An application filed with the Village pursuant to Section 9-1-5 of this Code for a cigarette-tobacco dealer or a retail tobacco store shall include, in addition to the requirements set forth in Section 9-1-5 of this Code:
(A) 
The names, home addresses, and personal telephone numbers of all persons who own at least 5% of the proposed business; and
(B) 
The names and home addresses of any supervising officer, director or manager who will oversee all of the applicant's personnel that may conduct the sale of tobacco at the proposed business location.
In addition to the criteria set forth in Section 9-1-7(B) of this Code, the Finance Director shall deny an application for a new or renewal business license for a cigarette-tobacco dealer or a retail tobacco store if any owner of at least 5% of the proposed business, or any supervising officer, director or manager of the proposed business, has: (A) been convicted of any criminal offense related to the sale of cigarettes or other tobacco products; (B) been found liable for the violation of any law or regulation concerning the imposition of tax on the sale of cigarettes or other tobacco products; or (C) found to have employed any coercive or illegal measures to promote the sale of any cigarettes or other tobacco products.
All cigarette-tobacco dealers and retail tobacco stores shall comply with all applicable regulations governing the sale and use of tobacco products, as set forth in Article 3 of Chapter 10 of this Code.
(A) 
Not more than eight licenses for retail tobacco stores may be issued at any one time. Upon the revocation, expiration, or surrender of any retail tobacco store license, the number of authorized retail tobacco licenses will automatically be reduced by one, without any further amendment of this Section 9-4-4(A).
(B) 
In accordance with Section 9-1-10 of this Code, no retail tobacco store license may be transferred at any time.
(C) 
A retail tobacco store license will expire automatically upon the closure for a period of 30 consecutive days of the business for which the license was issued.
In the event that a business license for a cigarette-tobacco dealer or a retail tobacco store is revoked pursuant to Section 9-1-16 of this Code:
(A) 
The business licensee shall be ineligible to reapply for a business license for a cigarette-tobacco dealer or a retail tobacco store for any premises within the Village for a period of 18 months after the date of revocation of the business license;
(B) 
No subsequent business license for a cigarette-tobacco dealer or a retail tobacco store shall be granted for the premises for which the business license was revoked for a period of six months after the date of revocation of the business license; and
(C) 
All cigarettes, cigars, and tobacco products shall be removed promptly from the formerly licensed premises.
