[Adopted 5-14-1990 (Sec. 11.21 of the 1967 Code)]
As used in this article, the following terms shall have the meanings indicated:
NONALCOHOLIC DANCE CLUB
Any premises operated by any person or organization, whether incorporated or not, who or which is the owner, lessee, or occupant of a building whose purpose or object is providing dances, a dance floor, or amusement devices for persons aged 15 and up. Dances sponsored by an accredited school are not included.
PREMISES
Includes both the inside of the building and so much of the outside of the building as is owned or occupied by the license holder.
A. 
License required. No person shall engage in the business of operating a nonalcoholic dance club without being licensed as required by this article.
B. 
Application form. Application for a license shall be made to the Village Clerk on the form provided by such office.

The application shall be forwarded to the Legislation Committee of the Village, which shall hold a public hearing prior to the Committee's recommendation to the Village Board concerning action on the license.
The license shall not be issued if the applicant, or any partner, or the principal officer, or any stockholder holding more than 20% of the corporation if the applicant is a corporation:

Possesses an arrest or conviction record that substantially relates to the licensed activity.

B. 
Is under 18 years of age.

In reviewing each application, the Legislation Committee shall find that:
A. 
The establishment, maintenance, or operation of any nonalcohol dance club will not be detrimental to or endanger the public health, safety, morals, comfort, or general welfare.
B. 
The nonalcohol dance club will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted nor substantially diminish and impair property value within the neighborhood.
C. 
The establishment of a nonalcohol dance club will not impede the normal orderly development and improvement of the surrounding property for uses permitted in the district.
D. 
Adequate measures have or will be taken to maintain good order surrounding the location thereof.
A. 
Period. The license shall be for a period of one year or part thereof and shall expire June 30 following its issuance. License fees shall be prorated for applications made for periods of less than one year.
B. 
Consent to inspection. All license holders consent to warrantless inspection of the premises at any reasonable hour by police officers.
C. 
Notification. Any person holding a liquor license and nonalcohol dance club license shall notify the Police Department and the Village Clerk 48 hours in advance of the dates and hours when underage persons as defined in Ch. 125, Wis. Stats., will be allowed on the premises.
D. 
Supervision. There must be at least one adult supervisor, 21 years of age or older, on the premises during hours the premises is open.
E. 
Ages. No license holder shall permit any person age 14 or under upon the premises for the licensed activity.
F. 
Hours. A premises for which a license is issued may not be open before 4:00 p.m. and shall close at 11:00 p.m. if school is in session the following day and may remain open to 1:00 a.m. at all other times. The schedule of the D.C. Everest School District shall determine the days when school is in session for the purposes of this article.
G. 
No alcohol. No person may possess or consume alcoholic beverages on the licensed premises, nor may any person procure, sell, dispense or give away alcoholic beverages to any person on the licensed premises during the period of licensed activity.
H. 
Compliance with other license requirements.
(1) 
Persons required to obtain a nonalcohol dance club license are exempt from Article II of this chapter relating to dance halls.
(2) 
The license holder shall obey all other Village ordinances and state laws to obtain any other license required by ordinance, including but not limited to amusement device licenses.

A. 
Any person or firm or corporation who or which shall violate any provision of this article shall be subject to § 1-2 of this Code.
B. 
In addition to the penalties provided in § 1-2 of this Code, the Village may also revoke, or suspend for any period not to exceed 60 days, any nonalcoholic dance club license.
The Village Board may suspend or revoke any license issued pursuant to this article at any time for any reasonable cause which shall be in the best interest and good order of the Village, provided that the licensee shall be accorded due process of law.
