This chapter is adopted pursuant to the authority granted by
§ 236.45, Wis. Stats., and for the purposes listed in §§ 236.01
and 236.45, Wis. Stats.
This chapter shall be known as, referred to, or cited as the
"Subdivision Ordinance, City of Marion, Wisconsin."
The purpose of this chapter is to:
A. Regulate and control the division of land within the City of Marion;
B. Promote the public health, safety, convenience, comfort, and prosperity;
conserve, protect, and enhance property value; and secure the most
appropriate use of land throughout the City of Marion;
C. Implement the City's Comprehensive Plan;
D. Promote orderly growth and development; further the orderly division,
layout and use of land; prevent the overcrowding of land; lessen congestion
in the streets and highways; provide for adequate light and air; facilitate
adequate provision for water, sewerage and other public requirements;
and provide for proper ingress and egress;
E. Prescribe reasonable rules and regulations governing the subdivision
and platting of land; the preparation of plats; the location, width,
and course of streets, highways, and parkways; the installation of
utilities, street pavements and other essential improvements; and
the provision of necessary public grounds for schools, parks and other
public open spaces; and
F. Promote proper monumenting of subdivided land and conveyancing by
accurate legal description.
It is not intended by this chapter to repeal, abrogate, annul,
impair, or interfere with any existing easements, covenants, deed
restrictions, agreements, ordinances, rules, regulations, or permits
previously adopted or issued pursuant to law. However, whenever this
chapter imposes greater restrictions, the provisions of this chapter
shall govern.
In their interpretation and application, the provisions of this
chapter shall be held to be minimum requirements and shall be liberally
construed in favor of the City of Marion and shall not be deemed a
limitation or repeal of any other power granted by the Wisconsin Statutes.
