This chapter may be known as and cited as the "Town of Schroeppel
Subdivision Regulations Law."
The Town Board of the Town of Schroeppel hereby enacts this
chapter of the Code of the Town of Schroeppel as Local Law No. 6 of
1988.
The Planning Board has the power and authority to approve plats
of a subdivision or resubdivision of land, with or without streets
or highways, within the Town of Schroeppel. Such approval shall be
in accordance with the procedures and regulations set forth herein
and is prerequisite to the filing of any plat for the subdivision
or resubdivision of land, as defined herein. In the office of the
Oswego County Clerk. Subdivision approval in accordance with these
regulations shall be a prerequisite to the issuance of any building
permit or certificate of occupancy for construction or use of a subdivision
of land.
It is hereby declared to be the policy of the Town of Schroeppel
that the subdivision and development of land for residential, commercial
and industrial purposes shall be guided and regulated in such a manner
as to meet the following requirements for orderly and harmonious growth:
A. Land to be subdivided or developed shall be of such character that
it can be used safely without danger to health or peril from fire,
flood, erosion, excessive noise or smoke or other menace.
B. Proper provisions shall be made for drainage, water supply, sewerage
and other appropriate utility services.
C. The proposed streets shall provide a safe, convenient and functional
system for vehicular circulation and shall be properly related to
the Master Plan of the Area. Street names shall be designated in accordance
with the procedure established by county law. Streets shall be of
such width, grade and location as to accommodate prospective traffic
as determined by existing and probable future land and building uses.
D. Buildings, lots, blocks and streets shall be so arranged as to afford
adequate light, view and air to facilitate fire protection and to
provide ample access for fire-fighting equipment to buildings.
E. Land shall be subdivided or developed with due regard to topography
so that the natural beauty of the land and vegetation shall be protected
and enhanced.
F. Adequate sites for schools, parks, playgrounds and other community
services shall be located so that residents of all neighborhoods shall
have convenient access to such facilities.
For the purpose of this chapter, certain words used herein are
defined as follows:
PLANS and PLATS
A.
SKETCH PLANAn informal plan indicating salient existing features of a tract and its surroundings and the general layout of a proposed subdivision.
B.
PRELIMINARY PLATA drawing showing the layout of a proposed subdivision, including but not restricted to road and lot layout and approximate dimensions, key plan, topography and drainage and all proposed facilities unsized, including preliminary plans and profiles, at suitable scale.
C.
FINAL PLATA drawing showing a proposed subdivision, containing such detail as may be required by these regulations and the modifications, if any, required by the Planning Board at the time of approval of a preliminary plat of such proposed subdivision, if such preliminary plat has been so approved.
D.
FINAL GRADING PLANA drawing showing the proposed grading for surface water runoff of the entire subdivision, containing such detail as required by these regulations and the modifications, if any, as may be required by the Planning Board prior to the approval of the final plat.
SIMPLE SUBDIVISION
The following classifications of subdivisions shall be known as "simple subdivisions" and shall be considered and approved, approved with modifications or disapproved by the Code Enforcement Officer as set forth in §
81-6.1 herein:

A.
Subdivisions involving the mere adjustment of existing lot lines
or lot lines shown on an approved, yet unfiled, plat map, without
the creation of new streets, curb cuts, infrastructure or building
lots.
B.
Subdivisions involving the elimination of existing lot lines
so as to consolidate one or more lots into a lesser number and not
involving the creation of new streets, curb cuts, infrastructure or
building lots.
STREETS
A way for vehicular traffic, whether designated as a street,
highway, thoroughfare, parkway, road, avenue, boulevard, lane, drive,
place or other similar designation. The following functional classification
is used in those regulations:
A.
ARTERIAL STREETSThose which are used primarily for fast or heavy traffic, usually with complete or partial control over access from abutting property.
B.
COLLECTOR STREETSThose which carry traffic from minor streets to major system of arterial streets and highways.
C.
MINOR STREETSThose which are used primarily for access to the abutting properties.
D.
MARGINAL ACCESS STREETSMinor streets which are parallel to and adjacent to arterial streets and highways and which provide access to abutting properties and protection from through traffic.
E.
CUL-DE-SAC STREETSMinor streets with one end open for public vehicle and pedestrian access and the other end terminating in a vehicular turnaround. The length of a cul-de-sac street shall be measured along the center line from its intersection with the center line of the street from which it runs to the center of the cul-de-sac turnaround.
F.
SERVICE DRIVESMinor private ways which are used primarily for vehicular service access to the back or the side of properties otherwise abutting on a street.
SUBDIVISION
A division of any part, parcel or area of land by the owner
or agent, either by lots or metes and bounds, into lots or parcels
two or more in number for the purpose of conveyance, transfer, improvement,
building development or sale. A subdivision shall not include, however,
the division of land for agriculture or residential purpose, which
has not been subdivided within the past five years, into three or
less lots, each having a minimum lot size required in the zoning district
in which the lots are located, and which does not involve the creation
of a new street highway, the term "subdivision" shall include resubdivision.
