The Sugar Valley Community Volunteer Fire Company is recognized as the officially recognized fire company within the Borough of Loganton.

Volunteer firefighters of the officially recognized fire company are authorized to provide such services to the Borough as may be necessary for the protection of property and persons situate therein, including, by way of example and not of limitation, the extinguishment of fires and all such activities as may be necessary and appropriate to prevent or reduce the risk of loss of life or damage to property from fire, automobile accidents, medical emergencies, hazardous materials injuries, or other similar dangerous situations.
Volunteer firefighters may also provide nonemergency and public service functions, such as the removal, abatement, or mitigation of natural or man-made conditions which might cause injuries to persons or damage to property.
Volunteer firefighters may conduct and participate in such training activities and drills, either within or outside of the Borough, as may be deemed necessary by the appropriate officers of the fire company to maintain proficiency in providing service.
Volunteer firefighters may respond to calls or provide services to municipalities outside the Borough limits pursuant to mutual assistance agreements.
Volunteer firefighters may engage in fund-raising activities for the fire company, when authorized by the appropriate officers of the company, and may engage in such other duties or activities as duly authorized by said fire company.
The purpose of this article is to recognize the Sugar Valley Community Volunteer Fire Company as the official fire company of the Borough and to set forth the expanded scope of duties for volunteer firefighters in order to clarify the eligibility of said volunteer firefighters for workers' compensation benefits.

As used herein, the following terms shall have the meanings indicated, unless a different meaning clearly appears from the context:
Loganton Borough, Clinton County, Pennsylvania.
Sugar Valley Community Volunteer Fire Company.
Includes an individual, natural person, estate, trust, firm, corporation, partnership, governmental entity, association or other legal entity.
The Borough authorizes the fire company to recover the costs of fire-fighting materials used and expended, the use of the fire trucks, fire engines, rescue equipment and tankers, emergency medical supplies and hazardous situation abatement materials used and expended in connection with any fire, safety or rescue incident or operation, or hazardous situation abatement incident, including vehicular accidents and fires, occurring within the Borough or any other area in which the fire company is authorized by the borough or contracted with to provide such services.
Borough Council may by resolution, from time to time, establish, revise, amend or rescind a schedule of fees that may be charged by the fire company.
A person or persons receiving fire-fighting, rescue, or emergency services, or any combination of those services, shall be liable for the costs and expenses incurred by the fire company and any other fees established by the Borough unless the person:
A.
Paid to the Borough a tax which funds at least in part the services which the fire company provides;
B.
Is obligated to pay a municipality any tax which funds at least in part the services of the fire company and which municipality has contracted with the Borough for the fire company to perform services for a fee paid by the municipality to the Borough;
C.
Paid dues or a monetary contribution to the fire company within the preceding 12 months from the date that the services were provided; or
D.
Is a resident of the Borough or any other municipality which has contracted with the Borough for the fire company to perform services within the municipality.
The costs and fees as outlined in a resolution of Borough Council shall be recovered directly by the fire company by direct billing of the fire company or by an attorney, collection service or agency contracted with by the fire company. In addition to the costs and fees as outlined in a resolution of Borough Council, the fire company, or any attorney or collection service or agency contracted with by the fire company, shall be authorized to collect in addition to the costs and fees reasonable interest and administration fees for collecting the costs and fees.
In the event that any insurance carrier or person fails to pay any bill or invoice within 30 days of the mailing or delivery of such notice of charges, the fire company or any attorney or agency contracted with by the fire company who mailed or delivered the bill or invoice may enforce the provisions of this article by filing a civil action at law in a court of competent jurisdiction for the collection of any amounts due to the fire company together with statutory interest, court costs, collection fees and reasonable attorneys' fees. The remedies provided herein shall be in addition to any other relief, remedies or penalties that may be appropriate or provided by law.
