The Animal Control Officer may issue the warning to first-time offenders
when there is a less extreme case of cruelty or neglect. "Less extreme
cruelty or neglect" is defined as any unintentional act of cruelty
or neglect, which has no permanent effect on the animal and the aforementioned
behavior of the owner or custodian is subsequently corrected through
education.
When issuing a warning, the Animal Control Officer shall provide
detailed educational guidance specific to the violation and a copy
of these regulations.
If a violation of this chapter occurs within 12 months of the date
of the warning, the warning will become a first offense and, at the
discretion of the Animal Control Officer, a citation may be issued
as a second violation.
