It has been determined that air pollution from outdoor wood-fired
boilers may be detrimental to the health, comfort, living conditions,
welfare, and safety of the citizens of the Township, and it is hereby
declared to be the policy of the Township to regulate and restrict
the use of outdoor wood-fired boilers in order to safeguard the citizens
of the Township from air pollution. The provisions hereof apply to
the installation and use of outdoor wood-fired boilers within the
Township. The provisions hereof do not apply to: grilling or cooking
using charcoal, wood, propane, or natural gas in cooking or grilling
appliances, burning in a stove, furnace, fireplace, or other heating
device within a building used for human or animal habitation, the
use of propane, acetylene, natural gas, gasoline, or kerosene in a
device intended to provide heating for construction activities.
Outdoor wood-fired boilers are prohibited in all districts, whether as a primary use or an accessory use, except that the Board of Supervisors may permit a Phase 2 outdoor wood-fired boiler by conditional use in the R-1 District under § 143-32D, and in the I District under §
143-133D, as hereinafter provided.
Phase 2 outdoor wood-fired boilers may be permitted by the Board of Supervisors by conditional use in the R-1 Residential District under § 143-32D and in the I District under §
143-133D, provided there is compliance with the standards set forth in §
143-80 and provided there is compliance with all of the following standards and requirements.
A. The Phase 2 outdoor wood-fired boiler shall be set back at least
150 feet from all property lines, including, without limitation, 150
feet from the street line. The Phase 2 outdoor wood-fired boiler shall
have a permanent attached stack with a minimum stack height of 10
feet above the ground that also extends at least two feet above the
highest peak or highest point of the roof of any occupied building
located less than 150 feet from the outdoor wood-fired boiler.
B. The fuel used for the Phase 2 outdoor wood-fired boiler shall be
limited to the following, and no other fuel shall be used: clean wood
or wood pellets made from clean wood. The following fuel is also permitted
when used as a starter fuel or supplemental fuel for a dual-fired
boiler: home heating oil, natural gas or propane.
C. The Phase 2 outdoor wood-fired boiler shall not be used or operated
between the dates of May 1 and September 30 of any year.
D. The Phase 2 outdoor wood-fired boiler shall be used or operated in
compliance with all applicable state, local, and federal regulations.
