Wherever a space is marked off on any street for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this article for any person to park a vehicle or allow it to remain parked otherwise.
Parking is prohibited in the following circumstances at all times:
A. 
Within 15 feet of a fire plug;
B. 
More than 12 inches from a curb;
C. 
So as to block a public or private driveway/garage entrance, with the exception of a property owner blocking his own private driveway/garage entrance;
D. 
Double parking;
E. 
On the traveled portion of a roadway;
F. 
Within 15 feet of an intersection;
G. 
So as to block a crosswalk; and
H. 
On the curb or sidewalk.

A. 
Specific vehicles prohibited. It shall be unlawful for any person to park or the owner of any vehicle to allow a vehicle to remain parked on any highway or street within Ambridge Borough a vehicle of the class or type listed below:
(1) 
Any truck, truck/tractor, or combination having a height of greater than nine feet, or a length of greater than 30 feet, or a weight in excess of 20,000 pounds.
(2) 
Any trailer or special mobile equipment without being attached to a power unit or motor vehicle enabling the trailer or special mobile equipment to be readily removed from the street or highway.
(3) 
Any bus.
(4) 
Any motor home.
(5) 
Any dump truck, tow truck, or flatbed vehicle.

B. 
Exceptions. Between sunrise and sunset a vehicle of the type described in Subsection A, above, may be parked for the purpose of loading or unloading property for a period not to exceed 24 hours if parking is not otherwise prohibited.
C. 
Notice of restrictions. Notice of parking restrictions herein described shall be provided by means of traffic control devices or certified letter or personal service or placing of a notice on a windshield or other readily visible location on the vehicle. In the absence of a posted traffic control device, enforcement of this section shall not take place unless a notice of violation has been issued to the owner or operator of the vehicle prior to the date and time enforcement is initiated. The aforesaid notice of violation must be issued to the registered owner of the vehicle at least seven days prior to enforcement of the within section and the registered owner may request an extension of time upon a showing to the Chief of Police that exigent circumstances exist which prevent strict compliance with the requirements of the within section.
D. 
Penalty. Any person violating any provisions or regulation of this section shall, upon conviction thereof, be fined a sum not exceeding $300 and, upon any default of payment of such fine, may be committed to imprisonment in the Beaver County Jail for a period not exceeding 30 days. Each day that a violation is permitted to exist by such person shall constitute a separate, additional offense.
No person shall park a vehicle or allow it to remain parked for longer than the time indicated in any of the following locations at any time on the days and between the hours indicated.

B. 
During the entire period from November 1 of any given year until April 1 of the following year, between the hours of 2:00 a.m. and 7:00 a.m. prevailing time daily, it shall be unlawful for an owner or operator of any motor vehicle to park on any street which has any meter located on that block identified in § 290-46, Parking meter zones established.
A. 
Findings and purpose. The Borough finds that:
(1) 
Certain residential areas in the Borough are subjected to commuter vehicle parking, therefore depriving the residents of those areas of spaces in which to park their own vehicles.
(2) 
Those residential streets are also subjected to a high degree of commuter traffic which substantially reduces the quality of the ambient air level.
(3) 
The establishment of a parking permit program for certain affected areas should facilitate efficient movement of traffic by providing for parking preference during certain hours of the day and days of the week. Therefore, the Borough considers it to be in the interest of the people of the Borough to provide for the establishment of a residential permit parking program to ensure primary access to available parking spaces by neighborhood residents and also to provide a cleaner ambient air level.
B. 
Definitions. For the purpose of this section, words and terms listed in this subsection, as follows, shall have the following meanings:
COMMUTER VEHICLE
A motor vehicle parked in a residential area by a person not a resident of that residential area.
PROPRIETOR
A person who owns or leases real estate within a residential area of which he is not a resident, but who owns or manages a business enterprise or professional office maintained at that address; for the purpose of this section, a proprietor shall be entitled to one parking permit for that business or professional office address.
RESIDENT
A person who owns or leases real property within a residential area and who maintains either a voting residence or bona fide occupancy, or both, at that address.
RESIDENTIAL AREA
A contiguous area containing public highways or parts of public highways primarily abutted by residential property or residential and nonbusiness property (such as schools, parks, places of worship, hospitals and nursing homes).
C. 
Criteria. The residential areas designated in Subsection D of this section are those deemed impacted and hence eligible for residential parking on the basis of the following criteria:
(1) 
During any period between the hours of 7:00 a.m. and 6:30 p.m., Monday through Saturday, except legal holidays, the number of vehicles parked (or standing), legally or illegally, on the streets in the area is equal to 70% or more of the legal, on-street parking capacity of the area. For the purpose of this criterion, a legal parking space shall be 20 linear feet.
(2) 
During the same period as specified in Subsection C(1), directly above, 10% or more of the vehicles parked (or standing) on the streets in the area are not registered in the name of a person residing in the area. For the purpose of this criterion, the latest available information from the Bureau of Motor Vehicles and Licensing of the Pennsylvania Department of Transportation regarding registration of motor vehicles shall be used.
(3) 
In determining that a specific area identified as impacted and eligible for residential permit parking is designated as a residential permit parking area, the following factors are taken into consideration:
(a) 
The local and metropolitan needs with respect to clean air and environment;
(b) 
The possibility of a reduction in total vehicle miles driven in the Borough;
(c) 
The likelihood of alleviating traffic congestion, illegal parking and related health and safety hazards;
(d) 
The proximity of public transportation to the residential area;
(e) 
The desire and need of the residents for residential permit parking and their willingness to bear the administrative costs in connection with it; and
(f) 
The need for parking in excess of the residential permit parking program in proximity to establishments located in the residential permit parking area and used by the general public for religious, health or educational purposes.
D. 
Designation of residential permit parking areas.
(1) 
The following are designated as residential permit parking areas:

Signs shall be erected along the streets in each residential permit parking area, indicating the days, hours, locations and conditions under which parking shall be by permit only.
E. 
Application for permit. Application for a residential parking permit shall be made to the Chief of Police by the person desiring the permit, who shall be only the owner or the driver of a motor vehicle who resides on or is a proprietor of property immediately adjacent to a street or other location within a residential parking permit area. A separate application shall be required for each motor vehicle, and each application shall be accompanied by a permit fee, set pursuant to a resolution of the Borough Council, which shall be for the use of the Borough to be applied to the cost of administering the residential permit parking program. Each application shall contain the following information: the name of the owner or the driver, as the case may be, of the motor vehicle; the address of the resident or the proprietor, as the case may be; the make, model and registration number of the motor vehicle; and the driver number as taken from the applicant's current driver's license. At the discretion of the Chief of Police, the applicant shall be required, at the time of making application, to present his driver's license and the vehicle registration card.
F. 
Issuance of permit. Upon receipt of the application and the permit fee, and determination by him that the information upon the application shows that the applicant is entitled to a residential parking permit, the Chief of Police shall issue to the applicant a residential parking permit, which shall be valid for the remainder of the calendar year. The permit shall display the serial and registration numbers of the motor vehicles, the residential parking area number, and the expiration date. The permit shall be renewable annually before the expiration date, upon making application for renewal and payment of the permit fee. It shall be unlawful and a violation of this section for any person to display other than the current and valid permit while standing or parking in a residential permit parking area at any time when those permits are to be displayed.
G. 
Temporary and exemption parking permits. Temporary parking permits may be issued by the Chief of Police, upon payment of a fee established pursuant to a resolution, to bona fide visitors of residents of a designated residential permit parking area, and exemption parking permits may be issued, without payment of a fee, to handicapped persons.
H. 
Responsibility of permit holder.
(1) 
Notwithstanding any provision of this section to the contrary, the holder of a residential parking permit shall be permitted to stand or park a motor vehicle operated by him in any designated residential parking area during those times when parking of motor vehicles is permitted in that area. While a vehicle for which a residential parking permit has been issued is so parked, that permit shall be displayed so as to be clearly visible through the windshield of the vehicle. A residential parking permit shall not guarantee or reserve to the holder a parking space within a designated residential permit parking area.
(2) 
A residential parking permit shall not authorize its holder to stand or park a motor vehicle in any place where or at any time when stopping, standing or parking of motor vehicles is prohibited or set aside for other specified types of vehicles, nor shall the permit exempt its holder from the observance of any traffic or parking regulation other than residential permit parking regulation or restriction.
(3) 
No person other than the permit holder whose name appears on the permit shall use a residential parking permit or display it on a vehicle operated; any such use or display by a person other than the permit holder shall constitute a violation of this section by the permit holder and by the person who so used or displayed the parking permit.
(4) 
It shall constitute a violation of this section for any person falsely to represent himself as eligible for a residential parking permit or to furnish false information in an application to the Chief of Police in order to obtain a residential parking permit.
I. 
Revocation of permits. The Chief of Police shall have authority to revoke the residential parking permit of any permit holder found to be in violation of any provision of this section. Upon written notification to him of the revocation, the permit holder shall surrender the permit to the Chief of Police. Failure to do so, when so requested, shall constitute a violation of this section, provided that any person receiving such a notice may, within 10 days after the date of the notice, appeal to Borough Council for a hearing on the revocation, and the decision of Borough Council shall be final.
A. 
Issuance of parking permit. The Council of the Borough of Ambridge hereby authorizes the issuance of monthly parking permits for use by automobiles to park in the following lots and parking spaces within the Borough of Ambridge between the hours of 8:00 a.m. and 5:30 p.m., Monday through Saturday, inclusive:

B. 
Fee. The fee for the monthly parking permit shall be established from time to time by resolution of the Borough Council.
C. 
Display of permit. All permits must be prominently displayed on the rearview mirror of the automobile parked in a permit space.
D. 
Validity of permit. Permits are only valid for use in the lots and spaces designated as well as for authorized time periods only. Any parking by permit in nondesignated spaces or areas or at nondesignated times is invalid and is not governed by the condition of the permit issued.
E. 
Enforcement.
(1) 
The Borough parking permit program shall be under the supervision of the Borough Secretary. It shall be the duty of the Borough Secretary or his authorized representative to carry out the function and purpose of this section and to ensure compliance with this section. The administration of this section, including the establishment of parking fees or designating the number of spaces subject to permit use, may be set from time to time by resolution of the Council of the Borough of Ambridge.
(2) 
If for any reason the Borough Secretary is unable to perform the foregoing duties, it shall be the duty of the Chief of Police to perform the duties as outlined above.
A. 
Restricted handicapped residential parking. Any Borough resident who has been issued a handicapped or severely disabled veteran license plate by the Commonwealth of Pennsylvania or on whose behalf said license plate has been issued, pursuant to § 1338 or 1342 of the Pennsylvania Vehicle Code, shall be eligible for the installation, in front of said person's residence solely for said person's use, of a sign indicating that parking in such space is restricted to such person's vehicle bearing a handicapped or severely disabled veteran license plate, which eligibility shall expire 12 months from the date such sign is installed. Application for such restricted parking sign shall be made to the Chief of Police.
B. 
Application form and content. Application for a restricted handicapped or severely disabled parking space shall be made on a form provided by the Chief of Police. The application information shall include the identity of the handicapped person or severely disabled veteran and said person's place of residence and shall be accompanied by documentation evidencing issuance of a handicapped or severely disabled veteran plate by the Commonwealth of Pennsylvania.
C. 
Factors in determining approval of an application.
(1) 
In reviewing the application, the Chief of Police shall take into consideration the following factors:
(a) 
Impact on general safety.
(b) 
Impact on traffic flow.
(c) 
Impact on neighboring properties.
(d) 
Nature of disability.
(e) 
Availability of off-street parking, garage and/or driveway.
(f) 
Verification of application in general.
(2) 
Following his review of the application and consideration of the above factors, the Chief of Police shall submit his recommendation to Borough Council for final determination as to whether the application shall be approved or rejected. The application shall not be approved if off-street parking is available to the applicant unless the same cannot be utilized or if an undue hardship is created for the other residents parking in the area.
D. 
Annual certification.
(1) 
Each renewal period shall be 12 months.
(2) 
Application for renewal must be filed with the Chief of Police no later than 30 days before the date the prior eligibility is due to expire.
(3) 
The Chief of Police will not accept the application for renewal unless it is also accompanied by a sworn document containing the following averments:
(a) 
The applicant continues to be disabled as evidenced by documentation submitted and signed by the applicant's treating physicians.
(b) 
The applicant continues to drive an automobile or is being driven by another identified individual because of applicant's disability.
(c) 
The applicant resides at the same address.
E. 
Failure to file completed application. Failure to file a completed initial application or a timely application for renewal shall result in such application being denied or not renewed. In the event an individual fails to file a completed application for recertification within the time allowed, that is, on an annual basis prior to expiration of the individual's eligibility, the right to such sign shall be forfeited, and the sign shall be removed by the Department of Public Works.
F. 
Current signs. All residences currently having restricted handicapped or severely disabled veteran parking signs in front of the premises shall apply to the Chief of Police within 60 days of the effective date of this article for renewal of their handicapped or disabled status. Failure to do so will result in the removal of the sign.
G. 
Removal of sign. In addition to removal of the sign for failure to properly apply for renewal, a handicapped or severely disabled veteran parking restriction sign may be removed after notice to the applicant if, upon investigation, the Borough determines either that the applicant is not, in fact, handicapped or a severely disabled veteran; that the applicant has moved; or that the privilege is being abused in a manner inconsistent with its intent. The notice to the individual shall state the reason or reasons for the anticipated removal of the sign and shall give the handicapped individual or severely disabled veteran 20 days in which to request a hearing before the Chief of Police or his designee.
H. 
Installation. Upon approval of the application, the Chief of Police shall refer all applications for handicapped or severely disabled veteran restricted parking which meet the requirements of this section to the Borough Engineer and the Department of Public Works for installation of a restricted handicapped or severely disabled veteran parking sign.
I.

(5)

J. 
Violations and penalties. Any person, firm or corporation who submits a false application to the Chief of Police shall, upon conviction thereof, be sentenced to pay a fine of not more than $600 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this section continues shall constitute a separate offense.
Unless provided otherwise in any section, any person who violates any provisions of this article shall, upon conviction, be sentenced to pay a fine of not more than $15 and costs, provided that it shall be the duty of the police officers and of parking enforcement personnel of the Borough to report to the appropriate official all violations of any provisions of this article, indicating, in each case, the section violated; the license number of the vehicle involved in the violation; the location where the violation took place; and any other facts that might be necessary in order to secure a clear understanding of the circumstances attending the violation. The police officer or other person making the report shall also attach to or place upon every such vehicle a notice stating that the vehicle was parked in violation of this article. The notice shall contain instructions to the owner or driver of the vehicle that if he will pay the sum indicated within the time period indicated, enclosing it within the envelope provided, at the office of the Chief of Police or by depositing it in any of the special parking fine boxes installed at various locations within the Borough, that act will save the violator from further prosecution and assessment of costs.
