The provisions of this article imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.
No person shall park a vehicle at any time upon any of the streets or parts of streets described in Schedule I, § 225-48, attached to and made a part of this chapter.
A. 
Whenever snow has fallen and the accumulation is such that it covers the street or highway, no vehicle shall be parked on the main traveled or major roadways or portions thereof, as described in Schedule II, § 225-49, attached to and made a part of this chapter. The parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
B. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary emergency no parking signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of emergency no parking signs when weather conditions, accidents, fires, public celebrations, etc., dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that emergency no parking signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
C. 
Whenever snow has fallen and accumulation is such that it covers the street or highway, no vehicle shall be parked on any residential street in the Township. For residential streets wherein off-street parking is available, the parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic. For residential streets wherein off-street parking is not available, as described in Schedule II, § 225-49, as seen below and made a part of this chapter, the parking prohibitions shall remain in effect for alternate sides of the residential streets as described in Schedule II, § 225-49, after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.

D. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
E. 
The effectiveness of this section is contingent upon signs being erected as required by law.
No person shall park a vehicle between the hours specified on any day upon any of the streets or parts of streets described in Schedule III, § 225-50, attached to and made a part of this chapter. The Police Department is authorized to post such signs and notices as necessary.

No person shall park a vehicle for longer than the time limit specified between the hours listed upon any day except Sunday and public holidays on any of the streets, parts of streets, or other locations described in Schedule IV, § 225-51, and Schedule XXVII, § 225-74 attached to and made a part of this chapter.
A. 
Handicapped parking on street. In accordance with the provisions of N.J.S.A. 39:4-197, the street locations, as shown in Schedule V, § 225-52, attached to and made a part of this chapter, are designated as handicapped parking spaces. Such spaces are for use by persons who have been issued special identification cards for plates or placards by the Division of Motor Vehicles or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.
B. 
Handicapped parking on municipal parking lots and Board of Education property. In accordance with the provisions of N.J.S.A. 39:4-197, the off-street municipal parking yards and Board of Education property, as shown in Schedule VI, § 225-53, attached to and made a part of this chapter, are designated as handicapped parking areas. Such spaces are for use by persons who have been issued special identification cards for plates or placards by the Division of Motor Vehicles or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.
C. 
Handicapped parking on private property.
(1) 
Open to the public. In accordance with the provisions of N.J.S.A. 40:48-2.46, the off-street parking yards, as shown in Schedule VII, § 225-54, attached to and made a part of this chapter, are designated as handicapped areas. Such spaces are for use by persons who have been issued special identification cards for plates or placards by the Division of Motor Vehicles or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.
(2) 
All other private property. In accordance with the provisions of N.J.S.A. 39:5A-1, the off-street parking yards, as shown in Schedule VIII, § 225-55, attached to and made a part of this chapter, are designated as handicapped parking areas. Such spaces are for use by persons who have been issued special identification cards for plates or placards by the Division of Motor Vehicles or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these spaces.
D. 
Signs, pavement markings, installation and maintenance. The owners of the premises referred to in Subsection C shall provide and install signs and pavement markings for each parking space reserved for use by handicapped persons, which signing and marking shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township. The owner shall be responsible for the repair and restoration or replacement of the same.
The streets or parts of streets described in Schedule IX, § 225-56, attached to and made a part of this chapter, are hereby designated as no stopping or standing streets. No stopping or standing signs shall be installed as provided in the schedule.

A. 
The Township is hereby authorized to designate, subject to the approval of the governing body as herein provided, certain streets and other public areas within the Township as permit parking areas in which only resident vehicles displaying valid parking permits, vouchers or hang tags may stand or be parked on such streets. The streets or parts of streets described in § 225-73, Schedule XXVI, attached to and made a part of this chapter, are hereby designated as parking by permit only. Signs shall be installed as provided in the schedule.
B. 
No person shall be permitted to park any vehicle on a permit-parking-only street or portions thereof described in this chapter, unless such person has a valid parking permit.
C. 
Application for parking permit. Application for a parking permit under this article shall be made, in writing, to the Municipal Clerk or his/her designee upon such form as shall be prepared by the office of the Municipal Clerk. Fees, if applicable, for residential parking permits shall be as established under Chapter 172 of the Ewing Township Code and shall be payable upon issuance of a permit.
D. 
Conditions for granting of permit. Parking permits shall be granted to the following person or persons under terms and conditions as hereinafter set forth: to persons who are owners/occupants and/or residents by way of a lease on any street, a portion thereof upon which parking is so restricted, for every vehicle owned or leased by such person who is a resident/owner and/or occupant by way of a lease, which shall include a company-owned vehicle principally driven by such resident. In the case of an occupant by way of a lease, said occupant must show proof to the satisfaction of the Municipal Clerk that said occupancy shall be for a period of at least one year.
E. 
Residential parking permits shall be valid for a one-year period. Permits may be renewed upon expiration, provided that the conditions for issuance still exist.
F. 
Permits shall be issued only for passenger automobiles, as defined in N.J.S.A. 39:1-1 et seq., and shall not be issued for any recreational vehicles or for any commercial vehicles not otherwise owned by a resident of the street and permitted in accordance with Subsection D, above, or other types of vehicles as defined in N.J.S.A. 39:1-1 et seq.
G. 
Permits shall not be transferable from the applicant to any other person. However, permits may be transferred from one vehicle to another vehicle owned or leased by the same applicant upon the filing of a transfer application and the payment of a transfer application fee, if applicable.
H. 
Permits shall be prominently displayed on the rear driver side window of the vehicle for which a permit has been issued.
I. 
All vehicles for which parking permits have been issued shall be subject to all other parking regulations set forth in the Township of Ewing municipal ordinances and to all parking restrictions and prohibitions established pursuant to Title 39 of the New Jersey Statutes.
J. 
Exception to permit provisions.
(1) 
Contractor, service and delivery vehicles bearing the name and address of a commercial business may park without a permit during the times they are rendering service but in no event longer than an eight-hour period.
(2) 
Emergency vehicles, gas, electric, telecommunications and other similar vehicles may park on permit-parking-only streets during the times they are rendering service or repairs on said street.
(3) 
Health care providers may park their vehicles on permit-parking-only streets during the times they are rendering assistance and/or health care service to residents of said streets (such health care provider to be defined as a nurse, home health aid, physical therapist, or any other medical professional).
K. 
Two visitor permits shall be issued to each residential unit requesting them for use only by visitors to that residential unit. These visitor permits shall be valid for one calendar year and will be renewed upon request and proof of residence.
(1) 
A resident may request additional visitor parking permits for events such as gatherings, parties, etc., which shall be valid for one twenty-four-hour period only.
L. 
Surrender of permit. An application for a parking permit under this article shall provide to the Municipal Clerk or his/her designee satisfactory evidence that such person fulfills all conditions required for the issuance of a permit. Whenever the conditions no longer exist, any person holding such permit shall surrender the same to the Municipal Clerk or his/her designee. It shall be unlawful for any person to represent that he/she is entitled to a permit hereunder when he/she is not so entitled to a permit, or to park a vehicle displaying such permit at any time when the holder of such permit is not entitled to hold it.
M. 
All sales or exchanges, whether for monetary or other consideration, of any parking permit issued pursuant to this chapter is strictly prohibited and subject to the penalties stated herein. A violation of this section may result in revocation of the violator's permits.
N. 
The Township's Police Department shall be the enforcing agency with respect to the provisions hereof.
O. 
Counterfeit permits; penalty.
(1) 
It shall be unlawful and a violation of this chapter for a person to copy, produce or otherwise bring into existence a facsimile or counterfeit parking permit or alter an expired parking permit.
(2) 
Any person committing a violation of this subsection shall be subject to a penalty not to exceed $500 and/or imprisonment for not more than 10 days for each such violation. Any such penalties may be imposed by the Municipal Court.
P. 
Violations and penalties. Any person who violates any provision of this chapter shall, upon conviction thereof, be punished by a fine of $50 for the first violation; for any additional violation, the fine shall be $150. A separate offense shall be deemed committed on each day, or part thereof, during or on which a violation occurs or continues. A violation of this section by a tenant of a residence shall be a violation of Chapter 284, Article II, Licensing and Registration, of the Ewing Township Code.

A. 
Creation; powers; compensation; qualifications.
(1) 
There is hereby created in the Township of Ewing the designation of “parking enforcement officer.” The Township of Ewing shall have the authority to appoint those parking enforcement officers that may be necessary to carry out the responsibilities that the Township may have under the laws of the State of New Jersey and the ordinances and regulations of the Township of Ewing relating to the parking of vehicles within the municipality.
(2) 
Parking enforcement officers shall be appointed by the Township of Ewing in accordance with the provisions of N.J.S.A. 40A:9-154.7 et seq.
(3) 
All parking enforcement officers shall have the authority to issue parking tickets, serve and execute process for parking offenses and cause vehicles to be towed when necessary. Such responsibilities and duties shall be carried out in accordance with N.J.S.A. 40A:9-154.7 and the ordinances and regulations of the Township of Ewing.
(4) 
Parking enforcement officers shall not carry or use a firearm while on duty but shall be deemed to be performing a public safety function while on duty.
(5) 
The term, hours and compensation for a parking enforcement officer, when not otherwise a part of the duties of an employee, shall be set by the Township Council in accordance with the Township’s Salary Ordinance.
(6) 
Consistent with N.J.S.A. 40A:9-154.9, no person shall be appointed as a parking enforcement officer unless the individual meets the following qualifications:
(a) 
A resident of this state during the term of appointment;
(b) 
Able to read, write and speak the English language well and intelligently;
(c) 
Of sound mind and in good health;
(d) 
Of good moral character; and
(e) 
Has not been convicted of any offense involving dishonesty or which would make the person unfit to perform the duties of his office.
B. 
Fingerprints; eligibility check; training course; uniform.
(1) 
All parking enforcement officers shall be fingerprinted prior to commencing their duties, and their fingerprints shall be filed with the State Police and the Federal Bureau of Investigation.
(2) 
All parking enforcement officers shall complete a training course conducted or approved by the Township of Ewing. The Township may waive this training requirement for any person otherwise eligible to be appointed as a parking enforcement officer if the person possesses substantially equivalent training and background, as determined by the Chief of Police.
(3) 
All parking enforcement officers shall be supplied with a uniform which shall clearly identify the officer’s function. The uniform shall include but not be limited to a hat and appropriate badges which shall bear an identification number or name tag and the name of the municipality in which the officer is employed. In addition, the uniform shall include an insignia issued by the municipality which clearly indicates the officer’s status as a parking enforcement officer. The uniform shall be distinct in color from the uniform of a regular police officer or special law enforcement officer.
(4) 
A reasonable fee may be charged, as determined by the Township Council, for issuance of the uniform, but no fee shall be charged for training or for the issuance of the certificate of employment.

No person or property owner shall park, or give any individual permission to park, a motor vehicle on any unpaved surface on any property, whether the property be commercial, residential, or publicly owned property, absent a special events parking permit. A property owner may apply for a special events parking permit to allow short-term parking on an unpaved surface when attendance at a special event is expected to exceed the available parking capacity or for other good cause. Application for a special events parking permit shall be made to the Municipal Clerk 30 days in advance of the special event. The special events parking permit shall be issued by the Township Council after review by the Police Department and the Code Enforcement Department.

A. 
No person shall park or stop a motor vehicle in or in any other manner obstruct a properly designated fire lane. The Township Police Department, as well as parking enforcement officers, shall have the authority to cause said vehicle found in violation to be towed and stored at the expense of the vehicle's owner.
B. 
Fire lane regulations shall be concurrently enforced by the Township Police Department, parking enforcement officers, and the Township Fire Official and Fire Inspectors. Violation of the fire lane regulations shall be considered a violation of the Township parking ordinances, as well as violations of the Uniform Fire Code, N.J.A.C. 5:70-3.1 et seq.
C. 
Enforcement by the Township Police Department or parking enforcement officers shall be handled as a Township ordinance violation or as a Uniform Fire Code violation. Enforcement by the Township Fire Official and Fire Inspectors shall be pursuant to N.J.S.A. 52:27D-210, which provides for penalties under the Penalty Enforcement Law of 1999, N.J.S.A. 2A:58-10 et seq., for violations of the Uniform Fire Code.

No person shall park a vehicle in excess of four tons at the Ewing Senior and Community Center, the Hollowbrook Community Center, and Lou Lamata Soccer Fields at Rambling Creek Park, except for deliveries or Township business.

No person shall park or stop a motor vehicle at any time in front of a public or private driveway or within five feet of the opening of a public or private driveway.
