From and after the passage of this article, all persons or entities,
including but not limited to title, insurance companies, title abstract
companies, attorneys and others engaged in the business or practice
of holding real estate settlements and/or closings, who contact the
Borough of Norwood Tax Collector or its agent for the purpose of obtaining
a certification as to the status of real estate taxes for real property
situated within the Borough of Norwood shall be required, in consideration
for the providing of such a service, to pay to the Tax Collector of
the Borough of Norwood a fee in such amount as shall be set from time
to time by resolution of the Borough Council.
Upon failure of any person or entity as set forth above, to
whom tax certification information has been provided, to make payment
as required by this article, the Borough of Norwood or the Tax Collector
of the Borough of Norwood shall have the right and power to proceed
with all legal remedies available to it to effectuate collection of
the tax certification fee. If legal action is required to effectuate
such collection, the person or entity to whom the tax certification
information has been provided shall be responsible for the payment
of court costs and attorneys' fees incurred by the Tax Collector
and the Borough of Norwood.
