A. 
Except as otherwise specifically provided in this chapter, the statutory provisions in Chs. 340 to 348 and § 349.215, Wis. Stats., describing and defining regulations with respect to vehicles and traffic, exclusive of any provisions therein relating to penalties to be imposed and exclusive of any regulations for which the statutory penalty is a fine or term of imprisonment, are hereby adopted and, by reference, made a part of this chapter as if fully set forth herein. Any act required to be performed or prohibited by any statute incorporated herein by reference is required or prohibited by this chapter. Any future amendments, revisions or modifications of the statutes incorporated herein are intended to be made part of this chapter in order to secure uniform statewide regulation of traffic on the highways, streets and alleys of the State of Wisconsin.
B. 
Other laws adopted. There are also hereby adopted by reference the following provisions of the Wisconsin Statutes and Administrative Code, but the prosecution of such offenses under this chapter shall be as provided in Chs. 340 to 348, Wis. Stats., and the penalty for violation thereof shall be as provided in § 397-18 of this chapter:[1]

A. 
Duty of the Chief of Police to erect and install uniform traffic control devices. Whenever traffic regulations created by this chapter, including a state traffic regulation adopted by reference in § 397-1 of this chapter, require the erection of traffic control devices for enforcement, the Chief of Police, with the cooperation of the Director of Public Works, shall procure, erect and maintain uniform traffic control devices conforming to the Uniform Traffic Control Device Manual promulgated by the Wisconsin Department of Transportation giving notice of such traffic regulations to the users of the streets and highways on which such regulations apply. Whenever state law grants discretion to local authorities in erecting or placement of a uniform traffic control device, devices shall be erected in such locations and in such a manner as, in the judgment of the Chief of Police, will carry out the purposes of this chapter and give adequate warning to users of the streets and highways of the City.
B. 
Official Traffic Map.
(1) 
Official Traffic Map established. There is hereby established for the City of Mayville an Official Traffic Map dated April 1, 1988, on which is indicated as of said date all existing stop signs; stop signs, except right turns; arterial intersections; yield signs; controlled intersections; prohibited U-turns; handicapped parking areas; and school zones and school crossings. All such restrictions and limitations set forth on said Official Traffic Map are hereby adopted by reference.
(2) 
Additions to map. The Council may, from time to time, make additions to or deletions from the Official Traffic Map and the Chief of Police shall keep such Official Traffic Map current. Every addition to said Official Traffic Map made after April 1, 1988, shall indicate the number of the authorizing resolution and the date the appropriate official traffic control device was erected, and every deletion shall indicate the number of the authorizing resolution.
(3) 
Map to be maintained. The Official Traffic Map shall be maintained and displayed in the office of the Police Department. The Chief of Police shall make appropriate authorized changes on said map within three working days after the appropriate official traffic control device is erected or removed, as the case may be.
(4) 
Violations prohibited. When official traffic control devices giving notice of the restrictions, prohibitions and limitations shown on the Official Traffic Map are erected and maintained in accordance with the provisions of this section, a violation of the restriction, prohibition or limitation shown on the Official Traffic Map shall be a violation of the provisions of this chapter.
C. 
Prohibited signs and markers in highways. No person, other than an officer authorized by this chapter to erect and maintain official traffic control devices or his designee, shall place within the limits of any street or highway maintained by the City any sign, signal, marker, mark or monument unless permission is first obtained from the Chief of Police or the State Highway Commission. Any sign, signal, marker, mark or monument placed or maintained in violation of this subsection shall be subject to removal as provided in Subsection D below.
D. 
Removal of unofficial signs, signals, markers and traffic control devices. The Chief of Police may direct the Director of Public Works to remove any sign, signal, marker or other device which is placed, maintained or displayed in violation of this chapter or state law. Any charge imposed against premises for removal of a prohibited or illegal sign, signal, marker or device shall be reported by the Director of Public Works to the Council for review and certification at its next regular meeting following the imposition of the charge. Any charge not paid on or before the next succeeding November 15 shall be placed upon the tax roll for collection as other special municipal taxes.

B. 
Designation of location of stop signs and yield signs. In the interest of public safety, the Council, by resolution, has designated the location of stop and yield signs within the City and has ordered the installation of such signs. In addition, the location of such signs is designated on the Official Traffic Map of the City pursuant to § 397-2 of this chapter.
C. 
Operators to obey traffic control devices. Every operator of a vehicle approaching an intersection at which an official traffic control device is erected in accordance with this section shall obey the direction of such official traffic control device as required by the Wisconsin Statutes incorporated by reference in § 397-1 of this chapter. Operators of vehicles approaching a stop sign shall stop before entering a highway as required by § 346.46, Wis. Stats. Operators approaching intersections at which a yield sign has been installed shall yield the right-of-way to other vehicles as required by § 346.18(6), Wis. Stats.
D. 
Heavy truck route.

(1) 
Definition. For purposes of this subsection, heavy traffic shall be defined as:
(a) 
All vehicles not operating completely on pneumatic tires; and
(b) 
All vehicles or combination of vehicles, other than motor buses, designed or used for transporting property of any nature and having a gross weight of more than 15,000 pounds.
(2) 
Prohibited routes. Heavy traffic is prohibited from using any City street or highway not designated as a heavy traffic route. This subsection shall not act to prohibit heavy traffic from using a City street or highway for the purpose of obtaining orders for supplies or moving or delivering supplies or commodities to or from any place of business or residence, provided that the shortest possible route is used to and from the heavy truck route. Furthermore, this subsection will not act to prohibit heavy traffic from using any City streets designated as highways. Vehicles owned and operated by a public utility will be exempt from the provisions of this subsection.
(3) 
Administration. The Director of Public Works, in cooperation with the Police Department, shall administer this subsection. Administration shall include:
(a) 
Posting of signs. Appropriate signs shall be posted giving notice of this subsection and of the heavy traffic routes established herein. Yellow signposts may also be used to designate heavy traffic routes.
(b) 
Maps. Heavy traffic routes shall be shown on the Official Traffic Map.
(c) 
Construction equipment.
[1] 
The Director of Public Works may grant temporary permits to allow heavy construction equipment to use City streets or highways not designated as heavy traffic routes. These permits may be granted only when use of a nondesignated route is necessary for the equipment to reach a construction site. No permit may be issued unless the person or corporation owning the equipment agrees to reimburse and hold the City harmless for any damage done to the City street by the equipment and/or any personal injury or property damage caused in part or in whole by the street damage.

City-owned or operated equipment and commercial garbage haulers collecting refuse are specifically excluded from the provisions of this subsection.
(4) 
Liability. Any operator, corporation, owner or agent whose heavy traffic vehicle damages any City streets or highways in violating this subsection shall be liable and required to pay the City the cost of repair or replacement of the damaged street or highway.
(5) 
Special and seasonal weight limitations. The Director of Public Works shall have the authority to impose special or seasonal weight limits on any highway, bridge or culvert maintained by the City to prevent injury to the roadway or for the safety of the users of such bridge or culvert and shall be responsible for erecting uniform traffic control devices giving notice thereof in accordance with the provisions of § 397-2.
(6) 
Heavy traffic routes designated. All streets and alleys within the City are designated Class "B" highways subject to the weight limitations of § 346.16, Wis. Stats., except that the following highways or parts thereof within the jurisdiction of the City are hereby designated heavy traffic routes and are excepted from the Class "B" weight limitations:
(a) 
Highway 28 (Horicon Street and Main Street).
(b) 
Highway 67 (Main Street).
(c) 
Clark Street as it extends south from Horicon Street to Fourth Street.
(d) 
Fourth Street as it extends east from South Clark Street to South John Street.
(e) 
South John Street as it extends north from the City limits to Horicon Street.
(f) 
Kekoskee Street as it extends east from the City limits to Furnace Street.
(g) 
Furnace Street as it extends south from Kekoskee Street to Breckenridge Street.
(h) 
Taylor Street as it extends east from Furnace Street to North Main Street.

(i) 
Bridge Street as it extends east from Main Street to German Street.
(j) 
German Street as it extends south from Bridge Street to the City limits.
The Chief of Police is hereby authorized to establish safety zones and islands, loading zones and traffic lanes of such kind and character and at such places as deemed necessary for the protection of persons using the public streets. The Director of Public Works, upon the recommendation of the Chief of Police, is authorized and empowered to erect and maintain such pavement markings, structures and/or signage as may be deemed necessary to mark the areas designated pursuant to this section consistent with the provisions of this chapter.

No person shall drive a vehicle, except in the direction indicated, upon the following streets or portions of streets:
A. 
On Mill Place in an easterly direction from South Main Street to a point 94 feet to the east thereof.
B. 
On Park Street in a southerly direction from the west boundary of the City park to the southeast boundary of the City park.
C. 
On Brickyard Lane in an easterly direction from Oak Street to South Walnut Street.
D. 
On Iron Lane in a west-to-east direction from Furnace Street to North Main Street.

A. 
Stopping, standing and parking regulated. Pursuant to § 349.13, Wis. Stats., the authority to regulate the stopping, standing and parking of vehicles is delegated to the Chief of Police, subject to control of the Council. The Chief, with the cooperation of the Director of Public Works, is hereby authorized to designate and sign streets, or portions thereof, where the stopping, standing or parking of vehicles is prohibited at all times or during certain designated hours.
B. 
Limited time parking. Unless specifically otherwise provided, except on Sundays and legal holidays, no person shall park a vehicle for any longer than the period hereinafter specified upon the following streets or portions thereof:
(1) 
Ten minutes.
(a) 
The first two parking stalls on the west side of North School Street directly north of Bridge Street with a time limit of Monday through Friday from 8:30 a.m. to 4:30 p.m. and Saturday from 9:00 a.m. to 11:00 a.m.
(b) 
On the north side of Breckenridge Street from Wisconsin Street to Henninger Street during school days from 7:30 a.m. to 3:30 p.m.
(c) 
On the west side of Henninger Street from Breckenridge Street to a point 960 feet north thereof during school days from 7:30 a.m. to 3:30 p.m.
(d) 
Two parking stalls in front of 35 South Main Street every day of the week from 11:00 a.m. to 8:00 p.m.

No person shall park any vehicle on Main Street, from Horicon Street to Buchanan Street, between the hours of 2:30 a.m. and 5:30 a.m. at any time.
H. 
Truck parking on Main Street regulated. No person shall park a truck or other vehicle longer than 19 feet in length on either side of Main Street from Horicon Street to Dayton Street.
I. 
Parking in parking lots regulated.
(1) 
Twenty-four-hour parking. No person shall, without a parking lot permit, park any motor vehicle in any City parking lot for more than 24 hours. No person shall park any motor vehicle on any such parking lot by backing said motor vehicle into a parking stall.
(2) 
Parking lot permit. City parking lot permits may be obtained from the City Clerk's office for a fee as set by the Common Council. Parking permits must be hung from the rearview mirror with the expiration date of the permit facing the windshield. Improperly displayed permits are subject to citation. No vehicle may remain parked in the same stall for more than 72 hours.
(3) 
Business permits. Business permit fees are paid at the City Clerk's office for a fee as set by the Common Council. The style and color of the business permit is to be approved by the Chief of Police and is not to be provided by the City.
(4) 
Parking lot designations. City parking lots are designated as follows:

J. 
Parking limited to certain vehicles.
(1) 
Library parking lot. No person shall park a vehicle in the four northerly parking stalls in the City Library parking lot (Lot C) located north of Williams Street during hours when the library is open unless such person is an employee of the library. Parking is permitted in this lot from 7:00 a.m. to 7:00 p.m. Overnight parking from 2:30 a.m. to 6:30 a.m. is allowed by permit only.
(2) 
Municipal building parking lots. Parking for Lot A shall be two-hour parking from 7:00 a.m. to 7:00 p.m. No overnight parking is permitted in this lot. Parking for Lot B shall be allowed from 7:00 a.m. to 7:00 p.m. Overnight parking from 2:30 a.m. to 6:30 a.m. is allowed by permit only.
(3) 
Main Street parking lots. Parking in Lots D and E shall allow overnight parking from 2:30 a.m. to 6:30 a.m. by permit only.
K. 
Parking in alleys regulated. All parking in alleys is prohibited, except in alleys in the Main Street Business District between Horicon Street and Buchanan Street for the purpose of loading or unloading freight.
L. 
Parking in driveways prohibited. No person shall park or leave standing any motor vehicle in any private driveway without the permission of the owner or lessee of the property upon which such driveway is located, whether or not such driveway is posted to prohibit parking.
M. 
Parking with engine running. No person shall park any motor vehicle for more than 30 minutes upon a public street, alley or parking lot or upon any private property zoned for residential, business or commercial purposes in the City if the vehicle engine is left running or if the engine to any equipment on the vehicle is left running.
N. 
Street maintenance and snow removal. Whenever it is necessary to repair a City street or any part thereof or to remove snow, the Street Superintendent shall post such street or parts thereof with appropriate signs prohibiting parking. Such signs shall be erected at least two hours prior to the time that street maintenance work or snow removal is to be commenced. No person shall park a motor vehicle in violation of such signs.
O. 
Winter parking regulations. Winter parking period. From December 1 through April 1 annually, no person shall park any motor vehicle on any public street within the City of Mayville between the hours of 1:00 a.m. and 6:00 a.m., unless the vehicle displays a valid winter parking permit issued by the City of Mayville.
(1) 
Winter parking permits.
(a) 
The City Clerk, or designee, shall issue winter parking permits upon application and payment of the required fee.
(b) 
The fee for a winter parking permit shall be established by the Common Council as part of the annual City fee schedule.
(c) 
Permits shall be displayed as directed by the City Clerk and shall be valid only for the specific vehicle identified in the application.
(d) 
Possession of a winter parking permit does not exempt a vehicle from the restrictions of a snow event or declared snow emergency under this section.
(2) 
Snow events.
(a) 
No owner or operator of any vehicle may park upon any street between the hours of 1:00 a.m. and 6:00 a.m. when there is a snow event.
(b) 
For purposes of this section, a "snow event" means either:
[1] 
The accumulation of snow is such that the Director of Public Works (or their designee), in their sole discretion, authorizes the use of snowplows to clear the snow; or
[2] 
The Director of Public Works, or their designee, declares a snow event by contacting the newspaper, radio, or cable television, or posting on the City of Mayville website.
(c) 
All vehicles must be removed from public streets and alleys from the starting time of the snow event until the streets or alleys have been cleared curb-to-curb or edge-to-edge of pavement during a snow event.
(d) 
For purposes of this subsection, a "vehicle" shall be defined as every device in, upon, or by which any person or property is or may be transported or drawn upon a roadway or highway.
(e) 
Vehicles found in violation of this subsection shall be subject to citation, and may be ticketed and towed at the owner's risk. The fine for violating this subsection shall be consistent with the parking violation schedule established by the Police Department, plus the cost of towing for each occurrence.
(3) 
Snow emergencies.
(a) 
Emergency declarations. In times of emergency due to excessive snowfall which impedes vital services, the Mayor or, in their absence, the Council President may declare a snow emergency. Such declaration shall be made by causing the announcement thereof to be made by area radio station. Such snow emergencies shall be in effect until declared ended by the Chief of Police or the Director of Public Works.
(b) 
Parking regulations. During a declared snow emergency, it shall be unlawful for any person to park, or suffer to be parked, any vehicle upon any street in the City.
(c) 
Towing of vehicles. Upon the issuance of a parking citation against the registered owner of any vehicle found parked in violation of this subsection, the Police Chief may direct the towing of such vehicle to a temporary site designated by the Chief.
(d) 
Penalty. In addition to the penalty provided in § 397-18 of this chapter, any person violating this subsection shall be required to pay the towing charges for any vehicle towed as a condition of the release of such vehicle.
P. 
Designated parking spaces. The Chief of Police, with the cooperation of the Director of Public Works, shall cause lines or markings to be painted upon the curb and/or upon the street or parking lot surface for the purpose of designating a parking space. It shall be unlawful to park any vehicle across any line or marking or to park a vehicle in such position that the same shall not be entirely within the area designated by such lines or markings.
Q. 
Removal of chalk marks prohibited. In order to monitor the continuous length of time that a vehicle is parked in a parking space or zone subject to parking time restrictions, it is necessary that the Police Department place a chalk mark or other mark on one or more tires of parked vehicles. It shall be unlawful to remove, erase or alter, or attempt to remove, erase or alter, any chalk mark or other mark of any kind placed upon any tire of a vehicle parked in any parking zone or space subject to parking time restrictions.
R. 
Legal holidays designated. For purposes of enforcement of parking restrictions in the City, the following days shall be defined as legal holidays: New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day; provided, however, that in the event that any of said days falls on a Sunday, the following Monday shall be deemed to be the legal holiday.
S. 
Exceptions to parking regulations. The prohibitions regarding parking in this section do not apply as follows:
(1) 
When a vehicle becomes disabled in such a manner or to such an extent that it is impossible to avoid stopping or temporarily leaving the vehicle in the prohibited place.
(2) 
When the stopping of the vehicle is necessary to avoid conflict with other traffic or to comply with traffic regulations or the directions of a traffic officer or traffic control sign or signal.
(3) 
When the stopping of a public utility vehicle is necessary for the maintenance of the utility's facilities.
(4) 
A vehicle for a disabled person and displaying a special registration plate issued under § 341.14, Wis. Stats., or a special identification card issued under § 343.51, Wis. Stats., shall be exempt from any ordinance imposing time limits on parking with a one-half-hour or more limitation. Said vehicles shall be subject to all other parking restrictions.
T. 
Restricted parking on highways and in residence districts.
(1) 
Except for such time as is reasonably necessary to load or unload, or for other commercial operations in the immediate vicinity, no owner or operator of a motor truck, truck tractor, motor bus, trailer or semitrailer weighing more than 20,000 pounds or exceeding 30 feet in length shall park or leave standing such vehicle on any state trunk highway or on any highway, street, alley, parking lot or private driveway within the City without first obtaining permission therefor from the Mayville Police Department. Any violation of the terms of any permit issued hereunder shall be a violation of this section.
(2) 
Recreational vehicle parking restricted. It is unlawful for any person to park camping trailers, travel trailers, motor homes, boat trailers and boats, utility trailers and construction trailers on any City street for a period of more than 48 hours. Any person wishing to park any of these vehicles/trailers on any City street overnight must contact the Police Department.
(3) 
In addition to any other penalty provided herein, and not in substitution thereof, any vehicle parked or left standing in violation of this subsection may be removed by or under the direction of the Police Department, and the risk and expense of such removal and storage shall be charged to the owner or operator of such vehicle. The removal of such vehicle by or under the direction of the Police Department shall not prevent prosecution under this subsection.
U. 
Construction dumpsters prohibited.
(1) 
No person shall locate a waste dumpster on a street in the City unless site approval has been given by the Chief of Police or the Director of Public Works and a permit has been issued by the City Clerk. A permit may be issued for a maximum ten-day period if it is impossible to place the dumpster on private property and the dumpster is of such a size that it will not create a hazard to vehicles, pedestrians, or bicycle traffic.
(2) 
Application for a permit shall be made to the Chief of Police or Director of Public Works at least five working days prior to permit issuance. The permit fee shall be as set by the Common Council.
(3) 
The applicant shall be required to provide barricading or other markings to ensure day and night visibility of the dumpster.
(4) 
Penalty. A person violating this section shall be subject to a forfeiture pursuant to the provisions of § 1-4 of this Code.
Any vehicle parked or left standing upon a highway, street or alley or other public grounds in violation of any of the provisions of this chapter is declared to be a hazard to traffic and public safety. Such vehicle shall be removed by the operator, upon request of any police officer, to a position where parking, stopping or standing is not prohibited. Any police officer, after issuing a citation for illegal parking, stopping or standing of an unattended vehicle in violation of this chapter, is authorized to remove such vehicle to a position where parking is not prohibited. The officer may order a motor carrier holding a permit to perform vehicle towing services, a licensed motor vehicle salvage dealer or a licensed motor vehicle dealer who performs vehicle towing services to remove and store such vehicle in any storage garage or rental parking grounds or any facility of the person providing the towing services. In addition to other penalties provided by § 397-18 of this chapter, the owner or operator of a vehicle so removed shall pay the cost of towing and storage.
A. 
Abandonment of vehicles prohibited. No person shall abandon any vehicle unattended within the City for such time and under such circumstances as to cause the vehicle to reasonably appear to be abandoned.
B. 
Definition. As used in this section, "vehicle" means a motor vehicle, trailer, semitrailer or mobile home as defined in § 397-1 of this chapter, whether or not such vehicle is registered under Ch. 341, Wis. Stats.
C. 
Presumption of abandonment. Any vehicle left unattended for more than 72 hours on any public street or grounds, or on private property where parking is prohibited, limited or restricted, without the permission of the owner or lessee, is deemed abandoned and constitutes a public nuisance, provided that the vehicle shall not be deemed abandoned under this section if left unattended on private property out of public view by permission of the owner or lessee.
D. 
Exceptions. This section shall not apply to a vehicle in an enclosed building or a vehicle in an appropriate storage place or depository maintained in a lawful place and manner authorized by the City.
E. 
Removal and impoundment or sale. Any vehicle found abandoned in violation of this chapter shall be impounded by the Police Department until lawfully claimed or disposed of as provided in this section. If the Chief of Police or his duly authorized representative determines that towing costs and storage charges for 10 days, as provided in Subsection F below, would exceed the value of the vehicle, the vehicle may be junked or sold prior to the expiration of the impoundment period upon determination by the Chief of Police that the vehicle is not wanted for evidence or any other reason, provided that vehicles in excess of 19 model years of age shall be sold or disposed of only by auction sale or sealed bid in accordance with Subsection H below.
F. 
Minimum impoundment period. The minimum period of impoundment or storage of a vehicle found in violation of this section shall be 10 days.
G. 
Notice to owner. The police officer removing or causing the removal of any vehicle found in violation of this section shall immediately notify the Chief of Police of the abandonment and location of the impounded vehicle and shall, within 10 days thereafter, notify the owner and lienholders of record, by certified mail, of the impoundment and of their right to reclaim the vehicle. The notice shall set forth the information contained in § 342.40(3), Wis. Stats., and shall state that the failure of the owner or lienholder to exercise his right to reclaim the vehicle shall be deemed a waiver of all right, title and interest in the vehicle and a consent to sale of the vehicle.
H. 
Sale. Each retained vehicle not reclaimed by the owner or lienholder may be disposed of by sealed bid or auction sale as provided in § 342.40(3), Wis. Stats.
I. 
Sale to bar claims against vehicle. The sale of a motor vehicle under the provisions of this section shall forever bar all prior claims thereto and interest therein except as hereinafter provided.
J. 
Purchaser to remove vehicle. The purchaser of any vehicle on sealed bid or auction sale under Subsection H above shall have 10 days to remove the vehicle from the storage area upon payment of a storage fee of the actual cost of commercial storage for each day the vehicle has remained in storage after the second business day subsequent to the sale date. Ten days after the sale, the purchaser shall forfeit all interest in the vehicle and the vehicle shall be deemed to be abandoned and may be again sold.
K. 
Request for list. Any listing of vehicles to be sold pursuant to this section shall be made available by the Chief of Police to any interested person or organization who or which makes a request therefor.

L. 
Notice to Department. Within five days after the sale or disposition of a vehicle under this section, the Chief of Police shall advise the Wisconsin Department of Transportation of such sale or disposition on a form supplied by the Department.

M. 
Owner may file claim. At any time within two years after the sale of a motor vehicle, as provided herein, any person claiming ownership of such motor vehicle or a financial interest therein may present a claim to the Council setting forth such facts as are necessary to establish such ownership or interest and that the failure of the claimant to reclaim the vehicle prior to the sale was not the result of the neglect or fault of claimant. If the Council is satisfied as to the justice of such claim, it may allow the same, but in no case shall the amount allowed exceed the sum paid into the City treasury as a result of the sale of such motor vehicle nor the amount of interest of the claimant therein.
N. 
Exemption. Any owner or person operating a registered vehicle which shall become disabled or inoperative for any reason and who shall be unable to cause removal of such vehicle from any alley, street, highway or public place not otherwise regulated as a restricted parking, stopping or standing zone shall, within 12 hours of such occurrence, notify the Police Department of the location of the vehicle and shall transfer and deliver clear title for said vehicle to the City together with a fee for the cost of towing and junking charges and shall be exempt from the provisions of this section. When so requested by the owner or person in charge of a vehicle, the Chief of Police shall be authorized to order such vehicle removed and junked directly from the scene of disablement by the contractor engaged by the City for towing of disabled vehicles. The provisions of Subsection K above shall apply to any vehicle removed under this subsection.
No person shall make unnecessary and annoying noises with a motor vehicle by squealing tires, by excessive acceleration of the engine, or by emitting unnecessary and loud exhaust system noises.
Pursuant to the provisions of § 118.105, Wis. Stats., the following regulations shall apply to the grounds of the Mayville School District located within the City:
A. 
Parking. All parking on grounds of the Mayville School District from 7:30 a.m. to 4:30 p.m. shall be by permit only and shall be restricted to areas designated for parking by the School Board. When signs are erected by the School Board giving notice of such restrictions, no person shall park a motor vehicle in an area other than one for which he shall have been issued a permit nor without displaying a valid permit. All authorized visitors shall park only in areas designated and signed for visitor parking.
B. 
Speed limits. No person shall at any time operate a motor vehicle upon the Mayville School District grounds at a speed in excess of 15 miles per hour.
C. 
Vehicles prohibited at specified times. No person shall at any time operate a motor vehicle other than a school bus in or upon any drive designated for buses only by sign during the hours of 7:30 a.m. to 9:00 a.m. and during the hours of 3:00 p.m. to 4:30 p.m. on any weekday during the months that school is in session.
D. 
One-way traffic. No person shall operate a motor vehicle contrary to the one-way traffic signs posted on any school drive.
A. 
Time limitations. It shall be unlawful to stop any railroad train, locomotive or railroad car upon or across any highway or street crossing or to cause obstruction of vehicular traffic on public streets at such crossing by stopping, leaving standing, switching or otherwise maintaining constant railway use at such crossing longer than 10 minutes.
B. 
Penalty. Any conductor, engineer, switchman, brakeman or other employee or agent in charge of or otherwise responsible for such offending railroad locomotive or car who shall violate the provisions of this section shall, upon conviction, be subject to a penalty as prescribed in § 397-18C of this chapter.

Purpose and intent. The City of Mayville adopts the following snowmobile and all-terrain vehicle trails and routes and restrictions for the operation of snowmobiles, golf carts, all-terrain vehicles (ATVs) and utility terrain vehicles (UTVs) on roadways and City-owned property throughout the City of Mayville. Following due consideration of the recreational value to connect trail opportunities, and weighed against the possible dangers, public health, liability issues, terrain, traffic density and history of vehicular traffic, these routes and trails have been established.
B. 
State snowmobile laws adopted. Except as otherwise specifically provided in this chapter, the statutory provisions describing and defining regulations with respect to snowmobiles in the following enumerated sections of the Wisconsin Statutes are hereby adopted by reference and made part of this section as if fully set forth herein. (1) 
Applicability of rules of the road to snowmobiles. The operator of a snowmobile upon a roadway shall, in addition to the provisions of Ch. 350, Wis. Stats., be subject to §§ 346.04, 346.06, 346.11, 346.14(1m), 346.18, 346.19, 346.20, 346.21, 346.26, 346.27, 346.33, 346.35, 346.37, 346.40, 346.44, 346.46, 346.47, 346.48, 346.50(1)(b), 346.51, 346.52, 346.53, 346.54, 346.55, 346.87, 346.88, 346.89, 346.90, 346.91, 346.92(1), and 346.94(1) and (9), Wis. Stats., all-terrain and utility terrain vehicle laws.
(2) 
The statutory provisions of § 23.33 and Chs. 340 to 348, Wis. Stats., establishing definitions and regulations with respect to ATVs and UTVs and Ch. NR 64, Wis. Adm. Code, are adopted here by reference. Unless otherwise specifically provided herein, any act required to be performed or prohibited by any statute or administrative code provision incorporated herein is required or prohibited by this section. Any future amendments, revisions or modifications of the Wisconsin Statutes or Wisconsin Administrative Code incorporated herein are made a part of this section in order to secure uniform statewide regulation of ATVs and UTVs. To the extent that any provision of state law incorporated herein conflicts with the language of this section, the language in the state law shall control, except that if state law allows the City to impose either a greater or more narrow restriction than the rule, provision or restriction contained in state law that is in conflict with this section, in which case the language of this section shall control.
E. 
Definitions. The following definitions shall apply with respect to this section:
ALL-TERRAIN VEHICLE or ATV
A commercially designed and manufactured motor-driven device that has a weight, without fluids, of 900 pounds or less, has a width of 50 inches or less as measured laterally between the outermost wheel rim on each side of the vehicle, exclusive of tires, mirrors, and accessories that are not essential to the vehicle's basic operation, is equipped with a seat designed to be straddled by the operator, and travels on three or more low-pressure or nonpneumatic tires.
CITY
The City of Mayville, a Wisconsin municipal corporation. All references to the City in this section shall apply only within the jurisdictional limits of the City of Mayville, and the City makes no attempt to exercise authority outside of the jurisdictional limits of the City of Mayville.
GOLF CART
A vehicle whose speed attainable in one mile does not exceed 20 miles per hour on a paved, level surface, and that is designed and intended to convey one or more persons and equipment to play the game of golf in an area designated as a golf course.
OFF-ROAD VEHICLES
Shall include, without limitation, off-highway motorcycles, minibikes, golf carts, all-terrain vehicles (ATVs) and utility terrain vehicles (UTVs).
UTILITY TERRAIN VEHICLE or UTV
Any of the following:
(1) 
A commercially designed and manufactured motor-driven device that does not meet federal motor vehicle safety standards in effect on July 1, 2012, that is not a golf cart, low-speed vehicle, dune buggy, mini-truck, or tracked vehicle, that is designed to be used primarily off of a highway, and that has, and was originally manufactured with, all of the following: a weight, without fluids, of 3,000 pounds or less; four or more tires; a steering wheel; a taillight; a brake light; two headlights; a width of not more than 65 inches as measured laterally between the outermost wheel rim on each side of the vehicle, exclusive of tires, mirrors, and accessories that are not essential to the vehicle's basic operation; a system of seat belts or a similar system for restraining each occupant of the device in the event of an accident; and a system of structural members designed to reduce the likelihood that an occupant would be crushed as a result of a rollover of the device.
(2) 
A commercially designed and manufactured motor-driven device to which all of the following applies: it does not meet federal motor vehicle safety standards in effect on July 1, 2012; is not a golf cart, low-speed vehicle, dune buggy, mini-truck, or a tracked vehicle; is designed to be used primarily off of a highway; and has, and was originally manufactured with, a weight, without fluids, of not more than 3,000 pounds; it has a width of 65 inches or less as measured laterally between the outermost wheel rim on each side of the vehicle, exclusive of tires, mirrors, and accessories that are not essential to the vehicle's basic operation; it is equipped with a seat designed to be straddled by the operator; it travels on three or more tires; and it is not an all-terrain vehicle, as defined in § 340.01(2g), Wis. Stats.
(3) 
All other applicable words and phrases defined in §§ 23.33 and 340.01, Wis. Stats., are incorporated by reference in this section.
F. 
Snowmobile operation in the City restricted.
(1) 
General. It shall be unlawful to operate any snowmobile on private property or on the City streets, alleys, parks, parking lots, or on any public lands or private lands or parking lots held open to the public.
(2) 
Exception for designated and marked trails and routes (Cr. Ord. No. 754-91 § 2). Snowmobiles may be operated on designated and marked snowmobile trails and routes designated by the Council on a map on file in the City Clerk's office, as follows:
(a) 
On the Rock River.
(b) 
From the City sewage plant area north to the City limits.
(c) 
From the Rock River north of the pedestrian bridge at East Dayton Street and west across Highway 67/Main Street to 121 North Main Street (Kwik Trip).
(d) 
From County Road TW (south), south of Highway 28/Horicon Street, across Highway 28/Horicon Street to 1400 Horicon Street (BP gas station).
(e) 
From County Road TW (north) east across County Road TW to rear access drive to 701 South Mountain Drive (Mayville Inn).
G. 
Use of trails by snowmobiles. Snowmobile routes or trails are to be used only for ingress to and egress from the City, it being the intention to provide said trails or routes only to get through the City. Any use by snowmobiles other than for ingress or egress is prohibited.
H. 
Hours of operation restricted. No person shall operate a snowmobile anywhere within the City between the hours of 2:00 a.m. and 6:00 a.m.
I. 
Speed limit for snowmobiles (Am. Ord. No. 913-01 § 1). No person shall operate any snowmobile in the City at a speed in excess of 25 miles per hour.
J. 
Permitting operation by improper persons prohibited. No owner or person having charge or control of a snowmobile, golf cart, all-terrain vehicle or utility terrain vehicle shall authorize or permit any person to operate such snowmobile, all-terrain vehicle or utility terrain vehicle who is not permitted under state law to operate such snowmobile, all-terrain vehicle or utility terrain vehicle, or who is under the influence of an intoxicant or a dangerous narcotic drug.
K. 
Operation while under influence prohibited. Section 346.63, Wis. Stats., shall apply to the operation of a snowmobile, golf cart, all-terrain or utility terrain vehicle any place within the City.
L. 
Designation of ATV and UTV routes and use of golf carts. No person shall operate an off-road vehicle on any City street, alley, park, or parking lot; on any public lands or parking lots held open to the public; or on any land zoned residential within the City, except as provided below:
(1) 
Designation of all-terrain and utility terrain vehicle routes. Pursuant to § 23.33(8)(b)2, Wis. Stats., all City-maintained streets, roads and alleys are designated as ATV and UTV routes unless otherwise posted.
(2) 
Per § 23.33(11)(am)2, Wis. Stats., the City of Mayville authorizes the operation of all-terrain vehicles and utility terrain vehicles with snow removal devices attached on the roadway, or adjacent to the roadway, for the purpose of snow removal for the maintenance of residential and commercial properties, if the applicable roadway speed limit is greater than 45 miles per hour.
(3) 
Per § 23.33(11)(am)4, Wis. Stats., the City of Mayville authorizes the operation of ATVs and UTVs on all county and state highways that are not part of the national system of interstate and defense highways and that have a speed limit of 35 miles per hour or less and are located within the territorial boundaries of the City of Mayville.
(4) 
Per § 349.18(1m)(a), Wis. Stats., and except as provided in Subsection L(5) of this section, the City of Mayville shall allow the use of golf carts on any highway that has a speed limit of 25 miles per hour or less that is not a state trunk highway or connecting highway and that is located within the territorial boundaries of the City of Mayville.
(5) 
Per § 349.18(1m)(c)2, Wis. Stats., the City of Mayville shall allow the operation of golf carts in order to cross a state trunk or connecting highway if the state trunk or connecting highway has a speed limit of 35 miles per hour or less, the highway crossing will connect highways on which golf cart use is allowed under Subsection L(4) of this section, and the City provides sufficient funds to the Wisconsin Department of Transportation to cover the costs of erecting and maintaining highway crossing signs, to be erected and maintained by the Department of Transportation, to mark the crossing. The Common Council may in its discretion either provide or withhold such funds to the Department of Transportation to cover the costs of erecting and maintaining highway crossing signs.
(6) 
Per § 349.18(1)(b), Wis. Stats., in addition to those crossing points established under Subsection L(5) of this section, the following golf cart crossing points are hereby established: on South German Street at the golf cart/pedestrian crossing in between South High Street and McArthur Road/Golf Course Road. The City, village or town shall place a sign of a type approved by the Department of Transportation to mark the crossing point on both sides of the highway.
(7) 
The City of Mayville reserves the right to close or modify routes and trails or to revoke authorization to use golf carts, ATVs and UTVs on any highway located within the City at any time.
(8) 
The City of Mayville or its designee shall maintain all golf cart, ATV route and trail signs within the City of Mayville. The City of Mayville shall maintain all ATV route and trail signs on state trunk highways within the City of Mayville.
(9) 
All golf cart, ATV and UTV routes and trails shall be signed in accordance with §§ 23.33(8)(e), Wis. Stats., and §§ NR 64.12 and NR 64.12(7)(c), Wis. Adm. Code.
M. 
Conditions and restrictions on operation. In addition to the provisions contained in § 23.33 and Chs. 340 through 348, Wis. Stats., and as a condition for the use of ATV and UTV routes designated and authorized above, the following conditions and restrictions shall apply to all golf cart, ATV and UTV operators and passengers, as applicable:
(1) 
All ATV and UTV units shall be registered for public use in accordance with Wisconsin Department of Natural Resources (DNR) regulations, and proof of registration shall be displayed as required by statute during all times of operation.
(2) 
All golf cart, ATV and UTV operators shall observe all motor vehicles laws regarding the use of motor vehicles in the State of Wisconsin and all ordinances regarding the use of motor vehicles in the City that are not inconsistent with this section.
(3) 
No golf cart, ATV or UTV shall be operated at a speed greater than the maximum permitted speed limit within the City, and no ATV or UTV shall be operated at a speed greater than 25 miles per hour.
(4) 
All ATV and UTV operators are subject to and shall abide by applicable provisions of the Wisconsin Statutes and DNR regulations pertaining to age, safety and safety certificate requirements.
(5) 
No person shall operate an ATV or UTV on any trail or route without fully functional headlights, taillights and brake lights. All operators shall display a lighted headlight and taillight at all times while on the trail or route.
(6) 
No person shall operate a golf cart, ATV or UTV on any trail or route where the vehicle does not meet state or municipal noise and exhaust restriction requirements.
(7) 
No person shall operate a golf cart, ATV or UTV within any municipal park or on any sidewalk, designated bicycle or pedestrian lane, gravel shoulder, ditch or other area of any street right-of-way other than on the paved roadway, unless specifically designated and posted otherwise by the City or its designee or unless yielding the right-of-way.
(8) 
All golf cart, ATV and UTV operators shall ride in single file.
(9) 
All golf cart, ATV and UTV operators shall ride on the right-hand side of the paved portion of the highway, unless making a left turn.
(10) 
All users of golf carts at all golf cart crossings established under this section shall stop and yield the right-of-way to all vehicles approaching on the highway before crossing the highway.
(11) 
All golf carts operated on any highway within the City shall be equipped with at least two reflective devices at least three inches in height and width and a reflective "slow moving" sign or flag visible from the rear of the vehicle.
(12) 
No golf cart, ATV or UTV may be operated on any open ATV route if the golf cart, ATV or UTV does not meet all applicable federal noise and air pollution standards.
(13) 
No person shall leave or allow any golf cart, ATV or UTV owned or operated by that person to remain unattended on any public highway or public property while the motor is running or with the starting key left in the ignition.
(14) 
No person shall operate a golf cart, ATV or UTV within the City unless the owner or operator has in effect at the time a liability policy insuring operation of the golf cart, ATV or UTV, which policy meets the carrier and coverage requirements specified in § 344.61, Wis. Stats., that are applicable to a motor vehicle liability policy, as defined in that section. No person shall operate a golf cart, ATV or UTV without having proof of such liability insurance coverage readily available.
(15) 
Golf cart, ATV and UTV operators or passengers under the age of 18 years of age shall wear protective headgear, as required under § 347.485(1)(a), Wis. Stats., with a chin strap securely fastened at all times of operation.
(16) 
No person shall operate a golf cart, ATV or UTV on any open segment ATV/UTV route or on any highway on which golf carts may be used unless the operator is 16 years of age or older and holds a valid driver's license issued by the Wisconsin Department of Transportation or another state driver's licensing authority.
(17) 
Every person who operates a golf cart or an ATV or UTV on an open segment of City streets or highways shall have in his or her immediate possession a valid motor vehicle operator's license and shall display the license document upon demand from any law enforcement officer or official described in § 23.33(12), Wis. Stats.
(18) 
No golf cart, ATV or UTV operator or passenger shall be in possession of an open intoxicant while the golf cart, ATV or UTV is in operation. No person shall operate a golf cart, ATV or UTV while under the influence of an intoxicant, a restricted controlled substance, a controlled substance analog, or any combination of these elements, to a degree which renders the person incapable of safely operating the golf cart, ATV or UTV.
N. 
Enforcement and penalties. The penalty for any violation identified in § 23.33(13) or Ch. 340 through 347, Wis. Stats., shall be as set forth in the Wisconsin Statutes. Deposit amounts for such violations shall be as set forth in the current Revised Uniform State Traffic Deposit Schedule. The penalty for any violation of this section not addressed in § 23.33(13) or Ch. 340 through 347, Wis. Stats., shall be a forfeiture as set forth in § 1-4 of the Mayville Municipal Code, together with all applicable costs, surcharges and assessments.
O. 
City Clerk to file section. Pursuant to §§ 350.047 and 23.33(11)(b), Wis. Stats., the City Clerk is hereby and directed to send a copy of this section to the Department of Natural Resources, to the state traffic patrol, the Police Department and the County Sheriff's Department.
A. 
Defined. "Bicycle" shall mean every device propelled by the feet acting upon pedals and having two wheels or having wheels any two of which are 20 inches or more in diameter.
B. 
Registration required. It is unlawful for any person to operate a bicycle owned by a resident of the City or kept in the City upon any City street unless the bicycle is properly registered and licensed as provided in this section.
C. 
Registration procedure.
(1) 
Registration shall be made by filing with the Police Department the name and address of the owner together with a complete description of the bicycle on forms provided by the Department and by paying a registration fee as set by the Common Council. Registrations shall be serially numbered and kept on file in the Police Department as a public record.
(2) 
Upon registration of a bicycle, the Department shall cause a license to be securely affixed upon the bicycle in a prominent place. The licenses shall be serially numbered to correspond with the registration numbers. Such license shall remain affixed to the bicycle unless removed by the Department for cause or upon a change of ownership requiring registration under Subsection G below.
(3) 
In case of theft or loss, a duplicate license shall be issued upon payment of a fee covering the cost of such license.
D. 
Payment of fees. Registration fees, collected by the Police Department, shall be paid monthly to the City Treasurer-Comptroller for deposit in such City account as he designates.
E. 
Unsafe bicycles; suspension of license. No bicycle shall be registered which is in an unsafe mechanical condition. The Chief of Police shall have authority to suspend the registration of and remove the license plate from any bicycle operated contrary to any state law or City ordinance or operated while in unsafe mechanical condition, such suspension and removal to continue for a period not to exceed 10 days, provided that such registration shall not be reinstated or such license plate be replaced while such bicycle is in unsafe mechanical condition. Such suspension and removal shall be in addition to other penalties provided in § 397-18 of this chapter.
F. 
Destruction of license or frame number prohibited. No person shall willfully remove, deface or destroy any bicycle license or any bicycle frame number.
G. 
License transfer. Within seven days after any bicycle registered under the provisions of this section has changed ownership or is taken out of operation, the new owner shall report such information to the Police Department. In case of change of ownership, the bicycle shall be reregistered. However, no reregistration or fee shall be required unless ownership is transferred to a person who is not a member of the immediate family of the registrant.
H. 
Dealer requirements.
(1) 
All persons engaged in the business of buying and selling secondhand bicycles are required to make a monthly report to the Police Department giving the name and address of the person from whom and to whom each bicycle is purchased and sold, the frame number thereof and the number of the old license plate, if any.
(2) 
No person engaged in the business of buying and selling secondhand bicycles shall purchase any secondhand bicycle from a minor under 18 years of age.
I. 
Rules of the road. In addition to the statutory rules of the road applicable to bicycles, adopted by reference in § 397-1 of this chapter, the following rules shall apply:
(1) 
Whenever a usable path for bicycles has been provided adjacent to a roadway, bicycle riders shall use such path and shall not use the roadway.
(2) 
No person shall ride a bicycle upon a sidewalk.
(3) 
No person under the age of eight shall operate a bicycle licensed under this section on any public street in the City.

A. 
No person shall roller-skate, roller-blade or operate a skateboard on the sidewalk located in the Main Street Business District between Horicon Street and Buchanan Street.
B. 
No person shall roller-blade on any state highway in the City.
C. 
No person shall roller-blade on Clark Street from Horicon Street north to Kekoskee Street.
D. 
No person shall roller-blade on Bridge Street from Main Street west to John Street.
E. 
No person shall roller-blade on any street located in the truck route in the City of Mayville, those streets of the truck route being listed in § 397-3D(6) of this chapter.[1]

A. 
No person shall use motor vehicle brakes within the City limits of the City of Mayville which are in any way activated or operated by the compression of the engine of any such motor vehicle or any unit or part thereof.
B. 
Any person violating the provisions of this section shall have committed a traffic offense and a penalty shall be imposed as provided in § 1-4 of this Code.
C. 
The Street Superintendent is authorized and directed to post appropriate signs consistent with the provision of this section.
D. 
All other terms and provisions of this chapter shall remain in full force and effect unless specifically modified therein.
E. 
All emergency/municipal vehicles are exempt from this section.
The penalty for violation of any provision of this chapter shall be a forfeiture as hereafter provided, together with statutory court costs and penalty assessment, if applicable.
A. 
State forfeiture statutes. Forfeitures for violation of §§ 340.01 to 348.28, Wis. Stats., shall conform to the forfeiture permitted to be imposed for violation of the statutes adopted by reference, including any variations or increases for subsequent offenses.
B. 
State fine statutes. The forfeiture for violation of any statute adopted by reference hereunder for which the penalty is a fine shall not exceed the maximum fine permitted under such statute.
C. 
Local regulations. The penalty for violations of §§ 397-2 through 397-16 of this chapter shall be as provided in § 1-4 of this Code.[1]

A. 
Enforcement procedure. This chapter shall be enforced in accordance with the provisions of §§ 345.20 to 345.53, Ch. 799 and § 66.0114, Wis. Stats.
B. 
Duty of police to enforce. City police officers shall enforce all the provisions of this chapter. Parking attendants are authorized to issue citations for nonmoving violations.
C. 
Uniform citation. The uniform citation promulgated under § 345.11, Wis. Stats., shall be used for all moving and nonmoving traffic violations, except parking violations.
D. 
Notice of demerit points and receipts. Every officer accepting a forfeited penalty or money deposit under this chapter shall receipt therefor in triplicate as provided in § 345.26(3)(b), Wis. Stats. Every officer accepting a stipulation under the provisions of this chapter shall comply with the provisions of §§ 343.28, 345.26(1)(a) and 345.27(2), Wis. Stats.
E. 
Parking citations. Citations for all parking violations under this chapter shall conform to § 345.28, Wis. Stats., and shall permit direct mail payment of the applicable forfeiture to the Police Department within 10 days of the issuance of the citation in lieu of a court appearance. Overtime parking forfeitures may be paid at the Police Department. The citation shall specify thereon the amount of the applicable forfeiture as provided in this chapter.
F. 
Registration record of vehicle as evidence. When any vehicle is found upon a street, highway or other public right-of-way in violation of any provision of this chapter regulating the stopping, standing or parking of vehicles and the identity of the operator cannot be determined, the owner as shown by the ownership registration of the vehicle supplied by the Wisconsin Department of Transportation, or a comparable authority of any other state, shall be deemed to have committed the violation for purposes of the enforcement of this section and shall be subject to the applicable forfeiture penalty; provided, however, that the defenses defined and described in § 346.485(5), Wis. Stats., shall be a defense for an owner charged with such violation.
G. 
Traffic violation and registration program. Pursuant to the provisions of § 345.28(4), Wis. Stats., the City elects to participate in the nonmoving traffic violation and registration program of the Wisconsin Department of Transportation and pay the costs established by the Department under § 85.13, Wis. Stats. Such costs shall in turn be assessed against persons charged with nonmoving traffic violations. The City Attorney shall be responsible for complying with the requirements set forth in § 345.28(4), Wis. Stats.
H. 
Deposit schedule. Every police officer issuing a citation for any violation of this chapter shall indicate on the citation the amount of the deposit that the alleged violator may make in lieu of court appearance. The amount of the deposit shall be determined in accordance with the City Bond Schedule.
I. 
Disposition of deposits. Any Police Department employee accepting deposits or forfeited penalties under this chapter shall deliver them to the County Clerk of Courts within 20 days after receipt, except for parking forfeitures which shall be turned over to the City Treasurer-Comptroller.[1]
