No person shall be permitted to park any vehicles on any public street or portion thereof located in the following described zones of the City of Atlantic City, for more than three consecutive hours, unless:
A. 
The vehicle is owned or operated on a regular basis by a City resident.
B. 
The vehicle has a valid resident or special guest parking permit displayed on either the rear panel window, on the driver's side or on the back window, on the driver's side in such a manner to be readily examined by persons authorized to enforce this chapter.
C. 
The vehicle falls under one of the exceptions to this parking ban pursuant to the provisions of § 243-46 of this article.
Residential Parking Permit Zones shall be established by ordinance when the need arises since there are a number of areas within the City of Atlantic City that are used primarily for residential purposes; these zones shall be:
A. 
Zone A. The area bounded by and between Albany Boulevard (excluding the easterly side of said street) to Jackson Avenue and the ocean to the inside thoroughfare.

B. 
Zone B. The area bounded by and between Albany Boulevard (excluding the westerly side of said street) to Missouri Avenue (excluding the easterly side of said street) and inside thoroughfare (excluding Atlantic Avenue) to the Boardwalk. Provided, however, that wherever parking has been restricted in this zone by previous ordinance or resolution presently in effect, then said area shall continue to be restricted parking areas as provided in the ordinance or resolution notwithstanding the provisions of this article. In addition, nothing in this article shall modify or repeal those restrictions imposed upon any hotel, motel or apartment complex required by Chapter 163, Land Use Development, Part 4, Zoning, to provide for off-street parking for its guests or residents. Residents of hotels, motels or apartment complexes in Zones A, B and C where Chapter 163, Land Use Development, Part 4 Zoning, requires that the owners of said facilities provide off-street parking for its residents shall not be entitled to receive residential parking permits pursuant to this article.

C. 
Zone C. The area bounded by and between Pennsylvania Avenue (excluding the westerly side of said street) to Connecticut Avenue (excluding the easterly side of said street) and Arctic Avenue (excluding Arctic Avenue) to Huron Avenue (excluding Huron Avenue).

A. 
No person shall park a vehicle on the streets or parts thereof described in Schedule XXVI (§ 243-84), attached to and made a part of this chapter, without the use of a permit.
B. 
Signs giving notice of the establishment of permit parking in areas set forth in Subsection A of this section shall be posted by the appropriate City department.
Applications for parking permits under this article shall be made in writing to the Chief of Police, or his designee upon such forms as shall be prepared by the office of the Chief of Police upon passage of this article.
Regular resident parking permits shall be granted to the following persons under the terms and conditions as hereinafter set forth:
A. 
To persons who are bona fide City residents of the City of Atlantic City of any zone described in § 243-46 above. Each said person shall be entitled to one parking permit for each vehicle owned or leased by such person and principally garaged at or near a residence located within any zone described in § 243-46 above.
B. 
Each bona fide business establishment of the zone described in § 243-46 above. Each said business establishment shall be entitled to a maximum of three parking permits, depending on how many employees are actually employed.
C. 
Each bona fide business establishment of Zone C, as described in § 243-46, which is a bona fide, nonprofit hospital and which affirmatively demonstrates that it does not have and cannot reasonably obtain a sufficient number of parking spaces which may be made available to its health care employees, shall be entitled to a maximum of 30 business employee parking permits. The number of permits to be issued shall depend upon how many such employees are actually employed subject to verification of their employment and of their necessity to utilize a motor vehicle for commuting to and from the business establishment, and upon the number of parking spaces which are or may reasonably be made available to such employees by the business establishment. All but the first 10 permits issued pursuant to this section shall be invalid on weekends and shall be prominently so endorsed.
A. 
Special guest permits shall be granted to the following person or persons under the terms and conditions set forth above.
B. 
Each bona fide resident household of the City of Atlantic City in zones described in § 243-46 shall be entitled to two special guest permits over and above any other permit they may be entitled to under this article if they reside within the Residential Parking Permit Zones established under this article under § 243-46 above.
Special guest permits may be used only by operators of vehicles within the areas described in § 243-46 with the sole purpose of visiting a person or persons residing within the resident household to whom the special guest permit being displayed was issued. A special guest permit may be used by such persons for not more than three consecutive days. Special guest permits may be used only on streets located within two City blocks of the household to whom said special guest permit was issued. Parking decals issued by the Board of Education of the City of Atlantic City may be used only by those teachers or members of the school district having official business in the Brighton Avenue School and the Chelsea Junior High School within the area described in § 243-46. Said parking decals issue by the Board of Education may be used only on streets located within two City blocks of the respective schools set forth above during the academic school year.
An applicant for a regular residential parking permit or a special guest permit shall show to the Chief of Police, or his designee, satisfactory evidence that he or she fulfills all the conditions required by issuance of said permit. Whenever by reason of a change of circumstances any person, whether as an individual or member of a household, is no longer qualified to hold any such permit, holder such permit holder shall immediately surrender the same to the Chief of Police or his designee. It shall be unlawful for any person to:
A. 
Represent that he is entitled to a permit or parking decal issued by the Atlantic City Board of Education hereunder when he is not so entitled to display or cause to be displayed such permit or parking decal.
B. 
In any way assist in the display of any special guest permit or parking decal issued by the Atlantic City Board of Education for the parking of a vehicle by the operator for any purpose other than to visit a person or persons residing in the household to whom the special guest permit was issued by the City, or to attend to official business in the Brighton Avenue School and/or Chelsea Junior High School.
C. 
Fail to surrender a permit to which he or she or the household for whom he or she obtained a permit, is no longer entitled.
D. 
Park a vehicle within any zone described in § 243-46 above at any time when the holder of such permit is not entitled to hold it.

There will be a fee of $1 for the first permit purchased and $2 for each additional permit purchased unless otherwise provided for in this article. All permits issued hereunder shall be valid for the current calendar year in which they are issued, but may be renewed upon expiration, provided that the conditions for issuance thereof still exist. The City of Atlantic City shall not be responsible for lost or stolen permits. Any permit which is lost or stolen prior to its expiration shall not be replaced, but may be renewed upon its expiration, provided that conditions for issuance thereof still exist.
The Chief of Police is hereby directed to prepare and erect proper signs calling attention to the provisions of this article along those streets or portions thereof located within the areas described in § 243-46.

A. 
Any person found guilty of any act set forth hereinbelow shall be subject to fines and penalties as follows:

B. 
Any vehicle which displays a fraudulent or counterfeit parking permit or sticker while parked in an area regulated by this article shall be subject to towing.
Residents of multifamily apartment or condominium apartment buildings containing 10 or more units each, and which buildings contain sufficient off-street parking facilities for all residents of said buildings who desire off-street parking facilities, shall not be entitled to regular residential parking permits.
The following vehicles shall be exempt from this article:
A. 
Contractors, service and delivery vehicles. Contractors, service and delivery vehicles bearing the name and address of a commercial business, and registered and licensed to do business in Atlantic City, if require, and exhibiting commercial license tags may park without a permit between the hours of 8:00 a.m. and 6:00 p.m. during the time that the operator and/or occupants of said vehicle as are actually rendering service, repairs, or improvements to a residence or other property located within the area described in § 243-45 above. Any commercial vehicle parked overnight shall be deemed in violation of this article.
B. 
Any vehicle lawfully parked in a parking space governed by a parking meter, where the required coins have been deposited in said meter.
C. 
Emergency vehicles. Emergency vehicles and public service telephone and other utility vehicles may park without a permit during the time they are rendering service or repairs to the area. Proof of service, e.g., an invoice or other written document must be furnished upon request of an officer enforcing parking regulations. Any public utility vehicle parked overnight and not providing service shall be deemed in violation of this article.
Every vehicle displaying a regular residential parking permit or a special guest permit shall comply with all other applicable statutes, ordinances, rules and regulations governing, regulating or restricting the parking of motor vehicles on the public streets of Atlantic City. A vehicle displaying such permits shall not be exempt from the obligation to deposit the required coins in parking meters, or to refrain from parking areas where parking is restricted or prohibited, including but not limited to loading zones, driveways, fire hydrant areas, stop sign areas, etc.
A. 
The Chief of Police is hereby empowered to promulgate reasonable and appropriate rules and regulations to implement and provide for the proper operation of this article.
B. 
The Chief of Police is specifically given the authority to make reasonable regulations providing for the waiver of enforcement of this article for limited areas and periods of time for the purpose of permitting more than two guests of a resident of any zone described in § 243-45 to park for more than three hours for the purpose of attending a bona fide event (including but not limited to wedding receptions, funeral receptions, etc.) at the home of said resident, provided that such special events are not such events that are held frequently or on a regular recurring basis.
