Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in N.J.S.A. 39:1-1 shall be
deemed to apply to such words and phrases used herein.
No person shall abandon a vehicle within the City, and no person
shall leave a vehicle at any place within the City for such a period
of time as to cause the vehicle to reasonably appear to be abandoned.
No person shall leave any partially dismantled, wrecked or junked
vehicle on a street or highway within the City.
No person in charge or control of property within the City,
whether as owner, tenant, occupant, lessee or otherwise, shall allow
partially dismantled, nonoperating, wrecked, junked or discarded vehicles
to remain on the property longer than 48 hours; and no person shall
leave such vehicles on any property within the City for a longer time
than 48 hours. This section shall not apply to a vehicle in an enclosed
building; a vehicle on the premises of a business enterprise operated
in a lawful place and manner when necessary to the operation of the
business enterprise; or to a vehicle in an appropriate storage place
or depository maintained in a lawful place and manner by the City.
Whenever any member of the Police Department finds a vehicle in the City which is illegally parked in violation of any section of this Code or of any statute of the State of New Jersey, and the police officer has reasonable grounds to believe that the vehicle has been abandoned, the vehicle shall be subject to the provisions of §
412-6.
A police officer may remove or secure the removal of a vehicle, as defined in §
412-4 of this chapter, to a place as may be designated by the Director for the impounding of vehicles and be retained there and impounded until the person owning the vehicle shall pay the cost of removal together with a garage charge as set forth in Chapter
155, Fees. Immediately after a vehicle is so removed, the Chief of Police, or member acting for him/her, shall notify the registered owner, in writing, by personal service or by registered mail, at the last known address of the owner, of the removal of his/her vehicle and the reason for the same and the location of the vehicle. After the vehicle has been in the possession of the Police Department for six months and the owner is unknown, cannot be found or refuses to retrieve the vehicle, the Director may proceed to sell the vehicle in accordance with the provisions of the laws of the state.
Any person who violates any provisions of this chapter shall
be subject to a fine of $38.
