The following words when used in this Part 4 shall have the following meanings, unless the context clearly indicates a different meaning:
ELECTRIC VEHICLE
Any self-propelled motorized vehicle licensed to travel upon the street, roads and highways of the Borough of Doylestown and capable of receiving and storing electricity via a plug-in, including hybrid electric vehicles.

EV CHARGING STATION
Any level of electric vehicle supply equipment station that delivers electricity from a source outside an electric vehicle into a plug-electric vehicle.

EV CHARGING STATION PARKING SPACE
A parking space with an EV Charging Station, designated as an EV Charging Station Parking Space, and situated so as to allow an electric vehicle to access an EV Charging Station.

INDIVIDUAL PARKING SPACE
Portion of a metered parking zone specified and marked off sufficiently to accommodate a parked vehicle.
PARKING
Standing of a vehicle on or in any of the off-street facilities provided therefor, and whether such vehicle is occupied or not, by an operator or otherwise, for a period in excess of one minute.
PARKING METER
Device which shall indicate thereon the length of time during which a vehicle may park in a particular individual parking space and which may have a receptacle for receiving and storing coins representing currency of the United States of America, and may also have a credit card or debit card reader, and a timing device to indicate the passage of an interval of time during which parking is permissible. Said device shall also display an appropriate signal when the aforesaid interval of time shall have elapsed, brief instructions as to the operation of said parking meter, and the schedule of parking meter rates and times of operation.

VEHICLE
Any type of mechanical device in which persons or property may be transported upon public streets or highways.

The off-street parking lots which shall be subject to this Part 4 shall be those sites described and designated as follows:
A. 
Zone A — Three-Hour Meters.

1. 
The following methods are the approved methods of payment for use of any on-street parking space regulated by parking meter:
A. 
Deposit of coin(s) and/or bills (U.S. currency) where applicable, in the meter.
B. 
Insertion of a valid debit card or credit card in the meter.
C. 
Subject to the provision of Subsection 2 below, purchase of parking time using a telecommunications device (phone, computer, mobile device, etc.) through a payment software application administered by a third-party vendor approved by the Borough of Doylestown.
2. 
Upon proper registration with the approved third-party vendor, any driver or operator of a vehicle may pay for the use of any metered parking space regulated by a single space parking meter through such vendor's payment software application. Users not registered with the approved third-party vendor may not use this payment option. The approved vendor shall be approved and identified by separate resolution of Doylestown Borough Council.
3. 
For users registered to make payment through the payment software application authorized in this section, additional charges, such as processing and other similar fees, may be charged by the third-party vendor for use of the payment software application. These charges are over and above the parking rates established by the Doylestown Borough Council. Such additional charges are not part of the parking rates established by the Doylestown Borough Council, but are set by the third-party vendor for use of its software program. By electing to pay through the third-party administered payment software applications, the registered user accepts and consents to the payment of such additional charges.

1. 
Borough Council may by separate resolution designate any of the parking meter zones and/or parking lots established under §§ 402 and 403 of this Part 4 as a special permit parking zone. All parking meters situate within designated special permit parking zones shall be suitably marked to identify them as being within the special permit parking zone.
2. 
Any person, firm or corporation, including any contractor performing contracting work within the Borough ("contractor applicant"), each an applicant, may make application to the Borough Manager of the Borough of Doylestown for a special permit or permits to authorize the applicant, or any person designated by the applicant, (i) in the case of a contractor applicant, to park a motor vehicle in any parking meter zones and/or parking lots established under §§ 402, 403 and 403.2 of this Part 4; and (ii) in the case of any applicant who is not a contractor applicant, to park a motor vehicle in any designated special permit parking zone, all in accordance with the provisions of this section. A separate application shall be required of and, upon compliance with the provisions of this section, a separate special permit shall be issued to each applicant.

3. 
Applications.
A. 
Fees.

(1) 
Each application for a special permit, other than an application made by a contractor applicant, shall be accompanied by a special permit fee of $60 or such other fee as Borough Council may from time to time, by separate resolution, establish.
(2) 
Each application for a special permit made by a contractor applicant ("contractor permit") shall be accompanied by a special permit fee as follows:
(a) 
$5 for a special parking contractor permit with an effectiveness of one calendar day;
(b) 
$25 for a special parking contractor permit with an effectiveness of one week;
(c) 
$100 for a special parking contractor permit with an effectiveness of one month.
(3) 
All special permit fees shall be nonrefundable upon issuance of the special permits.
B. 
Each applicant shall be solely responsible for each special permit issued to such applicant hereunder, and each applicant shall, upon any such special permit being lost, mislaid or stolen, report such fact, and the number of such special permit, to the Borough Manager.

C. 
Any special permit which has been issued hereunder and which has been lost, mislaid or stolen shall not be replaced by a duplicate permit or a substitute permit; provided, however, that should the applicant find, locate and retrieve any special permit which had been lost, mislaid or stolen, such special permit shall be and remain valid and effective for the remainder of the term for which it was originally issued, and provided further that nothing herein contained shall be construed to prevent any applicant from applying for a new special permit or permits provided the required fee is paid and there is compliance with all other provisions of this section.
D. 
Each application for a special permit shall contain such information as the Borough Manager shall deem necessary to properly administer this section, and such information shall be verified to the satisfaction of the Borough Manager.

4. 
Special Permit Issuance.
A. 
Each special permit issued hereunder, other than a contractor permit issued to a contractor applicant, shall be effective upon issuance and shall automatically terminate and be null and void on July 1 or January 1 next following the date of issuance, whichever should first occur. Each contractor permit issued to a contractor applicant shall be effective upon issuance and shall remain effective for the term for which such permit was issued pursuant to § 403.2, Subsection 3A above.

B. 
Provided that there is compliance with Subsection 4C below, each special permit issued hereunder shall be applicable to any motor vehicle operated by the applicant or by any person designated by the applicant.
C. 
Each special permit issued hereunder shall be affixed to any motor vehicle, parked pursuant to the provisions of this section in a special permit parking zone, in such manner and at such location on the vehicle as shall be determined by the Borough Manager.

5. 
The provisions of §§ 404, 408 and 410 of this Part 4 relating to parking time limits, coin deposit in meters and additional violations shall not apply to any vehicle to which a currently effective special permit has been affixed where: (i) in the case of a contractor permit, such vehicle is parked in any parking meter zones and/or parking lots established under §§ 402, 403 and 403.2 of this Part 4; and (ii) in the case of any special parking permit that is not a contractor permit, such vehicle is parked in a special permit parking zone. Nothing herein contained shall be construed to relieve any person from full compliance with all other applicable provisions of this Part 4.

6. 
The issuance or possession of a special permit shall not guarantee or reserve to the holder thereof any parking space within any parking meter zones and/or parking lots established under §§ 402,403 and 403.2 of this Part 4.

7. 
It shall constitute a violation of this section for any person to furnish false information in an application to the Borough Manager in order to obtain a special permit or to use any special permit issued hereunder without being designated and authorized to do so by the applicant. The Borough Manager shall have the authority to revoke any special permit where the holder thereof violates any of the provisions of this section.[1]

Parking any vehicle other than an electric vehicle in a designated EV charging station parking space shall be prohibited at all times, even when payment of the parking meter rates are not in effect.
4. 
Use of the EV charging station for any purpose other than charging an electric vehicle is prohibited.
5. 
It shall be unlawful and a violation of this Part 4 for any person to deface, tamper with, open, willfully break, destroy or impair the usefulness of an EV charging station, provided that nothing herein shall apply to the servicing of EV charging stations by officers, employees, police officers and/or agents of the Borough under the direction of the Borough Council.

Use of any and all parking spaces regulated by parking meters under this Part 4 shall require payment of the parking meter rates, as designated and approved from time to time by resolution of the Doylestown Borough Council, from 9:00 a.m. until 5:00 p.m. except on Sundays and legal holidays.

Parking meters shall be installed in the parking meter zones established as provided in § 401, and where installed shall be placed upon the sidewalk, immediately adjacent to the individual parking spaces as described in § 404. Each meter shall be placed or set in such manner as to show that the parking space adjacent to such meter is or is not legally occupied. Each meter installed shall indicate by a proper legend the legal parking time established by the Borough and, when occupied, shall indicate by its dial and pointer the duration of the period of legal parking and, on expiration of such period, shall indicate illegal or overtime parking.

Lines and/or markings shall be painted or placed upon the curb, sidewalk and/or street adjacent to each parking meter for the purpose of designating the parking space for which such meter is to be used. Each vehicle parked adjacent to any parking meter shall be parked wholly within the lines or markings so placed and applicable to such meter. It shall be unlawful to park any vehicle across any such line or marking, or to park any vehicle in such a position that such vehicle shall not be wholly within the area so designated by such lines or markings.

When a parking space in any parking meter zone is parallel with the adjacent curb or sidewalk, any vehicle parked in such parking space shall be parked so that the vehicle shall be nearest to the parking meter; when a parking space in any parking meter zone is diagonal to the curb or sidewalk, any vehicle parked in such parking space shall be parked with the vehicle nearest to such meter.

Any person who causes a vehicle to be parked in a parking space shall use an approved means of payment for the parking meter adjacent to such space, according to the time limits and rates indicated on the meter. Notwithstanding the rates established in § 408.1, all payments by credit card and debit card may be subject to a minimum.

The rates for on-street parking and metered lots will be specified by resolution of the Doylestown Borough Council and shall take effect on the date established by the resolution.

Any person or persons who cause a vehicle to remain in a parking space after the prescribed time has elapsed is hereby determined to be illegally parked; and each additional hour that such person or persons permit such vehicle to remain in an individual parking space after the prescribed time for parking has elapsed is hereby declared to be an additional violation. The fact that a vehicle is in an individual parking space when the time signal on the parking meter regulating said parking space shows that no parking is permitted, or that the time has expired, shall be deemed prima facie evidence of the unlawful parking of said vehicle by its operator and/or owner. The elapse of one hour from the time reported on the notice to the owner or operator of a motor vehicle, shall be deemed prima facie evidence of additional violations of the parking of said motor vehicle by the operator or owner.

It shall be unlawful and a violation of this Part 4 for any person to deface, tamper with, open or wilfully break, destroy or impair the usefulness of any parking meter, or parking meter stand or coin depository installed under the provisions of this part, provided that nothing herein shall apply to the servicing or opening of parking meters by officers, employees and/or police officers of the Borough under the direction of the Mayor and/or the Borough Council.

It shall be the duty of the police officers, or other designated person(s) of the Borough, in accordance with the instructions of the Borough Manager, to report all violations of any provision of this Part 4, indicating, in each case:
1. 
The section thereof violated;
2. 
The location where such violation took place; including the parking meter at which the vehicle was illegally parked;
3. 
The state and license number of such vehicle;
4. 
The date and time of violation;
5. 
The date and time of the notice of the violation;
6. 
Other facts deemed necessary for a clear understanding of the circumstances attending the violation.
Every such police officer shall place upon such vehicle a notice to the owner or driver thereof that such vehicle was parked in violation of a provision of this Part, and shall indicate on the notice, the date and time the notice was placed on the vehicle.

The Borough Council may suspend in whole or in part the parking meter regulations set forth in this Part 4 during such days and hours as may be designated by them.

1. 
Any person, firm, corporation or owner of any vehicle parking in violation of any section or provision of this Part 4, or aiding, abetting or assisting the violation thereof, shall be assessed a fine in accordance with the following schedule:
A. 
Twenty-five dollars, unless otherwise specified in Subsection 1.C below, for each separate parking violation if paid within 10 days of the date that the notice of violation was issued. The owner or driver may discharge the fine by paying $25 within the time limit indicated on the ticket by the following means: a) in person at Borough Hall between the hours of 8:30 a.m. and 4:30 p.m.; b) via telephone as indicated on the tickets; c) by mail, with a check or money order mailed to Borough Hall; or d) online, through the Borough website. If the fine is not paid within 10 days, the fine increases to $50, again payable within 10 days.

C. 
Fifty-dollar fines:
(1) 
Fifty dollars for the following:
(a) 
A second parking violation that occurs within 10 days.
(b) 
A violation of § 403.3 of this Part 4, regarding EV charging station parking, or § 411 of this Part 4, depositing a coin in a meter or making other payment to extend parking time beyond the legal limit.
(c) 
Any violation subject to fine under Subsection 1A that is not paid within 10 days.
(2) 
The fines set forth in this Subsection 1C are payable within 10 days, by means set forth in Subsection 1A of this section. Any fines not paid within 10 days shall be referred for institution of a criminal proceeding, subject to the process set forth in Subsection 1D.
D. 
If a fine assessed under Subsection 1A, B, or C of this section is not paid within 10 days, or the maximum allowable time as indicated, a criminal proceeding shall be instituted by either a law enforcement officer or means of electronic transmission of the information to the Magisterial District Court. Except as provided in Subsection 1E below, any person assessed a fine for a violation of any section of this Part or the procedures adopted pursuant thereto who does not pay the fine within the allowable time shall, upon conviction, be sentenced to pay a penalty of $50 for each violation, together with costs of prosecution.
E. 
The violation of § 412, Tampering with Meters Unlawful, is a criminal act punishable as a felony, misdemeanor, or summary offense depending on the extent of the damage inflicted. The Borough Council shall designate a person or persons who shall collect the coins in the parking meters and deliver the same to the depository.
