No person, firm or corporation being the owner or occupant of
any land or premises within the Town of Martinsburg shall use or permit
the use of such land as a location for a mobile home without obtaining
a permit therefor as hereinafter provided and without complying with
the following requirements and regulations:
A.
Each mobile home lot shall have a minimum lot frontage of 200 feet.
B.
Each mobile home lot shall have a front yard of a minimum of 70 feet.
C.
Each mobile home lot shall have a minimum side yard size of 25 feet.
D.
Each mobile home lot shall have a minimum back yard size of 20 feet.
E.
Each mobile home lot shall contain at least 20,000 square feet.
F.
Each mobile home shall be enclosed between the bottom and the ground
with a durable fire-resistant material.
G.
Each mobile home shall be equipped with at least one smoke or heat
detector or combination to give warning to occupants in case of fire.
H.
Each mobile home shall have an adequate water supply system that
is located at least 100 feet from the sewage disposal system.
I.
Each mobile home shall have a sewage disposal system. If such sewage
disposal system is not supplied by a municipality, the sewage disposal
system shall be by means of a septic tank and underground absorption
bed. The septic tank shall be not less than 10 feet from the structure
and not less than 100 feet from any well used as a water supply. The
absorption bed shall be located not less than 100 feet from any well
nor less than 20 feet from the lot line.
J.
Each mobile home shall be placed upon an adequate foundation for
the placement allowing tie-down of the mobile home, securing the superstructure
against uplift, sliding, rotation and overturning. Such foundation
shall be sufficient so that the mobile home shall not heave, shift
or settle unevenly under the weight of the mobile home. Such foundation
shall be provided with anchors and tie-downs such as cast-in-place
concrete "dead men," eyelets imbedded in concrete foundations or runways,
screw augers, arrowhead anchors or other devices securing the stability
of the mobile home. Anchors and tie-downs shall be placed at least
at each corner of the mobile home stand and shall be able to sustain
a minimum tensile strength of 2,800 pounds.
L.
All mobile
homes shall be in compliance with standards equal to or more stringent
than the United States Department of Housing and Urban Development
(HUD) Manufactured Mobile Home Construction and Safety Standards,
24 CFR 3280 (1976). The applicant is responsible for providing adequate
evidence that these standards have been complied with. The presence
of a permanent certification label affixed to the mobile home by the
manufacturer shall be presumptive evidence that the construction of
a mobile home is in compliance with such standards. In all other respects,
mobile homes shall be subject to all applicable portions of this chapter
pertaining to single-family dwellings.[2]
A.
The application for a permit to locate a mobile home in the Town
of Martinsburg shall be completed in duplicate, containing sufficient
information to show that the regulations of this chapter are being
complied with and accompanied by two copies of a plot plan drawn to
scale showing dimensions of the parcel of land proposed to be used
as a site, the location of the mobile home thereon, the location of
existing or proposed water supply and the location of existing or
proposed method of disposing of sewage.
B.
Upon receipt of application for a permit to locate or remodel a mobile
home, the Town Clerk shall transmit the same to the enforcement officer
for the Town of Martinsburg who shall make an examination of the site
described in said application and report his findings to the Town
Board. After receipt of such report the Town Board shall approve or
disapprove the issuance of a permit applied for.
C.
If the application is for a permit upon an already existing mobile
home site, a copy of said application, when approved by the Town Board
and signed by the Town Clerk, shall constitute a permit.
D.
If the application is for a mobile home use which has not been completed,
the approval of an application shall be a permit to complete the permitted
project. The applicant shall notify the Town Clerk of when the structure
is ready for final inspection. The enforcement officer shall promptly
make a final inspection and, if satisfied that the regulations pertaining
to the project have been complied with and that the project has been
completed as specified upon the original application, the enforcement
officer shall issue a certificate of compliance granting final permission
to use this structure.
A fee of $50 shall be charged for issuing a permit pursuant to § 145-12 of this chapter as pertains to locating an individual mobile home; payment to be made at the time application is filed.
Upon application from a senior citizen defined as the owner of property who is 65 or more years of age and upon a showing of an annual income by such senior citizen of $3,500 or less, the permit fee required of § 145-13 shall be waived for such senior citizen making application hereunder.
