As used in this article, the following terms shall have the meanings indicated:
PERSON
Any individual, partnership, limited partnership, association or corporation.
No person shall at any time sell or store Christmas trees inside any building within the limits of the Borough unless said tree or trees are artificial or flameproof.
No person shall at any time be permitted to sell or store Christmas trees within 15 feet of gasoline tanks or pumps.

No person shall be permitted to sell or store Christmas trees within the limits of the Borough without first obtaining a permit to sell or store the same.

On and after the effective date of this article, every person desiring to sell or store Christmas trees within the limits of the Borough, if not otherwise exempted as heretofore stated, shall on or before selling or storing said Christmas trees procure a permit for each of the places in which he wishes to sell or store the said trees from the Borough Secretary, who shall issue the same upon the payment of a fee in an amount as established from time to time by resolution of Borough Council, $95 of which shall be refunded to the licensee after January 1 of the following year if the lot and/or premises has been cleaned of all trees, branches and rubbish; if the lot and/or premises is not cleaned by the first of January, the licensee will forfeit the $95 to the Borough.

Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this article continues shall constitute a separate offense.
