The designation of handicapped parking spaces, pursuant to the
provisions of N.J.S.A. 39:4-197, may be established by the Township
in the following manner:
A. By ordinance or by resolution adopted by the Township Council.
B. By inclusion on a site plan approved by resolution adopted by the
Planning Board or the Zoning Board of Adjustment.
C. By regulation promulgated by the Director of Public Safety.
Any resolution adopted by the Township Council, the Planning
Board or the Zoning Board of Adjustment and any regulation promulgated
by the Director of Public Safety establishing handicapped parking
spaces, on public or private property, shall be filed with the Township
Clerk.
All handicapped parking stalls shall be 12 feet wide. Parking
shall be restricted to persons who have been issued handicapped parking
permits as provided by N.J.S.A. 39:4-197.
The posting of signs or pavement markings designating a handicapped
parking space shall create a presumption that the handicapped parking
space has been established by the Township pursuant to N.J.S.A. 39:4-197.
Signs shall comply with the specifications provided by N.J.S.A. 39:4-198
and shall include both pavement markings and signage that is visible
when the pavement markings are covered. The pavement markings and
signage shall be maintained by the owner of the property on which
the parking space is located.
Any person parking a motor vehicle in a restricted parking space
without a special vehicle identification card issued shall be liable
to the penalty provided in N.J.S.A. 39:4-197(3)c.
