A. 
Generally. The following industrial users are required to apply for a wastewater discharge permit:
(1) 
Any user subject to a Federal Categorical Pretreatment Standard;
(2) 
Any significant industrial user;
(3) 
Any user required by state pretreatment requirements to obtain a permit; and
(4) 
Any other user directed by the Authority to apply for a permit.
B. 
Existing users. Existing users must apply, if they have not already applied, for a wastewater discharge permit within 90 days of the effective date of this Article.
C. 
New users.
(1) 
A new user or a new point source discharge of an existing user, for which a permit is required, must apply for and receive a wastewater discharge permit prior to making any new discharge into a POTW.
(2) 
Any user not required to obtain a permit for existing discharges must apply for and receive a wastewater discharge permit prior to changing its discharge in such a manner that the resulting discharge would require a permit.
D. 
Permit modification.
(1) 
A user must apply for a new permit even though he already has a wastewater discharge permit for a point source discharge whenever the characteristics of the point source discharge are materially altered. The user must apply for and receive a new wastewater discharge permit prior to making any material alteration of a currently permitted discharge.
(2) 
Within nine months of the promulgation of a Federal Categorical Pretreatment Standard or pretreatment requirement or such short a time as specified within the standard or requirement, the wastewater discharge permit of a user subject to such standard shall be revised to require compliance with such standard within the time prescribed by such standard. The user shall reapply for a wastewater discharge permit within 90 days after promulgation of the new pretreatment standard.
(3) 
A user must reapply for a permit whenever the mass loading of pollutants contained in the permitted discharge exceeds the average daily quantity applied for by greater than 10%.
(4) 
A user may reapply for a wastewater discharge permit whenever the user believes that some of the permit requirements no longer apply.
A. 
Requirements. A user required to apply for a wastewater discharge permit shall complete and file with the Authority an application in the form prescribed by the Authority and accompanied by a fee as prescribed by the Harford County Code. In support of the application, the user shall submit in units and terms appropriate for evaluation, the following information:
(1) 
If the user is an individual or proprietorship: the name, home and business addresses and phone numbers of the proprietor; the address of the location of the proposed discharge; and the name, address and phone number of the owner of the building, structure or property where the proposed discharge is located, if different from that of the individual or proprietor.
(2) 
If the user is a partnership: the full name of the partnership; its state of formation; its principal address; and the name and the business and home addresses and phone numbers of each general partner. If the partnership is a foreign partnership: proof of its registration and qualification to do business in the State of Maryland. Also, the partnership shall specify the location of the proposed discharge and the name, address and phone number of the owner of the building, structure or property where the proposed discharge is located, if different from that of the partnership.
(3) 
If the user is a corporation: the full name, address and phone number of the principal office of the corporation and the principal office in the State of Maryland of the corporation; the state of incorporation; and proof of its registration or qualification to do business in the State of Maryland, if the corporation is not a Maryland corporation. In addition, the corporation shall specify the name, addresses and phone numbers of the president, vice president, secretary and treasurer of the corporation and the name, addresses and phone numbers of any authorized representative along with the written authorization verifying the Authority of the authorized representative. The corporation also shall provide the location of the proposed discharge and the name, address and phone number of the owner of any building, structure or property where the proposed discharge is located, if other than the corporation.
(4) 
The user's SIC number determined in accordance with the Standard Industrial Classification Manual issued by the Executive Office of the President, Office of Management and Budget, 1972, as amended.
(5) 
Time and duration of contribution.
(6) 
Signature of an authorized representative of the user and, in the event the user must pretreat a discharge pursuant to the Act as defined herein, any state law or regulation or this Article, a representative who is certified to be a qualified professional and capable of determining whether the pretreatment satisfies the requirements of the Act as defined herein, the state law or regulation and this Article. The signing parties shall indicate whether pretreatment standards are being met on a consistent basis and, if not, whether additional operation and maintenance or additional pretreatment is required.
(7) 
Any other information deemed by the Authority to be necessary to evaluate the permit application or required by the water and sewer regulations promulgated by the Authority.
B. 
Application fee. The Authority shall adopt rules and regulations which establish a reasonable application fee designed to cover the costs of the permitting process.
C. 
Industrial and commercial user categories. Any industrial user which discharges a toxic pollutant or is required to pretreat its discharges to bring the discharges into compliance with the requirements of § 256-59 shall be classified and categorized as follows:
(1) 
Category A: sewer flows of 1,000 gallons per day or less.
(2) 
Category B: sewer flows greater than 1,000 gallons per day and less than 10,000 gallons per day.
(3) 
Category C: sewer flows of 10,000 gallons per day or greater.
(4) 
Category D: any commercial or industrial user of any sewer flow not meeting the conditions listed under § 256-61A, but who stores, processes or disposes of hazardous substances, hazardous wastes or controlled hazardous substances as defined in federal and state statutes and regulations shall be classified and categorized as Category D.
(5) 
Category C-C: a significant industrial user.
