The Town Board of the Town of Orangetown takes cognizance of
the fact that all of the cemeteries within the Town are sacred and
revered places and that in order to ensure their preservation, protection,
tranquility and dignity and to ensure their peacefulness and good
order, it does hereby, pursuant to Town Law § 130, enact
this local law.
It shall be an unlawful trespass for any person to enter or
remain upon the lands or grounds of any cemetery located within the
Town of Orangetown between one hour after sunset and one hour prior
to sunrise, except during the course of working or caretaking therein,
interment or memorial services or a religious ceremony or observance.
It shall be unlawful for any person to transport, carry or consume
any alcoholic beverage upon the lands or grounds of any cemetery located
in the Town of Orangetown, except during and as part of interment
or memorial services or a religious ceremony or observance.
It shall be unlawful for any person to throw, drop or place
any can, bottle, litter or rubbish upon the lands or grounds of any
cemetery located within the Town of Orangetown.
Upon the written request of the owner or management of any cemetery
located within the Town of Orangetown, the Department of Public Works
of the Town of Orangetown may post "no trespassing" signs at the entrances
of said cemetery.
Any person violating any of the provisions of this local law
shall be subject to a fine not to exceed $250 or a jail term not to
exceed 15 days, or both.
Each separate provision of this local law shall be deemed independent
of all other provisions herein, and if any provisions shall be deemed
or declared invalid, all other provisions hereof shall remain valid
and enforceable.
This local law shall become effective immediately upon filing
with the Secretary of State.
