For the purposes of this chapter, the following terms shall have the meanings respectively ascribed:
PARK
Any municipal park or recreational facilities, owned, operated or under control of the village.
PERMIT
A written authorization issued by and under the authority of the Village Clerk with the approval of the Mayor, permitting the performance of a specified event or contest in any of the parks or recreational facilities.
Rules and regulations for parks, park areas and park buildings may be made from time to time by the Village Board of Trustees. All persons must comply with the rules and regulations after the same have been promulgated and approved by the Village Board of Trustees and posted at the park premises.

(a) 
Designated. All parks shall be open from 8:00 a.m. until dark every day, unless written permission is granted for any other times by the Village Clerk with the approval of the Village Board of Trustees or unless otherwise posted.
(b) 
Prohibited hours. No person shall under any circumstances loiter or remain in any park or park area or park building between closing time and 8:00 a.m.
Any request for a permit for the use of any facilities of any park or park area, fields or buildings or part of any building therein shall be made upon written application to the Village Clerk.
The following uses and activities shall be and are hereby prohibited in a park or park area:
(a) 
Injury to property. No person in a park or park area shall injure, deface, displace, remove, destroy or tamper with any gates, fences, seats, shelters or structures of any nature whatsoever, or any equipment or building or part thereof, or any sign, notice or inscription, or any growing thing, owned, operated or under control of the village.
(b) 
Rubbish and debris. No person shall carry through, leave or throw, drop or discharge any rubbish or debris of any nature in any park or park area.
(c) 
Spitting. No person in any park or park area or any building or structure therein owned or operated by or under the control of the village shall expectorate upon any portion thereof or in any structure, walk, stairway or floor.
(d) 
Advertising. No person shall distribute or display any flag, banner, sign or any other matter for advertising purposes within any park or park area nor attempt to attract attention for advertising purposes by the use of any musical instrument or any sound device within any such area.
(e) 
Soliciting. No person shall solicit for any purpose whatsoever.
(f) 
Disorderly conduct. No person shall annoy persons or people or do any act tending to create a nuisance and breach of the peace.
(g) 
Golf. The playing or practicing of golf or the driving or hitting of golf balls is prohibited.
(h) 
Kites; similar devices. No person shall operate aircraft, kites, balloons or other air devices from and above the surface of any park or park area except with the written permission of the Village Clerk.
(i) 
Bicycle riding. Bicycle riding is prohibited, except in designated areas.
(j) 
Abusiveness; obscenity. No person shall use threatening, abusive, profane or obscene language or perform any obscene or indecent act.
(k) 
Entry and exit. No person shall enter or leave any park or park area or building except by the established entranceways or exits.
(l) 
Children. Children under seven years of age must be accompanied by a parent or guardian to enter and remain in park area.
(m) 
Acts causing injury. No person shall do any act of any nature whatsoever which will cause or contribute to the injury of any person, animal or property within any park or park area.
(n) 
Disrobing. No person shall disrobe or assist, aid or abet any person to disrobe within the park or park area, except in designated places.
(o) 
Camping. No person shall tent, camp or erect or maintain a tent shelter in any park or park area, except by permission.
(p) 
Weapons; fireworks. No person shall bring in or have in his possession in any park or park area any firearms or concealed weapons or fireworks of any nature whatsoever.
(q) 
Sales. The sale of any wares, merchandise, foods and beverages of any type or nature within all park grounds and buildings is prohibited except with the written permission of the Village Clerk.
(r) 
Fires. No person shall kindle, build or maintain a fire in any park or park area.
(s) 
Animals. No dogs or domesticated animals shall be allowed in the park except by special permission of the Village Clerk and written approval of the Mayor.
No vehicles except municipal vehicles shall be parked inside a park unless in a specified parking area.

The Town of Eastchester is hereby designated as the agent of the Village of Tuckahoe for the management and operation of municipal playgrounds and recreation areas within the limits of the Village of Tuckahoe.

Use of any athletic field in the Parkway Oval Recreation Area is prohibited except where a permit for such use has been duly issued by the Town of Eastchester through the officials thereof designated by the said Town for the purpose, and such permit has not expired or been revoked.

No person or organization shall hold, direct, manage or participate in any athletic or other exhibition, parade or demonstration contest on any municipal playground or recreation area except where a permit therefor has been duly issued by the Town of Eastchester through the officials thereof designated by the said Town for that purpose and such permit has not expired or been revoked.

No motor vehicle or motorcycle shall be driven or parked in any recreation area or playground by any person or persons except such vehicles as may be specifically authorized by the Police Department of the Village of Tuckahoe or by the Town of Eastchester for use in the management or operation of such recreation area or playground.

No person shall enter or stay in any municipal playground or recreation area after dark, except where a permit for such entry or stay shall have been duly issued by the Town of Eastchester through the duly authorized officials thereof and such permit has not expired and has not been revoked.

No person shall engage in or play the game of golf at or in any part of the Parkway Oval Recreation Area.

The playing of any games or cards in any municipal playground or recreation area is prohibited.

In any municipal playground or recreation area, no person shall engage in pool selling or bookmaking with or without writing; no person shall make or record any bet or wager; and no person shall receive, register, record or transfer any money, thing or consideration of value, bet or wagered upon the result of any event, lot or chance.

No person shall buy, sell or consume any beverage containing alcohol in any municipal playground or recreation area without a permit for the same duly issued by the proper authority.

No person shall refuse to leave a municipal playground or recreation area after having been ordered to do so by a police officer or by a playground director appointed either by the Town of Eastchester or by the Village of Tuckahoe.

No person shall offer or expose for sale, possess or sell, furnish, explode or cause to be exploded in any municipal playground or recreation area any fireworks as the said term is defined in § 1894-a of the Penal Law of the State of New York or as defined in § 270.00 of the Penal Law of the State of New York as the said law shall exist on or after September 1, 1967, or any amendment to either statute, except as specifically authorized by resolution of the Village Board of Trustees; nor shall any person other than a peace officer, bear, carry, transport or use in any municipal playground or recreation area any species of firearms, air gun or any other weapon whatsoever.

Otherwise than as provided in this Article, any resident of the Town of Eastchester may enjoy the recreational use of any playground, except as to facilities for which a permit has been issued by the proper authority to other persons, except as provided in § 16-21.

Every person who shall violate any provision of this Article shall be subject to a penalty as prescribed in § 1-7 for each violation thereof. Every violation of this Article shall also constitute disorderly conduct and the person violating this Article shall be a disorderly person.
