There is hereby established a Board of Fire and Police Commissioners
("BFPC") consisting of five members.
No appointments to the BFPC shall be made by the Village President
within 30 days before the expiration of the Village President's term
of office.
Members shall not be subject to removal, except for cause, upon
written charges, and after an opportunity to be heard within 30 days
in his or her or their own defense, before a regular meeting of the
Board of Trustees. A majority vote of the elected members of the Board
of Trustees shall be required to remove any such member from office.
The BFPC may employ a secretary or may designate one of its
own members to act as such. The secretary shall keep the minutes of
the BFPC's proceedings, shall be custodian of all records pertaining
to the business of the BFPC, shall keep a record of all examinations
held, and shall perform such other duties as the BFPC shall prescribe.
The BFPC shall have the following powers and duties:
(A) To make
such rules for the appointment and removal of members of the Police
Department, which rules shall apply only to the conduct of examinations
for original appointments, for promotions, and to the conduct of hearings
on charges brought against a member of the Police Department. The
rules shall provide that appointments and promotions shall be made
after an examination as provided by state statute, except as modified
by the ordinances of the Village enacted from time to time. All rules
and regulations and any changes therein shall be printed immediately
for distribution, and notice shall be given of where the printed rules
and regulations may be obtained, and of the date, not less than 10
days subsequent to the time of printing, when the rules and regulations
or changes therein shall go into effect. Such notice shall be published
in one or more newspapers published in the Village or, if no newspaper
is published therein, then in one or more newspapers with a general
circulation within the Village.
(B) To appoint all members of the Village Police Department, except the
Chief of Police, and any exempt positions as authorized by ordinance
enacted from time to time, provided that all appointments to the Village
Police Department, other than that of the lowest rank, shall be from
the rank next below that to which the appointment shall be made.
(C) To perform such other duties and exercise such other powers germane
to the powers granted by the Board of Trustees and the applicable
provisions set forth in Division 2.1 of Article 10 of the Illinois
Municipal Code, 65 ILCS 5/10-2.1-1 et seq.; provided, however, that
in the event there is a conflict between the provisions of Division
2.1 of Article 10 of the Illinois Municipal Code and the provisions
of this Article 2, the provisions of this Article 2 shall prevail.
