STATUTORY AUTHORITY
Enforcement of State Uniform Construction Code — See N.J.S.A. 52:27D-126 et seq.
A. 
There is hereby established in the Township of Cedar Grove a State Uniform Construction Code enforcing agency to be known as the "Cedar Grove Construction Inspection Agency," consisting of a Construction Official, Building Subcode Official, Plumbing Subcode Official, Electrical Subcode Official, Fire Protection Subcode Official and such other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency.
B. 
Each official position created in Subsection A hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217,[1] as amended, and N.J.A.C. 5:23 and appointed by the Township Manager, provided that, in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217,[2] and N.J.A.C. 5:23 to hold each such position.

The public shall have the right to do business with the enforcing agency at one location, except for emergencies and unforeseen or unavoidable circumstances.
A. 
There is hereby established a Construction Board of Appeals to hear appeals from decisions by the enforcing agency. Such Board shall consist of five members. At least one Board member shall be a registered architect or licensed professional engineer of building construction experience, and at least one Board member shall be as qualified as a Plumbing Subcode Official and one as qualified as an Electrical Subcode Official. No more than two Board members shall be selected from the same business or profession. Each Board member shall have had at least three years' experience in construction, design or supervision as a licensed engineer or registered architect; or, in the alternative, five years' experience in construction, design or supervision as an architect or engineer with a bachelor's degree in architecture or engineering, respectively, from an accredited institution of higher education; or, as a further alternative, 10 years' experience in construction, design or supervision as a journeyman in a construction trade or as a construction contractor, subcontractor or inspector.
B. 
The Township Council shall appoint the Board members and any alternate members. For the members first appointed, the Township Council shall designate the appointee's terms so that one shall be appointed for a term of one year, one for a term of two years, one for a term of three years, and two for a term of four years. At the expiration of such terms and thereafter, appointments shall be made for terms of four years. Vacancies shall be filled for the unexpired term.
C. 
Members of the Board may be removed for cause by the appointing authority. Notice of the proposed removal and the reasons therefor shall be provided in writing to the affected Board member, who shall have an opportunity to defend the charges in a private hearing before the Council.

D. 
The Township Council shall appoint such number of alternates as may be appropriate for terms not to exceed four years or may, in the alternative, appoint alternates on a case-by-case basis.
E. 
No regular or alternate Board member may be a member of the enforcing agency, the decisions of which are subject to the review of the Board.
F. 
Members of the Board shall be reimbursed their necessary expenses incurred in the performance of their duties.

A. 
Construction permit. The fee for a construction permit shall be the sum of the subcode fees in Subsection B, C, D, E, and F hereof and shall be paid before a permit is issued.
B. 
Building subcode fees. The building subcode fees shall be as follows.
(1) 
New construction.
(a) 
For new construction: $0.040 per cubic foot of the building or structure volume, including the basement, attic and main floors of Use Groups B, E, H-1, H-2, H-3, H-4, H-5, I-1, I-2, I-3, I-4, M, R-1, R-2, R-3, R-4, R-5 and $0.030 per cubic foot of the building or structure volume, including the basement, attic and main floors of Use Groups A-1, A-2, A-3, A-4, A-5, F-1, F-2, S-1 and S-2.
(b) 
Basic fee for new construction.

R-3, R-5 and U Use Groups: $50.
[2] 
All other use groups: $100.
(2) 
For renovations, alterations and repairs: $50 per $1,000 or part thereof for the first $2,000 of the estimated cost of the work and $25 per $1,000 or any part thereof in excess of $2,000. For a combination of alterations and additions; the sum of the fees computed separately as alterations and additions.
(3) 
For additions: computed the same way as new construction and minimum fee of $50.
(4) 
For decks, porches, satellite dishes, communication tower, roofing, central conditioning, fences six feet or over, sheds 100 square feet or more and/or 10 feet in height and any other outdoor structures shall be figured under the alteration fee. Sheds that are less than 100 square feet and less than 10 feet in height requiring a zoning permit only. Any fence/barrier around swimming pools requires a construction permit.
(5) 
Retaining walls:
(a) 
Retaining walls for R-3 and R-5:
[1] 
Wall surface less than 550 square feet: $50.
[2] 
Wall surface greater than 550 square feet: $75.
(b) 
In all other use groups, it shall be computed as an alteration.
(6) 
For demolition fees for Use Group U-Utility shall be $25 and for all use groups it shall be as follows:
(a) 
Less than 5,000 square feet of total area is $150.
(b) 
More than 5,000 square feet is $500.
(7) 
For removal or abandonment of any combustible or flammable liquid storage tank, swimming pool, or septic tank there shall be required a demolition permit. The fee shall be $75 per tank for Use Group R-3/R-5. For all other use groups, the fee shall be $200 per tank.
(8) 
For aboveground pools, the fee shall be $75. In-the-ground pools shall be $150. Any other fees for pools that appear in other sections of this Code book shall hereby be deleted.
(9) 
For signs and awnings with a logo and/or business name, the fee shall be $6 per square foot of surface of sign exclusive of posts. In case of the double-faced signs, one side shall be computed. Replacement of any sign face which requires no increase to the overall dimensions of said sign shall be $50 per sign.
(10) 
For asbestos abatement, the fee shall be $50 for Use Group R-3/R-5. All other use groups shall be $100. A certificate of occupancy shall be issued at the completion of the work.
(11) 
For radon remediation, the fee shall be $50.
(12) 
For lead hazard abatement, the fee shall be $50 for Use Group R-3. All other use groups shall be $100. A lead abatement clearance certificate shall be issued at the completion of the work. The certificate fee shall be $25.
(13) 
For tents in excess of 900 square feet or more than 30 feet in any dimension shall be $100.
(14) 
Moving a structure shall be computed the same as a new building. Any Township costs such as police, fire and public works shall be paid prior to the move by the applicant.
C. 
Electrical subcode fees. The electrical subcode fees shall be as follows:
(1) 
Outlets, fixtures, switches, receptacles, exit lights, emergency lights, horns, strobes, communication devices, pull stations and fractional horsepower motors shall be computed as follows:
(a) 
The fees shall be $55 for one to 25 outlets, etc.
(b) 
The fee for each additional 25 outlets, etc., shall be $10.
(2) 
Motors.
(a) 
The fee for motors greater than one horsepower and less than or equal to 10 horsepower is $50 when it stands alone. In addition to any other device, it shall be $10 per unit.
(b) 
The fee for motors up to 50 horsepower is $75.
(c) 
The fee for motors up to 100 horsepower is $150.
(d) 
The fee for motors greater than 100 horsepower is $600.
(3) 
Electrical devices, transformers, generators:
(a) 
Greater than one kW and less than or equal to 10 kW is $50 when it stands alone. In addition to any other device, it shall be $10.
(b) 
Greater than 10 kW and less than or equal to 50 kW is $75.
(c) 
Greater than 50 kW and less than or equal to 100 kW is $150.
(d) 
Greater than 100 kW is $600.
(4) 
Service panel, service entrance or subpanel:
(a) 
Less than or equal to 200 amps is $75.
(b) 
Greater than 200 amps and less than or equal to 1,000 amps is $150.
(c) 
Greater than 1,000 amps is $600.
(5) 
Solar photovoltaic systems:
(a) 
One kW and less than or equal to 50 kW is $75.
(b) 
Fifty-one kW and less than or equal to 100 kW is $150.
(c) 
Greater than 100 kW is $600.
(6) 
Annunciation control panels: $50 per unit.
(7) 
Burglar alarm systems: $50 per unit.
(8) 
Pools:
(a) 
Aboveground pools: $50.
(b) 
In-ground pools: $100.
(c) 
Exterior spas or hot tubs: $50.
(9) 
Air-conditioner feeders, condenser, and disconnects: $50.
D. 
Fire subcode fees. The fire subcode fees shall be as follows:
(1) 
Smoke/heat detectors/pull stations:
(a) 
One to five units shall be $50 and for each unit above five shall be an additional $5 per unit.
(2) 
Automatic fire sprinkler system including limited area systems and basement systems. The fee shall be based on the number of sprinkler heads:

(3) 
Standpipe system shall be $75 per hose connection.
(4) 
Fire-suppression system such as dry chemical, carbon dioxide, wet chemical or any other extinguishing agent shall be $75 for the first $5,000 or any part thereof and an additional $5 per $1,000 or any part thereof in excess of $5,000.
(5) 
Installation and/or modification of a combustible liquid storage tank for Use Group R-3 shall be $75 per tank. Installation and/or modification of a stationary combustible flammable liquid storage tank for all other use groups shall be $250.
(6) 
Premanufactured fireplaces, wood stoves, masonry fireplaces, hot tar kettles, metal or masonry flues, pool heaters or commercial exhaust hoods or spray booths shall be $75 per unit. Oil- or gas-fired appliances, such as gas-fired fireplaces and furnaces, shall be $75 per unit. The fee for commercial hoods and spray booths will not include the suppression system fee. This fee shall be added in.
(7) 
Incinerators and crematoriums shall be $260 per unit. The units shall require approval from the NJDEP before any permits can be issued.
(a) 
Smoke-control systems shall be $200.
(8) 
Private-yard fire hydrants which are not serviced by the Cedar Grove Water Department and/or any other water supplier regulated by the NJPUC shall be $500 per fire hydrant.
E. 
Plumbing subcode fees. The plumbing subcode fees shall be:
(1) 
The first three fixtures shall be $65 and every additional shall be $10 per fixture. Fixtures shall be water closets, urinal/bident, bathtub, lavatory, shower, floor drain, sink, hose bibb, dishwasher, drinking fountain, water cooler, soda machine, washing machine, decorative fountain, baseboard heating.
(2) 
The following equipment or appurtenance shall have the following fees for each unit:
(a) 
Water heater: $50.
(b) 
Backflow preventer (not lawn sprinkler): $85.
(c) 
Steam boiler: $85.
(d) 
Hot-water boiler (R-3/R-5): $85.
(e) 
Hot-water boiler: $85.
(f) 
Furnace: $85.
(g) 
Sewer pump: $85.
(h) 
Inceptor: $85.
(i) 
Separator: $85.
(j) 
Grease trap: $150.
(k) 
AC water cooled: $85.
(l) 
Refrigeration unit: $85.
(m) 
Sewer connection (R-3/R-5): $85.
(n) 
Sewer connection: $100.
(o) 
Water connection (R-3/R-5): $85.
(p) 
Water connection: $100.
(q) 
Gas piping (R-3/R-5): $50.
(r) 
Gas piping, all other Use Groups: $75.
(s) 
Lawn sprinkler system: $75.
(t) 
Garage disposal: $50.
(u) 
Oil lines and/or oil tank lines: $50.
F. 
Certificates and plan review fees.
(1) 
Certificate of occupancy shall be $50 for all alterations and additions in Use Groups R-3 and R-5 and in all other use groups shall be $75. For alterations and additions in all use groups and new construction for all use groups, 15% of the total construction permit which includes building, electrical, fire and plumbing subcode fees exclusive of NJDCA training fees, zoning fees, sewer and water fees. The base fee shall be $50 for other use groups.
(2) 
Certificate of compliance (smoke and carbon monoxide detector certification) shall be issued for the resale, rental or lease of any one- and two-family dwelling shall be $50.
(3) 
Certificate of approval shall be issued upon the completion of any work prescribed under the NJUCC. There shall be no fee.
(4) 
Certificate of continued occupancy for all use groups other than R-3/R-5 and single occupancy of an R-2 shall be $75.
(5) 
A certificate of occupancy shall be issued in a change of use, and the fee shall be $150.
(6) 
Plan review fee for new construction shall be 20% of the total construction permit which includes building, electrical, fire and plumbing subcode fees exclusive of NJDCA training fees, zoning fees, sewer and water fees. For the addition and/or alterations in Use Group R-3 and R-4, the plan review shall be 5% and for additions and alterations in all other use groups, the fee shall be 20% of the total construction permit which includes building, electrical, fire and plumbing subcode fees exclusive of NJDCA training fees, zoning fees, sewer and water fees. Plan review fees are nonrefundable.
G. 
Miscellaneous fees.
(1) 
Zoning Approval review fee shall be $25. Zoning review for a new R-3/R-5 structure shall be $100, and structure all other use groups shall be $250.
(2) 
The fee for an application for a variation in accordance with N.J.A.C. 5:23-2.10 shall be $250 for Class I structures, $150 for Class II structures and $50 for Class III structures.
(3) 
The State of New Jersey training fees shall be established per N.J.A.C. 5:23-4.19.
(4) 
Elevators, escalators, dumbwaiters, or lifts-all fees shall be assessed pursuant to N.J.A.C. 5:23-12.6 when the state acts as the enforcing agency.
H. 
This shall amend any other Township Code which prohibits the use of garbage disposal units.

A. 
The following fire limits are hereby established in the Township, to which shall be applied the supplemental restrictions on construction permitted in accordance with the State Uniform Construction Code and the subcodes adopted thereunder.
(1) 
West side of Pompton Avenue, beginning at a point 130 feet north of Franklin Street with a depth of 300 feet, thence north along Pompton Avenue to a point 47 feet south of Harper Terrace (to coincide with the LC1 Zone).
(2) 
West side of Pompton Avenue, beginning at Highland Road, thence north to South Mountain Avenue and west to Birch Road.
(3) 
West side of Pompton Avenue beginning at South Mountain Avenue with a depth of 200 feet, thence north along Pompton Avenue to Bradford Avenue (to coincide with the RC Zone).
(4) 
West side of Pompton Avenue, beginning at Bradford Avenue with a depth of 430 feet, thence north along Pompton Avenue to a depth of 200 feet at Robin Lane (to coincide with the RC Zone).
(5) 
West side of Pompton Avenue, beginning at Robin Lane with a depth of 570 feet, thence north along Pompton Avenue to a depth of 320 feet at Vreeland Lane (to coincide with the B Zone).
(6) 
West side of Pompton Avenue, beginning at Vreeland Lane with a depth of 530 feet, thence north along the sewer easement line to Church Street and then west to Grove Avenue and thence north along Grove Avenue and Pompton Avenue to the point of intersection of said roads (to coincide with B Zone).
(7) 
West side of Grove Avenue, beginning at a point 155 feet south of Lewis Road, thence west to the Erie Lackawanna Railroad, thence north along Grove Avenue and the railroad to the intersection of Grove Avenue and Pompton Avenue.
(8) 
West side of Pompton Avenue, beginning at the Erie Lackawanna Railroad with a depth of 250 feet and then north along Pompton Avenue to a depth of 40 feet at Brunswick Road (to coincide with the B Zone).
(9) 
West side of Pompton Avenue, beginning at a point 220 feet north of Fairview Avenue with a depth of 350 feet, thence north along Pompton Avenue to Lindsley Road (to coincide with the RC Zone).
(10) 
West side of Pompton Avenue, beginning at a point 1,050 feet north of Lindsley Road with a depth of 350 feet and then north along Pompton Avenue to the Township line (to coincide with the M-1 Zone).
(11) 
East side of Pompton Avenue, beginning at the Borough of Verona line with a depth of 1,000 feet, thence north along Pompton Avenue to a point 50 feet north of the intersection of Ridge Road with a depth of 1,350 feet (to coincide with the LC 2 Zone).
(12) 
East side of Pompton Avenue, beginning at Bradford Avenue, with a depth of 170 feet, thence north along Pompton Avenue to Union Street (to coincide with the RC Zone).
(13) 
East side of Pompton Avenue, beginning at Union Street with a depth of 120 feet, then north along Pompton Avenue to Cedar Street (to coincide with the B Zone).
(14) 
East side of Pompton Avenue, beginning at Cedar Street with a depth of 200 feet, then north along Pompton Avenue to Taylor's Brook and Bowden Road.
(15) 
East side of Pompton Avenue, beginning at Bowden Road and then northerly along Bowden Road a distance of 810 feet then to the west 190 feet and then north to the Erie Lackawanna Railroad and along Pompton Avenue north to the railroad (to coincide with the B Zone).
(16) 
East side of Pompton Avenue, beginning at the Erie Lackawanna Railroad and then north along Pompton Avenue to a point 570 feet north of Little Falls Road and east to the Peckman River (to coincide with the B Zone).
(17) 
East side of Pompton Avenue, beginning at a point 900 feet north of Bortic Road, then east to Little Falls Road and north along Pompton Avenue to a point 550 feet north of Commerce Road and east to the Erie Lackawanna Railroad and along said railroad to Little Falls Road (to coincide with the M-1 and M-2 Zones).
(18) 
East side of Pompton Avenue, beginning at a point 500 feet south of Stevens Avenue with a depth of 250 feet, then north along Pompton Avenue to a point 1,230 feet north of Stevens Avenue.
(19) 
East side of Pompton Avenue, beginning at a point 1,120 feet south of Lindsley Road with a depth of 200 feet north along Pompton Avenue to Lindsley Road (to coincide with the RC Zone).
(20) 
That area on Lindsley Road bounded by the Erie Lackawanna Railroad to the west, south and east and Lindsley Road and the Township line to the north.
(21) 
That area on Little Falls Road bounded by Bowden Road and Public Service right-of-way to the south, the Erie Lackawanna Railroad to the east, Little Falls Road to the west and the railroad and Township line to the north.
(22) 
East side of Ridge Road, beginning at a point 740 feet south of Bradford Avenue with a depth of 1,590 feet and then north along Ridge Road to Bradford Avenue (to coincide with the O Zone).
(23) 
North side of Lindsley Road, beginning at a point 125 feet west of Stevens Avenue with a depth of 340 feet, then east along Lindsley Road to a point 340 feet east of Stevens Avenue.
