This chapter shall be known as "The Jackson Township Park Rules and Regulations Ordinance."
This chapter shall regulate the activities of persons in any park owned or operated by Jackson Township.
The park shall be open from sunrise to sunset.
A. 
Fires are not permitted in the park.
B. 
Food grilling is allowed, provided that grills are powered by propane only. No charcoal or wood-fired grills are permitted.
All persons using the park facilities shall protect, wherever possible, wildlife in the park. To accomplish this goal, the following is prohibited:
A. 
No person shall injure, deface, climb, mutilate, pull up, remove, or destroy any vegetation in the park, whether sod, tree, brush, shrub, vine, fern, flower or fruit.
B. 
No person shall hunt, trap, chase, capture or molest in any manner whatsoever wildlife of any kind or disturb the nests or eggs of birds or fish or homes of animals.
The discharge of any type of firearm, bow and arrow, paint ball marker, air gun, sling shots, fireworks or any other weapon within the limits of the park is prohibited.
Disorderly and/or immoral acts or practices are prohibited, including:
A. 
The possession and/or use of alcoholic beverages or illegal drugs within the park.
B. 
No person shall sell, peddle or advertise any tickets, articles or services in the park.
C. 
No person shall be intoxicated, under the influence of illegal drugs, gamble or use threatening, abusive, insulting or indecent language, fight or commit disorderly or immoral conduct of any kind.
D. 
No person shall post, display or distribute any banner or poster of private, commercial or political nature.
E. 
Offering anything for sale.
F. 
Parking of vehicles in other than designated parking areas.
G. 
Careless and unsafe operation of any nonmotorized, human-powered equipment, including bicycles, tricycles, skateboards, etc.
H. 
Trespassing onto adjoining properties without permission of owners of those properties.
I. 
Any practices endangering the welfare and safety of others, including the hitting of golf balls or tossing lawn darts and their like.
Dumping of rubbish, leaving trash on the park and littering of any kind are prohibited.
It shall be unlawful for anyone to deface, mutilate, mistreat, abuse, destroy, mark, write or paint upon anything in the park whether natural or man-made.
Use or operation of motorized vehicles in the park is prohibited except in designated parking areas during the normal hours the park is open. ATVs, snowmobiles or any four or more wheeled, or tracked vehicle, and recreational vehicles are prohibited anywhere in the park, including the designated parking areas.
A. 
Groups with reservations shall have the sole use of designated reserved areas for the duration of the reservation.
B. 
All reservation permits will be issued by the Jackson Township office staff, and a deposit and rental fee set by the Board of Supervisors by resolution will be required to ensure proper use and care of park property. Costs for cleanup and/or repair of any damages determined to be caused by the rental party and discovered during a post-rental inspection of the facilities by Township personnel will be retained from the deposit amount. If cleanup and/or damage fees exceed the deposit amount, the difference will be invoiced to the permit applicant. Invoiced amounts not paid within 30 days of such invoice shall bear interest at a rate of 1% per month until paid. The Township may proceed to collect any amounts invoiced hereunder in accordance with law, and the individual signing the application shall be deemed liable for such amount due, including any and all costs of collection, including attorney fees and costs.
C. 
Reserved use of the pavilions, courts, and ball fields shall be by permit only.
A. 
Pets are permitted in the park and must be leashed and under the direct control of the owner at all times. Pet waste must be cleaned up, bagged and removed from the park by the pet owner.
B. 
Equestrian activities are prohibited.
A. 
The park is primarily for the use of the Township residents; however, as Township property, no discrimination shall be permitted between residents of the Township and visitors from other areas.
B. 
Parents are responsible for the safety and behavior of their children within the park, and no Township supervision will be available or provided.
C. 
Users of the park shall respect the rights of others and conduct themselves in a manner acceptable and becoming to others. Users of the park are required to follow the direction of Township personnel, or other duly authorized authorities, who are working in or monitoring the park and activities.
Any person found guilty of a violation of this chapter in a summary criminal proceeding before a District Magistrate shall pay a fine of not more than $1,000 and not less than $50 and the costs of prosecution, and in default of payment of such fines and costs of prosecution, shall be imprisoned for not more than 10 days; provided, each day's continuance of a violation shall constitute a separate offense.
The provisions of this chapter may be enforced:
A. 
By a law enforcement officer instituting summary criminal proceedings by citations as provided by law; or
B. 
When the affiant is not a law enforcement officer, the affiant shall institute a criminal proceeding by filing a complaint with the District Magistrate as provided by law; or
C. 
By another proceeding now or hereafter authorized by law.
