The Burlington County Soil Conservation District shall be the review and inspection authority for all designated development projects within the Township of Eastampton pursuant to N.J.S.A. 4:24-39 et seq. and any regulations promulgated thereunder.
A. 
Major. Any and all new applications for development (as that term is defined in N.J.S.A. 4:24-41) received after the effective date of this chapter shall be referred by either the Land Use Planning Board or the Construction Official (where Board approval is not required), as the case may be, to the Burlington County Soil Conservation District for review, approval and inspection pursuant to N.J.S.A. 4:24-39 et seq.

B. 
Minor. Minor projects shall be defined as those projects causing the disturbance of less than 5,000 square feet of surface area of land. Any project deemed to be a minor project shall be referred to the Township Engineer for review, approval and inspection.
The Township of Eastampton shall require a performance bond or other suitable performance guaranty for all soil erosion and sediment control measures for all new major and minor applications for development which may be required by the Burlington County Soil Conservation District or Township Engineer to ensure installation and completion of the required permanent stabilization measures. The amount of the performance guaranty shall be estimated by the Township Engineer. The performance guaranty shall be approved by the Township Attorney as to form, sufficiency and execution. The performance guaranty shall name the Township of Eastampton as the obligee.
A. 
The Township Engineer shall retain responsibility for enforcing the implementation of erosion control plans, in accordance with standards for soil erosion and sediment control, for minor projects for which final approval has been granted as of the effective date of this chapter.
B. 
The Burlington County Soil Conservation District shall assume responsibility for enforcing the implementation of soil erosion plans for all major projects which are ongoing and for which final approval, including final approval of the soil erosion and sediment control plans, has been granted as of the effective date of this chapter.
All developers of projects subject to §§ 432-2 and 432-4B of this chapter utilizing a revolving escrow fund for inspection fees shall post requisite inspection fees directly with the Burlington County Soil Conservation District in accordance with its fee schedule. Developers of ongoing projects shall post said fees immediately upon notification after the effective date of this chapter. Developers of minor projects shall post inspection fees directly with the Township Clerk in accordance with the fee schedule utilized by the Burlington County Soil Conservation District.

The Land Use Planning Board or the Construction Official, as the case may be, shall condition all preliminary or final site plan, subdivision or construction permit approvals (where Board approval of projects is not required) after December 9, 1986, upon the certification of a soil erosion and sediment control plan by the Burlington County Soil Conservation District. In addition, each such Board and Construction Official shall refer any and all applications for such approvals and/or a copy of each such approval to the Burlington County Soil Conservation District for review.
