This chapter shall be known as the "Chestnuthill Township Park and Recreation Areas Ordinance."
This chapter shall regulate the general rules and regulations for all parks and recreation areas. Additionally, it will enable the Board of Supervisors to establish rules and regulations relating to activities and users of the Chestnuthill Township Park and recreation areas. The Supervisors shall adopt via resolution rules and regulations that apply to specific Township park and recreation areas.
The possession, distribution and/or consumption of alcoholic or intoxicating beverages or illegal drugs is strictly prohibited throughout all Township park and recreation areas.
The Township may from time to time restrict access to certain areas under construction or designated for further development. Written notice of restricted access will be posted at the Township Administration Building, at the Community Center Building, at and at appropriate locations.
The Township may enforce the terms of this chapter through appropriate signage and reference to this chapter, as may be amended. Signage shall not be a prerequisite to enforcement.
The use of all ball fields, playground equipment, barbecue pits and other outdoor equipment shall be subject to published rules and regulations which the Township reserves the right to adopt, supplement or modify from time to time via resolution.
In addition to other prohibited conduct set forth in this chapter, the following conduct is expressly prohibited:
A. 
No person shall conduct himself or herself in a disorderly, immoral or harassing manner, use indecent or obscene language or damage or destroy the property, buildings, fixtures, equipment, signs or other man-made material in the park.
B. 
No person shall violate any rule or regulation authorized by this chapter, provided that same is adopted by the Board of Supervisors and conspicuously posted in accordance with Act 60 of 1995, Article XXII, Section 2203.[1]

C. 
No person shall remove any bench, seat or table from the park or change the location thereof without permission from the Township.
D. 
No person shall set up any booth, table or stand for the sale of any article whatsoever within the limits of the park without the written consent of the Township, which shall have authority to refuse such consent in any instance.
E. 
No person shall injure, deface or destroy any notice, rule or regulation posted at any place within the park by authority of the Township, nor shall any person post, at any place within the park, any notice or placard other than by authority of the Township.
F. 
No person shall climb any tree or sit, stand or walk on any park sign, park structure or park building not customarily utilized for such purposes.
G. 
No person shall erect tents, shacks, shelters, trailers or any other structure for overnight camping or otherwise without express Township approval.
The Board of Supervisors may adopt site-specific rules and regulations for individual park and recreation areas. The site-specific rules and regulation will be adopted via resolution and conspicuously posted in accordance Act 60 of 1995.
A. 
This chapter shall be enforced by action brought before a District Justice in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. Any person, partnership, corporation or other entity who or which violates or permits a violation of the provisions of this chapter shall, upon conviction in a summary proceeding, pay a fine of not less than $100 nor more than $1,000 per violation, plus all court costs and reasonable attorneys fees incurred by Chestnuthill Township in the enforcement proceedings, and/or be imprisoned to the extent allowed by law for the punishment of summary offenses. Each day or portion thereof that a violation exists or continues shall constitute a separate violation. Each section of this chapter that is violated shall also constitute a separate violation. Further, the appropriate officers or agents of Chestnuthill Township are hereby authorized to seek equitable relief, including injunction, to enforce compliance with this chapter. All fines, penalties, costs and reasonable attorneys' fees collected for the violation of this chapter shall be paid to Chestnuthill Township for its general use.
B. 
The Township reserves the right to bring any other action at law or equity to enforce this chapter. Remedies shall be cumulative and not exclusive.
C. 
The Township's Zoning Officer and any other Township officer and agent which may be designated from time to time are authorized to enforce the terms of this chapter and all parks and recreation areas rules and regulations adopted via resolution.
