[Adopted 6-8-1970 as Sec. 6-8 of the Revised General Ordinances]
It shall be unlawful for any person to conduct, carry on or promote any motion-picture theater without having first obtained a license.
The applicant shall present with his application:
A. 
A certificate of approval of the Construction Official that the building or place where the licensed business is to be carried on complies with all of the requirements of the building and zoning ordinances of the Town and all of the laws of the State of New Jersey pertaining to such buildings or places.
B. 
A certificate of approval of the Chief of the Fire Department showing that the building complies with all laws of the State of New Jersey and all local ordinances pertaining to fire or safety.
A. 
The fee for the license issued under this article shall be as set forth in § 100-4B.
B. 
If the license is granted after July 1 of any year, the fee shall be 50% of the yearly fee.
Licensees under this article shall be subject to the following conditions and, in accepting the license, shall agree to abide thereby:

The building in which the exhibition is conducted shall in all respects comply with the requirements of the laws of the State of New Jersey and the ordinances of the Town of Newton respecting such building.
B. 
The licensee shall be responsible for any disorder and any police officer or fireman may enter such place at any time for the purpose of inspection and to enforce the laws of the State of New Jersey and the ordinances of the Town of Newton.
C. 
No smoking shall be permitted within the building during hours in which motion pictures or theatrical productions are being conducted, except in such specific areas within the building as may be reserved for smoking and which areas are approved by the Chief of the Fire Department.
Any person violating the provisions of this article shall be punishable as provided in Chapter 1, Article III, General Penalty.
