A. The Workmen's
Compensation Act, as supplemented and amended, provides that members of volunteer fire companies or volunteer
fire departments in boroughs are, "Hereby declared to be 'employees'
of such . . . boroughs for all the purposes of this Act
and shall be entitled to receive compensation in case of injuries,"
received under certain circumstances therein set forth, "or while
performing any other duties of such companies or fire departments,
authorized by such . . . borough"; and
B. All fire
companies and fire departments located in the Borough of Waterford
are self-supporting and all perform duties and functions beyond those
set forth in the Workmen's Compensation Act, the performance
of which duties and functions is necessary to the continued existence
of the fire companies and fire departments, and result in additional
services and benefits to the Borough and its citizens.
A. Members of volunteer fire companies and volunteer fire departments
located in said Borough shall be authorized to do and perform the
following acts and duties, in addition to those set forth in the Workmen's
Compensation Act, upon giving notice to the Secretary of the Borough
at least 24 hours in advance of the performance of such act or duty:
(1) Engage
in any type of drill, training, ceremonial, practice, test or parade
either within or without the Borough duly called or authorized by
proper officer or officers of the volunteer fire company or by volunteer
fire department of which they are members.
(2) Engage
in the performance of any act or duty intended to promote the welfare,
efficiency, standing or other thing deemed necessary or advisable
to strengthen the company or department or to promote the welfare
of the Borough and its citizens when such act or duty is authorized
by proper officer or officers of the company or department of which
they are members.
(3) Engage
in the performance of any act or duty assigned in connection with
any public event or public gathering either authorized or directed
by proper officer or officers of the company of which they are members.
B. A member shall be deemed to be engaged in any act or duty above set
forth from the time he shall leave the firehouse to perform said act
or duty until he returns to the firehouse after the performance thereof.
