The provisions of this Article 1 shall apply to all officers and employees of the Village, regardless of the time of the creation of the office or position or the time of the appointment of the officer or employee.
Wherever the following words or phrases are used, they shall, for purposes of this article, have the meanings ascribed to them in this Section 4-1-1, except when the context otherwise indicates:
EMPLOYEE
All at-will positions appointed pursuant to this Code, or other positions governed by a collective bargaining agreement or by the Board of Fire and Police Commissioners.

OFFICER
All Village elected officials, the Village Treasurer, appointed members of Village commissions and boards, and the Village Manager.

Except as specifically provided to the contrary by the other provisions of this Code, or otherwise by law or by a collective bargaining agreement to which the Village is a party, all employees shall be appointed by the Village Manager.

Every appointed officer of the Village shall hold office for an indefinite term, or until his or her successor is elected or appointed and qualified, unless otherwise provided by ordinance. Any officer appointed by the Village President with the consent of the Board of Trustees for an indefinite term may be removed by the Village President at any time without cause unless otherwise provided by law.
In the event a vacancy occurs, it shall be filled in the same manner in which appointments are made in the absence of provisions to the contrary.
Every officer of the Village, except appointed members of Village commissions and boards shall, before entering upon his or her duties, take the oath prescribed by statute. This oath, so subscribed, shall be filed with the Village Clerk.
All appointed officers and employees of the Village shall receive such compensation as may from time to time be provided by the Board of Trustees or by ordinance. Such compensation may be increased but not diminished so as to take effect during the term for which such persons are appointed.
All records kept by any officer or employee of the Village shall be open to inspection at all reasonable times by the President, or any Village Trustee, whether or not such records are required to be kept by statute or ordinance.
All officers and employees of the Village, upon the expiration of their terms or employment for whatever cause, shall deliver to their successors all property, books, records and effects belonging to the Village, or appertaining to the office they have held, within five days after notification and request to do so. If no successor has been appointed, such property shall be delivered to the Village Clerk or Village Treasurer. Any officer or employee that violates this section shall be liable for all the damages caused thereby and shall be fined in the amount set forth in the Annual Fee Resolution.[1]

At least once each month, all officers and employees of the Village shall turn over to the Village Treasurer all monies paid to the Village and received by the officer or employee in his or her official capacity, along with a statement showing the sources from which the money was received.

All Village employees, excluding those members of the Fire Department, Police Department, legislative, executive and judicial departments of the Village that have been specifically designated by the Village Manager, are included in the federal Old Age and Survivors Insurance System as authorized by the federal Social Security Act and amendments thereto. Withholdings from wages or salaries of employees will be made by the municipality in the amounts and at such times as may be required by applicable state or federal laws or regulations.
The Village President, Village Trustees, Village Clerk, Village Treasurer, and Village Manager shall hold no other municipal office during their respective terms as President, Trustee, Clerk, Village Treasurer, or Village Manager.
Officers and employees shall comply with applicable state law in regards to interest in contracts.
Every Village officer who is guilty of a culpable omission of duty, or who is guilty of willful and corrupt oppression, misconduct, or malfeasance in the discharge of the duties of his or her office, shall be guilty of a business offense and, on conviction, shall be fined in an amount set forth in the Annual Fee Resolution.[1]

All Village officers who are required pursuant to state law to file statements of economic interest shall promptly file such documents in proper form in the manner provided by law.
