Commission, the form of government in the Borough of Beach Haven from and after July 1, 2010, is hereby established as the Council-Manager Plan pursuant to N.J.S.A. 40:69A-81 et seq., the Optional Municipal Charter Law.
C.
Continuation of pending actions. All actions and proceedings of a legislative, executive or judicial character which are pending on the effective date of this chapter shall continue, and the appropriate officer or employee under this chapter shall be substituted for the officer or employee exercising or discharging the function, power or duty involved in the action or proceeding.
D.
Failure to include mandatory or optional statutory provisions herein. The noninclusion of specific mandatory provisions of the Optional Municipal Charter Law or any general law in the Charter or in this Administrative Code, or the failure to include any specific reference thereto, shall not be construed to mean the elimination or nonapplicabality of said law within the Borough of Beach Haven, except where options available to the Borough under the Optional Municipal Charter Law have not been specifically chosen by the Borough of Beach Haven.
E.
Provision contrary to law. In the event that any provision of this Code is contrary to any statute, the statute shall prevail and the conflicting provision in this Code shall be a nullity.
