Generally. The following industrial users are required to apply for a wastewater discharge permit:

Existing users. Existing users must apply, if they have not already applied, for a wastewater discharge permit within 90 days of the effective date of this Article.

New users.
(1)
A new user or a new point source discharge of an existing user, for which a permit is required, must apply for and receive a wastewater discharge permit prior to making any new discharge into a POTW.
(2)
Any user not required to obtain a permit for existing discharges must apply for and receive a wastewater discharge permit prior to changing its discharge in such a manner that the resulting discharge would require a permit.
D.
Permit modification.
(1)
A user must apply for a new permit even though he already has a wastewater discharge permit for a point source discharge whenever the characteristics of the point source discharge are materially altered. The user must apply for and receive a new wastewater discharge permit prior to making any material alteration of a currently permitted discharge.
(2)
Within nine months of the promulgation of a Federal Categorical Pretreatment Standard or pretreatment requirement or such short a time as specified within the standard or requirement, the wastewater discharge permit of a user subject to such standard shall be revised to require compliance with such standard within the time prescribed by such standard. The user shall reapply for a wastewater discharge permit within 90 days after promulgation of the new pretreatment standard.
(3)
A user must reapply for a permit whenever the mass loading of pollutants contained in the permitted discharge exceeds the average daily quantity applied for by greater than 10%.
(4)
A user may reapply for a wastewater discharge permit whenever the user believes that some of the permit requirements no longer apply.
