On and after the effective date of this article, the following
regulations shall control the preparation and collection of refuse,
garbage and rubbish within the Township of Jackson. It is the policy
and intent of this article that to protect and provide for the public's
safety, health and welfare every owner or occupant of premises in
the Township shall be responsible for the disposition of refuse, rubbish
and garbage originating on his premises.
For the purposes of this article, the following terms, phrases,
words and their derivations shall have the meanings given herein.
When not inconsistent with the context, words used in the present
tense include the future, words in the plural include the singular
number, and words in the singular number include the plural number.
The word "shall" is always mandatory and not merely directory.
ASHES
The residue from the burning of wood, coal, coke or other
combustible material.
GARBAGE
Putrescible animal and vegetable waste resulting from the
handling, preparation, cooking and consumption of food.
PERSON
Any person, firm, partnership, association, corporation,
company or organization or any kind.
REFUSE
All putrescible and nonputrescible solid waste (except body
waste), including garbage, rubbish, ashes and street cleanings.
RUBBISH
Nonperishable solid wastes, excluding ashes, consisting of
both combustible and noncombustible waste, such as paper, cardboard,
tin cans, yard clippings, wood, glass, crockery and similar materials.

A. Subject to the specific provisions of §
216-13, it shall be the duty of every owner, tenant, lessee or occupant of every building within the corporate limits of the Township to provide or cause to be provided and to keep on the premises, at all times, suitable receptacles for receiving and holding the garbage, refuse and rubbish that may accumulate or be collected in the premises. Suitable receptacles shall be designed for the combined disposal of garbage, refuse and rubbish and shall be watertight and closely covered. Except as otherwise provided herein, suitable receptacles shall have a capacity of
96 gallons or less or shall be disposable plastic trash bags, which
shall be sealed.
B. Burlap bags may be used for the disposal of leaves, grass clippings,
tree trimmings, brush and similar materials.

A. Garbage and rubbish. All garbage and rubbish, before being placed in garbage cans or other receptacles as described in §
216-12, shall be drained of liquid and may be wrapped in paper.
B. Trimmings and clippings. Tree trimmings, which shall be no more than
three inches in diameter, brush and similar materials shall be cut
to a length of six feet or less and securely tied in bundles not more
than two feet thick and are not to weigh more than 30 pounds before
being deposited for collection.
C. Lawn clippings and leaves. Lawn clippings, hedge clippings and leaves must be placed in disposable receptacles for collection consistent with the requirements of §
216-12 hereof.
D. Newspapers. Newspapers shall be securely bound with string or cord
in bundles not to exceed 50 pounds of weight.
E. Capacity. No refuse, rubbish or garbage receptacles, newspaper bundles,
plastic bags, etc., shall exceed 50 pounds in weight and shall be
of such size and shape as to permit easy handling. Bundles of tied
tree trimmings and brush shall not exceed 30 pounds.
F. Duty to maintain refuse, rubbish and garbage receptacles in a safe
and sanitary condition. All refuse, rubbish and garbage receptacles
shall be maintained in a safe and sanitary condition, and any receptacle
that does not conform to the provisions of this article or that has
ragged or sharp edges or any other defects liable to hamper or injure
the person collecting the contents thereof shall be promptly replaced.
Any collector of such refuse, rubbish or garbage shall have the authority
to refuse collection services for failure to comply herewith.
G. Each box, carton or other similar container must be flattened out
and disassembled so as to be readily and easily handled. No part of
any such article shall exceed four feet in length or weigh more than
50 pounds when deposited for collection.
H. All broken glass, pottery, ceramic or other similar materials shall
be placed in a secure container to facilitate the safe loading of
such materials.
I. Each container of rubbish, refuse or garbage shall be so staked or
otherwise stabilized by the property owner, tenant or other person
placing such refuse, rubbish or garbage for collection or from whose
property such garbage is proposed to be collected, so that it cannot
be readily overturned or upset as by animal infiltration or by a child.
Metallic receptacles shall be properly secured with a tight-fitting
lid or cover, and disposable plastic bags shall be properly sealed.
J. If any receptacle containing rubbish, garbage or refuse is upset
or overturned by a person other than a collector engaged in garbage,
rubbish or refuse collection, the property owner, tenant or other
person placing such refuse, rubbish or garbage for collection shall
promptly clean up such spillage and restore same to a receptacle as
herein provided.
K. If any receptacle of refuses, rubbish or garbage is upset or overturned
by a collector, the person responsible for such spillage shall immediately
collect and dispose of same in accordance with this article.
L. All garbage, rubbish or refuse containers must be removed from the
curb or other authorized point of pickup by the property owner by
9:00 p.m. of the same day that garbage, rubbish or refuse is collected.

A. Frequency of collection. Garbage, refuse and rubbish accumulated
by residents of the Township shall be collected at least once a week
on a schedule to be established by the collector. Such schedule may
be altered or amended from time to time to conform with legal holidays
and other emergency matters or upon special arrangements with a collector.
B. Placement of receptacles. All receptacles shall be placed by the
owner, tenant, lessee or occupant of the building at the curbline
to the front of their premises before 6:00 a.m. on the days designated
for collection as herein provided; provided, however, that if any
building abuts upon any street not improved by curbs, then receptacles
shall be placed by the owner, tenant, lessee or occupant of the building
at a point where the street and the physical boundary of such premises
meet or as reasonable safety precautions may dictate.
C. Quantity. No person shall be entitled to have collected on a specified
day more than eight receptacles weighing not more than 50 pounds each,
provided that no more than four of these receptacles shall contain
lawn clippings, hedge clippings, tree trimmings, brush, leaves or
other similar materials and that no more than four of these receptacles
shall contain refuse, garbage or rubbish. This provision shall be
construed as establishing minimum requirements which can be increased
upon special arrangements with the collector. For purposes of this
section, each separate bundle of tree trimmings, tied brush or newspapers
and each separate container of refuse shall be deemed to be one receptacle.

The following refuse shall be deemed not acceptable for collection:
A. Dangerous materials or substances, such as poisons, acids, caustics,
noxious chemicals, radioactive materials, corrosives, infected materials,
explosives and ammunitions or any other materials likely to cause
injury to any person or damage to equipment used in making collections.
B. Any more than one receptacle of materials resulting from the demolition,
repair, excavation, construction, renovation and similar activities
performed on buildings or structures, including but not limited to
such materials as plaster, mortar, lumber, roofing materials and the
like.
C. Special materials generated by a contractor shall be entirely disposed
of by the contractor.
D. Septic waste, sewage or fecal matter, loose piles of vegetation or
tree branches, unless properly prepared for collection.
The Township Committee shall have the power, if in its opinion
it is more advantageous to have garbage, refuse and rubbish collected,
removed and disposed of by private collectors, to make a contract
or contracts for such work or any portion thereof with any individual
or individuals, corporation or corporations. Said contract shall be
entered into and made only after bids therefor have been advertised
according and subject to all applicable laws. The person to whom such
contract is awarded shall give satisfactory bond or security for the
faithful performance of his work. The Township Committee shall also
have the power to establish a municipal system for the collection
and disposal of garbage, refuse and rubbish subject to all applicable
laws.
Any person, firm or corporation violating any of the provisions
of this article shall be subject to a fine not exceeding $500 or imprisonment
in the county jail for a term not exceeding 90 days, or both, in the
discretion of the Judge before whom such convictions shall be had.
Each and every violation of this article, or each day that any provision
of this article shall be violated, shall be construed as a separate
and distinct violation thereof.
