The owner of any property abutting upon any street in which a water main has been constructed shall make connections with such water line for the purpose of conducting water to such property.
The owner of such property shall be given at least 45 days' notice of this article requiring such water connections.
Upon the failure of such owner to make such water connection, the Borough of Auburn shall make such connection and shall collect the costs thereof from the owner by a municipal claim or in an action of assumpsit.
All such connections shall comply with the requirements of the Auburn Municipal Authority.

Any owner of property, person, partnership, firm, or corporation, who shall fail, neglect, or refuse to comply with any of the terms or provisions of this article or of any rule, regulation or requirement made pursuant thereto and authorized thereby shall, upon conviction in a summary proceeding under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus court costs and reasonable attorneys’ fees incurred by the Borough in the enforcement proceedings. Upon judgment against any person by summary conviction, or by proceedings by summons on default of the payment of the fine or penalty imposed and the costs, the defendant may be sentenced and committed to the county correctional facility for a period not exceeding 30 days. Each day that such violation exists shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this chapter in equity in the Court of Common Pleas of Schuylkill County.
