Pursuant to Section 3(h) of the Illinois Freedom of Information Act, 5 ILCS 140/1 et seq. ("Act"), the Board of Trustees may, by ordinance or resolution duly adopted, promulgate rules and regulations setting forth the procedures, instructions, and forms for requesting public records from the Village under the Act ("FOIA Rules"). All Village officials and employees shall comply at all times with the Village FOIA Rules as may be adopted and as may be amended from time to time.
All requests for public records shall be submitted to the Village in accordance with, and pursuant to, the FOIA Rules.
No person shall receive copies of any requested records except upon payment of all fees required pursuant to the FOIA Rules.
The charge for certification of a record shall be in addition to, and not in lieu of, the charges paid for copying the record.
No person shall obtain any records of the Village for a "commercial purpose," as that term is defined in the Act, without disclosing that the records are intended for a commercial purpose. Any person who violates this Section 1-3-5 shall be fined in the amount set forth in the Annual Fee Resolution.[1]
